    • Had a letter response today dated 12/6/24 from PRA Group re request for information consumer credit act 1974. Confirming they are in receipt of my CCA letter request - and that they are requesting the required information. They returned the £1 postal order. And my CCA letter. Stating that they will contact me with an update ASAP. They attached/included a standard ( non personal ) page about ' what they should provide ' and ' what happens If I don't get this information'.    I need to file my defence by 21 June 24. Any suggestions as to what that defence should be ?   
    • Thanks @dx100uk for responding promptly.    To be quite honest with you, applying for breathing space might not really help except some short term relief. I don’t want to default either as I might lose my job too and I cannot really afford it. Sorry for sounding bit stupid but is there something I can do to stop them charging interest and agree on reduced payments? I am working on information that @BankFodderhas requested and will be sharing it later today.

Received a letter today from Resolvecall to say that I have been removed from their files and my account has been closed, it continues to say that I maybe contacted in future by Intrum or another debt collection agency. Do you think it’s worth finding Itrums address and sending them the same letter? Thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

 

I have applied for a HSBC loan for 7500 pounds but have been referred online, When I rung up the customer service rep. was also surprised along with his supervisor of why I have been rejected. My case has been forwarded to a team for review.

 

What I don't understand is, that I have never missed a single DD payment ever in my life. I had a HSBC loan for 2,000 which I settled a day before applying so that I have no loan with HSBC, which should have been a good thing as I have settled the loan early. I have an overdraft, a credit card with vanquis.

 

I have a permanent income which is well above the average wage as I'm a higher education lecturer.

 

I've been told by HSBC over the phone that I'll be contacted in one working day i.e. Saturday (as they are open on Saturday).

I really don't know what has happened as I have never even missed a single dd for my TV license. HSBC have really put me off because I have been banking with them for such a long time and have such a good history with them.

 

I hope HSBC get back to me with good news, but I don't understand why I was referred online, as I had settled my existing loan a day before, and I had never missed a single payment for that loan. So why have I been referred.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'd personally advise you not to go with HSBC. To cut a long story short, HSBC put a "default" on my credit file WITHOUT notifying me and I couldnt get a mortgage for a house last year as my credit checks came back failed several times. So in the end I purchased my credit file and it said "HSBC Default of £216.49" which wasnt my fault in the first place.

 

Now if they didnt notify me that they we're going to do doubt they would discuss your refusal.

 

You should be able to get credit with a good credit record. Make sure you dont have any defaults on there.

 

Personally I would go with TSB or Natwest for bankign/credit etc.

 

Goodluck and let us know the outcome.

I went all the way to court to seek compensation for "damage to creditworthiness" against HSBC. I lost unfortunately.

I have had a call from them saying that they will be offering me an APR of 17.4% after doing some FURTHER checks! I mean they had an offer on for 6.2% APR, and now this is what they are doing. They have given me a further 48 hours waiting time for the final checks! I have been banking with HSBC for so long, last time I applied for a loan for 2000, It was in my bank account in 5 minuted, I have settled that loan and don't know why this time they are taking so long. I have banked with HSBC all my life and they are the only ones I bank with.

Further to this, HSBC have been telling me to transfer my credit card with them for so long, everytime I ring them, after this hassle should I really transfer my credit card with HSBC?

you shouldnt always restrict yourself to 1 bank!! If you have a few accounts and remain good with the different banks this allows a good relationship for you and the banks to establish!! So such issues can be resolved a lot quicker!

with regard to the rate of the loan, you may just simply be in the wrong postcode

 

You can have a perfect payment history but if you live in an area where a number of people have failed to pay then you are tarred with the same brush unfortunately....

You state you paid off a loan the day before? alarm bells as to why may have rung? HSBC work in a world of their own

Don't put all your eggs in one basket, HSBC can be tricky to deal with. Dealing with them for years, if you can get the best rate credit card you can, but not with your bank. I have found Natwest to be very good and supportive through hard times, I also have Barclays for day to day.
