    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.
    • JK: Yeah That's correct. We left rent payment coming out of his bank account from January 2023 - August 2023 until we could find somewhere to sort out his belongings which was fine. I tried to give notice a few times from August 2023 asking for advice from Sanctuary housing how we went about this explaining his condition and that he was in a Nursing home from December 2022. I explained we don't have any legal powers to his account like POT but were in the process of going for Deputyship and that I was the named person to act on his behalf to speak with Santuary housing. I said we could provide details of his condition and proof he was now in a nursing home with date he moved in. This went ignored despite repeated attempts to contact them until a housing manager contacted us end of February 2024 and notice was finally accepted with his tenancy coming to an end March 22 2024. Although they have continued to take rental payments for the flat despite someone else living in it from the 1st April. I wasn't aware payments were still being taken till I checked his May banks statements. I had asked them to back date rental payments to August 2023 when I gave notice rather than just giving notice in March 2024 but they've ignored that bit. I don't see why they shouldn't give it back they've taken money they shouldn't have. Thanks DX, I wasn't aware we could do that for that length of time. I'll ask my wife to check with the bank this week

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anybody advise me please?

 

I had an interview for a job I really, really, wanted. I didn't get the job, I was in the top 3 but they offered the job to another woman initially, she declined, then they offered it to the second person, a male and he accepted, started the job.

 

This may sound really silly and I am hoping somebody, detached from it all, can give their true opinion.

 

Problem I have is that I had been doing this job on a temporary basis for annual leave cover twice over the year, then recently again for the third time, whilst they advertised for the role on a permanent basis. I applied, got invited for an interview (I was working there at the time), and watched as all the candidates come to the office for their interview, I was the last one interviewed, only the 2 candidates, other than myself, were 'in the running', so to speak, so I was really excited as I had expressed how much I enjoyed working there and also how nervous I was because I really wanted the job. It was 'odd' that for the first time ever HR came to the office to interview alongside the Manager. Well it seems that HR thought I didn't answer the questions fully enough, I agree I didn't because I was so nervous on the interview, but I did tell HR I was nervous because I really wanted the job, but alas, I was unsuccessful. What's the problem, well I feel cheated and I'm not sure if I'm being PC or not, ut I'm a white 54 year old woman and feel that I was discriminated against as the first candidate they offered the job to wanted more money and the second candidate who did take the job, who arrived 20 minutes late for the interview and did not even apologise but HR said 'that's not a big problem, we can get past that'. I thought being late for an interview was a big problem. Am I being over sensitive? I don't feel fairly treated as I have never been late to work, and have been asked back there 3 times to work as a temp so they are obviously pleased with my work, I'm really confused on this.

Hi there

 

For discrimination to occur, you have to be treated less favourably on the grounds of a protected characteristic, the main ones being race, age, sex or disability (but there are 9 in total). Do any of these apply to you, compared with the two people ahead of you who were offered the role?

 

If not, and by your own admission you performed poorly at interview, then no, it's probably not discrimination as an employer can choose who they wish to fill a job role.

It's more common in public sector roles, btw, and most commonly found in employers addressing a disability equality balance, but it's still possible if ethnic minorities or young people are significantly under represented in the company.

But would they tell me that was the reason. I feel silly about this because I know I did not give my best on the interview, although I was actually doing the job with no problems and the Manager was very happy with my work. How could HR just 'overlook' the disrespect of arriving 20 minutes late for an interview with absolutely no excuse or apology? Also, both these candidates were currently in work and I have been trying so hard to get a job for over a year! It doesn't seem fair at all with the current unemployment.

I don't think being late to interview is fatal these days, if I'm honest. Its also not discrimination or unlawful to hire someone already in employment, in fact most employers see this as favourable!

 

If you genuinely believe you were discriminated against unlawfully (rather than just being treated unfairly, and there is a difference in law) then you could submit a discrimination questionnaire... But this could make your current position at work difficult, so think carefully whether it's worth it!

In that case, maybe you have nothing to lose, depending on whether you need the reference? If you do submit a discrimination questionnaire, you can ask what interview questions were asked to each candidate and the reasons they were chosen over you. Again, however, you may be burning your bridges, so I'd think carefully.

I agree that being late is no killer if there is a reason and the candidate is good.

 

Is is public or private?

 

 

My previous employer told me that candidates may be able to ask to see interview notes, hence they keep them written down.

Well, to be honest I don't think I have nothing to lose. I would like to know why HR were there and how an obvious sloppy attitude to an interview, should have mentioned when asked if he had a problem finding the office he said no. But I do want to pursue this as I do feel truly upset and fed up with the situation

Hi Theghost, it's housing, so does that count as public sector? I just don't understand that if I have been doing the job, on three occassions, with no problems, how can it be fair to offer to somebody else simply because I was nervous, too keen, on the interview and I know I should 'tread carefully' but hey, I've been kicked in the backside, I can't just roll over and not protest can I?

At least it would not have made me feel like I was good enough to do the job, and then to pull the rug out from under me and then say I wasn't good enough to do the job:-(
