      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

My mother passed away just before Christmas with no will and leaving no estate.

 

My family have now discovered that she had a few debts one of which was to a catalogue company. We advised the company of her death and even sent them the certificate.

 

They have now passed the debt to Phillips & Coen Associate Ltd who are demanding the debt is paid.

 

Phillips & Coen want us to call them to discuss this but I am reluctant to do so as I've been warned that once they have your telephone number they will harass you continually.

 

Can anybody help me?

send a letter to phillips and coen with a copy of the death certificate

 

tell them there is no estate (i take it there is no MR) AND YOU NOW CONSIDER THE MATTER CLOSED AND THAT THEY CLOSE DOWN THE ACCOUNT THAT HAS NO BEARING ON ANY OTHER DATA SUBJECT

 

recorded delivery and never give your phone number out

 

phillips and cohen have gone into the probate market, that is why they are contacting you

 

very distasteful

Well they are not entitled to receive any money. If there is no estate to settle any debts, then any creditors will just have to accept the loss.

 

In these circumstances, it is sometimes best to involve someone independent e.g Citizens Advice or a solicitor. They might suggest finding out about all debts and doing a one off letter to all creditors advising them of the situation. Then hopefully you will hear no more.

 

I suspect that once the credit record is noted as deceased, then creditors will soon realise the situation anyway.

Hi, thanks for your prompt reply.

 

I advised them that there was no estate and that no will was left but they ignored it and passed it to Phillips & Coen. I do have a step-father but he was unaware of the debts also. He is now worried that they will chase him though.

 

I'm sure there's nothing they can do but it is very worrying all the same.

Your stepfather is not responsible for your Mother's debts either. There is no estate therefore the creditors are going to be unlucky.

 

I would copy your letter to the OFT so they are aware of the unpleasant actions of these people.

 

Under no circumstances telephone them. Send your letter via a tracked method.. Special Delivery is probably the best.

They are clutching at straws, if there was no estate and no assets they get nothing it's as simple as that. Neither your step-father nor you or your siblings are personally responsible for any remaining debts.

 

If they were to try and pursue this through the legal system they would be laughed from the court.

Just when you thought that there was nothing more despicable than a DCA, along come Philllips Coen to prove you wrong. We have come across them, and their unspeakably unsavoury methods, before.

 

I would be inclined to send Phillips Coen a short letter, to make the position absolutely clear:

 

Dear Curs

 

I refer to your letter dated xxx about my late mother.

 

As (catalogue company) are aware, my mother died leaving no estate. For the avoidance of any doubt, other family member will be making any payment, or responding to any further correspondence in relation to this matter.

 

Your letter has caused considerable distress, and any further contact from yourselves will be construed as harassment and reported accordingly.

 

I trust the position is now clear. If you do not understand any part of this letter, you should seek professional advice.

 

Yours etc.

 

I would be very interested to see a scanned copy of Phillips Coen's letter (with personal details removed); I am researching some aspects of the way they work with a view to bringing formal complaints with regulators.
