Hi,

 

Can someone please help?

 

I have followed the route of prelim letter, LBA and now I have just filed a claim against Lloyds with MCOL, the claim has been issued and under the judgement section on MCOL website I have 'START' that I can click on, do I click on this to start the proceedings?

 

I have searched the forums and will continue to search to find the answer but if anyone would be so kind as to advise me, I don't want to make a mistake at this stage!!

You only click on start when you are able to start judgement against them.

I have had a letter from the royal bank of scotland refusing to refund any of the charges.

They state that they do not agree with the Office of Fair Tradings report and that there has been no attempt to consult the RBS or the industry in relation to other,entirely different products.

 

Do i now issue a claim?

I have consulted the FAQ's and the forum and cannot find another comparible letter as received.

Eddie, I am unclear where you are in this process. Have you sent the prelim letter and a letter before action.

 

You are also posting on someone elses thread in the Lloyds forum when your claim is with Royal Bank of Scotland.

Sorry about posting on the wrong thread.

I use a similar forum to this and it has "submit new thread" where needed and i am unable to see anywhere "submit new thread" on here so i apologise for that.

 

I have requested and received all statements as per subject access request.

I have calculated all costs on the spreadsheet and submitted this with a request letter as per the template shown on here.I have not asked for the interest costs as advised unless it goes to court.

I have now received a letter refusing to reimburse any of the charges.

So it sounds like you've sent in the prelim request for payment. You then need to send them a letter before action providing them with a final 14 days before you start court action. You can find that letter here:
