    • Today , after a lotof years i recieved a letter from this lot. Very friendly, "Were writing to remind you that we havent had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. uP TO 2000 I hadsucessfully gotten deferment on low income. But rarther thansign on as unemployed,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondance ceased from them, circa 2001. To date  I have had no correspondance from Student Loans. I was made  redundant in 2009 and  reached 65 in 2012 , at which age the loan should have been cancelled. Now ,today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.
    • hes not turning you away he is simply saying that you should stick to one channel of advice. he is perfectly happy with that channel being this forum, and he will help you   all he is saying, and I agree, is that you should stick to one help channel, not mix and match 3/4

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone! I am new to these forums, so please tell me if I have posted this in the wrong section!

 

A few years ago I took out an unsecured loan with Lloyds TSB for £5000 about 8 months later it was re-financed for £6000. I was paying back all the repayments until I became unemployed due to a spinal injury. I then receieved Income and support allowance which I used all of to make repayments. But then it wasnt long after the Tories came into power that I lost all my benefits.

So I set up a payment plan with lloyds TSB to pay back £1 a month. I did this for a few months, but when away from my address for a while, with no access to internet. My classic account went overdrawn and two £1 repayments bounced. I then got a letter from lloyds own debt recovery comapny based in Brighton - SCM solicitors. Stating my account balance was £6,245.68 and arrears £987.80. The letter demanded I repay the balance above less any rebate.

 

Obviously I was not able to pay them, So i called them up. All they told me was that they could not talk to me about it, that my account was still being processed, and that someone would call me with the next step.

 

NOW... I have recieved a letter from Moorcroft debt recovery limited, saying that they are sending me a notice of intended litigation before legal proceedings in the county court are issued. And that they believe that this letter fulfils this requirement even if it is not actually read by me.

 

It says that to prevent our recommending to our client that solicitors should commence legal proceedings, it is essential that i settle this debt without delay. Payment should be submitted in full within 7 days or contact made with this office immediately, by telephone or by letter, with your payment offer.

i have until the 17/01/12

 

Then it says We would draw to your attention that if judgement and an order for repayment in full is obtained and remains unpaid, a range of court enforcement options are available to our client and an application for one of these maybe considered.

 

it then goes on to say about legal cost for court etc. and the usual jargon.

 

 

I am really stuck, I'm just about keeping my head on... but I am quite shi* scared to be honest. PLEASE HELP!!!

Moorcroft have a whole library of letters from pre litigation, pre home visits, pre school !!

 

Do you know if this account has actually been assigned to Moorcroft ? If you have not received a Notice of Assignment then amend the letter below and send to Moorcroft.

SCM usually act on behalf of LTSB where litigation is concerned so I am kind of surprised that Moorcroft are anything other than a Collector/frightener.

Hi, thanks for all of your quick replies. I did take PPI out on this loan. And originally tried to use it when i became unemployed due to the injury, but because I had this injury prior to the original loan agreement I was not able to claim on my PPI. So about 6 months back I claimed back all the PPI i payed because it was mis-sold to me.

 

Please find the attachment which is a photo of the letter from Moorcroft. The last £1 repayment I made was on the 28th december 2011.

In response to Conniff about the Tories - No they havnt, but I went for a medical assessment. Which the final outcome was that I was capable for work, even though my condition is chronic and I am in constant pain. I'm not a moaner...perhaps I should of been more of a hypercondriac eh? :p

 

They offered a tribunal courts thingie to appeal etc. But i couldnt be bothered with all the hassle, and really dont have the time, money, or resources (I live in the middle of nowhere) So its now been struck out.

To be honest, that letter from Moorcroft just skates the boundaries of breaching the OFT guidelines on debt collection. All that bold print highlighting what they can or might do when in fact it will be LTSB who make any decisions.. regardless of Moorcroft.

 

Yes, send the assignment letter out.. lets see what Moorcroft come back with..

Hello soulysurfer,

 

I hope the replies you've received above have calmed you down and reassured that this letter really isn't anything to get so worried about (and certainly not scared). Others are advising you above as to how to respond, but just by looking a bit more closely at some of the language in that letter -- it shows that it's all bluff and bluster (but of course sneakily worded with the intended effect to worry and frighten, which it did.)

 

To prevent us recommending to our client

Also, the barman down the local pub recommends today's special of Shepherd's Pie

 

a claim may be issued by solicitors

It may be 30C and sunny in Clacton-on-Sea tomorrow, but also, it may not.

 

... if Judgement [typo -- that should be small J, like most nouns in English] and an order for repayment in full is obtained and remains unpaid...

They may as well stop there. There are so many ifs and maybes and mays in there. If Dipsy nicks Tinky-Winky's handbag, and if the unlikely event happened of your case ever going to court where the judge could see that you could afford 50p per month, our client would get 50p, and bugger-all else in big red letters.

 

... we will be happy to discuss a payment programme that you can afford and maintain

Oh, they're talking about :love:happiness now after all those nasty but ultimately empty threats?

 

 

I completely understand how you must have been worried, but please don't worry about this -- see it for the toilet paper that it is. As citizen B said: it skates the boundaries of breaching the OFT guidelines on debt collection.

 

It's good that you're here getting advice on what to do, and it is best not to totally ignore the letter without acting on it in some way -- but really, please don't worry -- this letter really is a lot of guff from a company that specialises in threatening and intimidating people. That's their business and they're experts at it -- until you see through their garbage ..!

My advise is to ignore them.

 

Should you want to make payments, I would pay Lloyds direct as Moorcrap have no power over you AT all.

 

Lloyds don't like to take refinanced loans near a Court esp if they have repaid PPI on it. Try to ignore it for 6 years. I would only respond to Court papers.

I dont think that you have had a proper response from LTSB. I would agree with Havinastella, continue to pay LTSB and let them pass the monies over.

 

Do you have PPI on this account and was it mis sold? If so, I would start the process for reclaiming.

There is something very wrong here.. you took out a loan for £5,000 and then refinanced to be £6,000. You had PPI on the original loan? And then on the refinanced loan?

 

At what point did you attempt to claim on the policy and when were you refunded the premiums?

 

Did you do your own spreadsheet for the refunds or did you just accept what LTSB gave you was accurate.

I am terrible with finances, I accepted what lloyds gave me. Assuming this would be the correct amount. I used a template letter to demand them on the original credit card, then on the refinanced loan. As far as i can remember the PPI was claimed before the loan was re-financed.

 

I was paying lloyds £1 per month. But fell very ill and lived with a relative few a few months. Not knowing that my account went overdrawn and 2 payments were missed.. This is why LLoyds Handed it over to moorcroft. However, I did ring up SCM (lloyds collections team) as It requested me to do so in their letter. But I just spoke to a lady who told me my account was being processed and I had to wait to hear from them... I never did, I just got the first letter from Moorcroft boom.

 

Should I contact lloyds offering somekind of payment plan still? I assumed this was now out of the question, especially as when I log into internet banking the Loan no longer appears there.

Yes, I think it might be a good idea to contact LTSB in the first instance. Explain the situation to them and make your offer of repayment. Lets see what happens from there.

Thankyou, I'm guessing I should put this in writing. Is there anything specific I should include? Should I just offer them a payment plan, and a budget sheet Like i sent to them in the beggining?

 

I think if you just set out how things are and yes, include your budget sheet then that is the way to go. Before you send any letter, have a read of the following and perhaps make contact with one of the companies mentioned.. perhaps National Debtline.

 

 

The following has recently been brought to my attention and could prove very useful. Especially now the OFT guidance specifically states it's an Unfair practice to ignore a cashflow budget!

If you are experiencing difficulty in repaying your debts, CASHflow is a way for you to negotiate affordable repayments with your creditors. Before you can use CASHflow, you must have spoken to one of the free advice agencies licensed to offer CASHflow to their clients. The advice agency will start by talking to you about all of the options available, and can help you to decide if CASHflow is the right one for you.

 

If you decide to use CASHflow, you will be provided with all of the tools you need to be able to complete your own financial statement and negotiate offers of repayment with creditors yourself. This will enable you to stay in control of your situation, but still have support from an adviser at any stage if you need it.

 

You can contact a local advice agency to check if they offer CASHflow. You can find a list of free advice agencies that are near to you by searching for a money adviser in England or Wales, Scotland, or Northern Ireland.
