Whizzkid was an absolute star. The judge was amazing. I don't really want to say much more as it's not my place to yet.

 

But having been there today, I have renewed faith in this site and all the people. It was really great for motivation. If any of you have a chance to be a court buddy, do so.

 

Whizzkid, I'm sure you will get your money soon, and all the rest of you waiting.:)

I'm kind of curious as to what their costs actually are. It's a pity you can't somehow force it to court on the grounds that disclosure of the costs is of great benefit to the public.

As they say, the courtroom is the judge's, and he REALLY took control of proceedings.

 

The defence was rattled quite a few times, but I feel confident that Whizzy should get his money sooner rather than later...

 

In fairness, a lot of the detail will probably not appear here, at least not until the claim is settled, but yes, if you get the chance to attend a hearing, it was an amazing experience. :rolleyes:

Actually, I'd love to see the evidence to support and substantiate Abbey's penalty charges. It would be interesting to see how long the banking industry could all stand with its backs to the floodgates.... :D

Abbey - Won DPA Claim - Aug 06 and got bailiffs in to recover my court costs of just £30.00

Abbey - Won Charges Refund of £1050 - Nov 06

Egg - Recovered £220 due to Customer Services misinformation - Feb 2007

Nat West - Prelinimary Letter to recover on Credit Card charges £30.00 sent March 2006. £25.40 offered - rejected and the bank reckons that this is it's last word on the matter. We'll see if that's still the case when it reads my N1 form sent recently. It has until the 17th April to respond or the N1 will be submitted.

This thread is a cliffhanger for sure. Whizzkid - well done for staying the course and congratulations to you and everyone who supported you thus far. I am sooooh impressed and wish I could have been there to see events as they unfolded.

8/8 CLAIM ACKNOWLEDGED GIVING THEM TILL 21/8.......

SETTLED IN FULL!!!!!!!

16/6 Data Protection Act SENT OFF

 

5/8 t mobile have failed to comply with the Data Protection Act/S.A.R - (Subject Access Request) reques ....BRING IT ON BABY!!

7/8 LBE SENT GIVING THEM 7 DAYS TO COUGH UP MY CASH

7/9 FULL REFUND BEEN SENT!!

Whizzy was well prepared, and there were no real surprises sprung at the last minute. Defence documents were as expected, and again, the preparation ensured that the judge ensured fairness all around...

 

I must say that I enjoyed being in the court, and would recommend 'buddying up' to anyone thinking of pursuing a claim...

I HAVE to re-inforce this. It was a fantastic experience in many many ways.

And I do wish Whizzkid all the best. It was wonderful to meet up and actually BE a buddy. He did the job brilliantly. He's a star, and WILL get his money.

Just to reiterate, yes it was a fantastic experience, due to both the support I had from these 2 & a no-nonsense judge. Should anyone be having any fears, or doubt, about the possibility of actually having to appear in court - and the vast majority of you won't - then be assured it's not the horrifying experience you might imagine! The judge will not let you be intimidated, especially when they throw a barrister at Mr Joe Average!

hello whizzkid(again), just got back from a festival, straight onto your thread with my breath held and VOILA!... i would say that on the face of it, that is a major RESULT, and it looks to me that Abbey are up the creek. Good. What we all really needed was a judge who could see through there obvious buff(unlike NeilP,s), and God smiled. As good a result as we could have wished for.... Well Done young man!
