    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This happened to come up in conversation with a friend and I just want to confirm the legal position.

My friend was shopping in a well known supermarket, in a 24 hour opening store, it was fairly late in the evening. Whilst cruising the aisle's he noticed a special offer on X-Box's which was a price discount plus a free game. He put an X-Box in his trolley along with a "free" game and carried on with his shopping.

He checked his receipt the next morning to find that he had been charged full price for the X-Box and also paid full price for the "free" game. He took his receipt back to the store to complain. Store staff pointed out to him that the offer ended yesterday, my friend pointed out that it was yesterday that he bought the items. The shop employee pointed out that his receipt was timed at 00.04 so it was in fact today and not "yesterday" that he bought the items. He left unconvinced.

So, my point is that when he picked the items off the shelf the offer was valid, in fact it was the shelf-edge poster that drew his attention to it in the first place. When he finished his shopping and joined the queue to pay it was probably still "yesterday" but by the time all his items had gone through the till and he completed the transaction it was "today".

Who was in the right here? The shop for saying the offer had expired or the customer claiming that he in fact "bought" the item when he picked it up off the shelf / joined the queue to pay?

Pete

Ok he actually bought it the next day - but, the supermarket shouldn't have left an out of date POS on the shelves, point out that they are liable for up to a 2k fine for each item that is incorrectly priced on the shelves. Failing that write to head office and complain.

He hadn't made an offer to buy or had that offer accepted until he paid for it, would be similar to shopping online, putting something in your 'basket' and leaving it for a week. You would be buying it/contract in effect from date of payment.

Fair enough, that was my understanding of the situation also but I thought I'd check.

Oh joy, can somebody tell me why we shop there? They are in the wrong as if they are going to stick so solidly to the rules, they should have had someone whip the label off the shelf at midnight!! which would probably have been no good to your mate as they were probably at the checkout by then!! I suggest your mate takes the item back for a full refund then sends a photo of a poor deprived child minus x box to the local paper!

I do try very hard not to shop there, most foodstuffs I buy from LiDL as the quality is the same or better and prices are way cheaper; 1/2 price fruit and veg at the moment - large cauliflowers for 29p (Tesco £0.95), a 1Kg bag of baby new potatoes for 45p (Tesco £1.36), etc :o

Anyway, I digress :D

He actully picked it up at about 11.40 pm but paid for it at 4 minutes past midnight. He did go back and to be fair they did offer to take the goods back for a full refund but wouldn't give him the special offer price.

You know why they're digging their heels, don't you?

Under their refund policy, if you have been charged for an item that was offer, whether be special price or BOGOFF, not only will they refund the item, you get the item FREE.

I personally would cause the mother of all stinks, write to HO, state that the item was picked up while still on promotion, that you do not believe for one second that a member of staff whipped off the tag at 00.04, (how do they know that you didn't actually pick up item at 00.01, go straight to till?) and that under their refund policy, you want full refund and the x-box/game free, as per their policy.

From Tesco's website:

Customer Service Service desk

new refund policy

And if things don't add up

• In the unlikely event that we overcharge you we will give you your money back and you can keep the product.

This does not affect your statutory rights.

They push, you push back harder. That's how it works.

Probably mentioned in a previous post but the reason I asked is that I work in the price integrity dept in the named supermarket.

The POS should have been removed by 8am (or 3 am in a 24h store) the previous day.

Go back to the customer service desk and ask for a full refund of the two items. You are entitled to keep the products for free.

The notice is displayed on each checkout and at the store entrance.

Lucky You!

P.S. Can someone give me some advice about my post in the Dixons forum?
