    • Today as the registered keeper of the vehicle photographed, I received a Parking Charge Notice, for a private land car park. I have looked at streetview and I dont think the signs are noticable, they were not placed on entry to the parking area, but on lamposts around the plot. It's not ANPR monitored but must've had someone on foot as they had photo of the vehicle parked in a bay. Is this one worth contesting or will it have to be paid?   1 Date of the infringement 28/5/24   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/6/24   [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 10/6/24   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? [Y/N?] post it up N/A   7 Who is the parking company? Parking&Property Management LTD   8. Where exactly [carpark name and town] 34-39 Magnolia House & 1-83 Cedar House Spelthorne Grove, Sunbury - on - Thames, Middlesex, TW16 7.   For either option, does it say which appeals body they operate under. It doesnt seem to. It states they operate in accordance with the International Parking Community's Code of Practice (IPC). On the back it says "Contesting this parking Charge" and under this heading it states that "all letters contesting a parking charge are carefully considered and replied to within 28 days. Charges are put on hold until an appeals decision has been reached. If we reject the appeal, you will be provided with the contact details of the Independent Appeals Service."   There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE   If you have received any other correspondence, please mention it here Nothing else received PARKING NOTICE.pdf

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I rang the Hellifax yesterday to complain about the unfair charges levied on my account: also to ask whether they'd received my letter yet? (They hadn't...surprise)

I told the telephone guy about the high charges and was told that I got my facts wrong!!! He said it only applies to credit cards, not debit cards! He wouldn't give his name because of "confidentiality", I told him that if I was wrong, then so were thousands of other people. I had the distinct feeling of being patronised so just rang off before Mr "Superior" could continue.

This is the latest situation of my account:

Basic account=no overdraft facility

Direct Debit refused = £39 bank charge.

By charging me £39= caused me to go £4.56 into the red.

By being £4.56 in the red= extra charge of £28 plus calculated daily interest.

So now I'm £32.56 (plus overdrawn interest charges daily) in the red whereas I was £12.78 in the black before!!!! Roll on Wednesday (payday)

Thank God I've also sold stuff on Ebay!!! this'll pay the charges for September!!!

Now what else can I strip the house of to sell ready for October charges!!!!

On the subject of cardcash accounts.

When our joint account was downgraded from cheque account to cardcash account, we already had an £850 overdraft limit, which the Halifax didn't remove. We now have a cardcash account which has an overdraft facility. So now whenever they refuse a DD and levy the £39 they always levy a £28 as well.

Why do we now have a cardcash account when our combined income is way way above average, thats not boasting it's just a fact, because instead of increasing the overdraft limit temporarily to a workable level to help us through a difficult time, the Halifax demoted us to a cardcash account because that way they make more money out of us.

5 more days to moneyclaim application.

Claim is £3363 and rising.

Hi Mad marchare,

Even if they havn't received your letter, assume they have and proceed, sticking to your original timetable. They (apparently) never received my LBA even though i sent it recorded delivery. Royal Mail apologised for it's loss. However, i carried on regardless and filed with MCOL. They paid up a week later.

Good luck

Nona

Hello all

:?: I have a question.

Please do not jump down my throat for my simplicity :p but in such cases aren't we putting our faith in the Karma principle that these badly behaved companies probably have coming to them?

My story:

My account with NatWest caught me out when I least expected it, just as I was keeping my head above rather rough financial waters.

To cut a long story short I was plunged into the spiralling cost of bank charges of which I couldn't pay back...I expect that most of you know what I mean.

The thing that gets me is that as a result of this Banks actions in relation to my finance and their unsympathetic and I'd say rather cruel nature in conversations; I suffered very very nearly loosing my home and business, actually then going onto a benefit (Which the bank got in paying off charges before I found you guys.) and consequently a lack of confidence which seriously threatened both my ability to cope and run my business and therefore my quality of life as a whole and in turn my spouse’s quality of life... for over a year- and that's without children to care for. :-x

If this were anything like my imagination tells me so, ...there should be a heck of a lot of compensation rolling around for all those lost years and months that many people like myself have suffered at the hands of Legal or not so legal criminals.

I realise that a lot of people are getting their money back now as the word spreads

But, in view of the rest whom might well have no idea (or computer abilities:razz:)

and are suffering terribly, we (as presumably good folk...) have a responsibility to put a stop to this.

The 'bank' obviously cares not one cent if it is responsible in any way for contributing to pain by living a 'vampire-like' existence on the most vunerable -as it continues to worship money but why do we let them get away with it? All that heartache that, as far as I am aware, British Justice would not wish to be seen to support.

Can not a big case finally put a stop to these mad charges?

(and so sails the big ship idealism)

Yours, not Amused, Moffie

P.S.

My curiosity extends perhaps to why hasn't this happened yet? I'm sure there is a good reason. -i.e. Is this a mad idea, and should I stick to my Karma theory! :p
