Hi, just an update first:)

 

S A R sent 30/08/06

Statement's recieved(even before they cashed the cheque..lol) 09/09/06

Prelim letter sent 11/09/06

Rejection letter rec'd 15/09/06

L B A sent 18/09/06

 

Today rec'd a letter:

 

Thank you for your further letter of 18 sept 06.

 

I regret that there is little that i can add constructively to my last letter and note your proposed course of action. I have alerted our lawyers and litigation department accordingly..

 

Short and not sweet...

 

What do i do now is it the money claim stage i'm a bit confused at the moment....

Moneyclaim it is!!! They have made it clear they will not be refunding however some people would advise to wait 14 days from LBA but I personally dont see the point because your not going to get another letter and its certainly not going to offer u ur money back!

Halifax: £2600.00 Letter received 28/09/06 SETTLED IN FULL!!!:lol:

 

Co-op: £1140.00 Cheque received 5/10/06 SETTLED IN FULL

 

Barclays Bank: £510.00 (LBA time up 19/9/06) Offer received of £250.00 thanks but no thanks

 

Barclaycard: £840.00 Half refunded mcol being done for the other half!

 

Capital One: £100 Settled in full after preliminary letter

 

RBS: £38.00 SETTLED IN FULL 14th September 2006

WoW... THANKS FOR THE QUICK RESPONSE..I have just registered on the moneyclaim site...seems all straight forward, do i just put what i am claiming for in the Particulars of claim... I am claiming for £620.00 but when i worked out the interest on the spreadsheet it only came to £39.00 i wasn't going to claim for this is it a good idea....

This is what I put for my particulars....

 

Claimant has accounts xxxxxxxxx with Defendant from (date of account opening) conducted on their standard terms and conditions. Claimant is claiming the return of £ (charges total) taken by Defendant in charges over x years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the

Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e.In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8 % a year from (first charge date) to (date of filing moneyclaim) of (figure on spreadsheet) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (your total charges x 0.00022)

 

And I definately would bother with the interest. Your entitled to claim it so claim it!! If u need any help give me a shout!

Hi. Well my claim was acknowledge on the 27th, hoping to hear something soon...

 

Was gob-smacked this morning...Got a phone call from my main bank asking me to make an appointment to see them, when i asked why the reply they gave me was" because i don't have an overdraft and have gone over(which they made me do because they took a charge wihout me knowing), they offered me one:eek: ". I said NO THANKS but she woundn't let it go saying it would be better in the long run, and i didn't need to use it..(yeh what ever, if its there i'd spend it:lol: ).

I finally agreed to only talk about it over the phone, not in person..

 

What a set of numptys....
