    • Thank you. Such a good point. They did issue all 3 before I paid though. I only paid one because I didn’t have proof of parking that time, only for two others.    Unfortunately no proof of my appeal as it was just submitted through a form on their website and no copy was sent to me. I only have the reply. I believe I just put something like “we made the honest mistake of using the incorrect parking area on the app” and that’s it. Thanks again for your help. 
    • They are absolute chuckleheads. You paid but because you entered a different car park site also belonging to them they are pursuing you despite them knowing what you had done. It would be very obvious to everyone, including Alliance that your car could not have been in two places at the same time. Thank you for posting the PCN so quickly making it a pity that you appealed since there are so many things wrong with it that you as keeper are not liable to pay the charge. They rarely accept appeals since that would mean they lose money but they have virtually no chance of beating you in Court. Very unlikely that they will take you to Court given the circumstances. Just in case you didn't out yourself as the driver could you please post up your appeal.
    • Jasowter I hope that common sense prevails with Iceland and the whole matter can be successfully ended. I would perhaps not have used a spell checker just to prove the dyslexia 🙂 though it may have made it more difficult to read. I noticed that you haven't uploaded the original PCN .Might not be necessary if the nes from Iceland is good. Otherwise perhaps you could get your son to do it by following the upload instructions so that we can appeal again with the extra ammunition provided by the PCN. Most of them rarely manage to get the wording right which means that you as the keeper are not liable to pay the charge-only the driver is and they do not know the name and address of the driver. So that would put you both in the clear if the PCN is non compliant.

    • Hi Clou, Welcome to the Forum and thank you for reading first before you posted. There seems to be many problems with Cornwall and getting a signal to use your a phone which could be why these parking companies don't use alternatives. It is a shame you paid the first one as you would probably have not had to pay that one either.  Was the car park at which you paid the same parking company as the one sending you these PCNs? On the subject of PCNs could you please post them up so we can see if they comply with the Act.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi can anyone help??

 

Basically i fell behind with my capital one card, i tried making token payments but by the time the kept adding charges on it wasnt worth it! my credit limit is only 200 and i now owe 450!!!

 

Well i now have a company called FTC chasing me for this dedt which they said i can pay at 20 per month, but how do i actually know that this company now has my capital one debt??

Unless they have sent a Notice of Assignment, carry on paying Cap1.

 

Knowing Cap1 I bet there are a good few late payment and over limit fees that you can claim back with interest. Have a read around the Cap1 forum to get an idea of the process involved.

of assignment, Capital 1 should have informed you.

What have you had in writing from FTC so far?

Post it up if you can it'll give more scope to advise.

The first job is a CCA request to FTC to get a copy

of the agreement, this costs £1.00 and they have 12+2 days

to reply. use the template letter from the CAG library.

Firstly you you should have had a letter from Cap One telling you they were going to pass the account over.

 

Secondly, you need to claim those charges back, with interest. You may find out that once you have reclaimed the charges you owe them next to nothing at all.

 

Do you have all your statements for the account? If not, you will need to send Cap One an SAR this will cost you £10 and they have 40 days to respond.

 

You say your limit is £200, did you have to pay them a £200 deposit before they gave you the card? if you did, have you had your £200 back from them yet?

 

DO NOT ring FTC, and if they call you, refuse to answer their security questions and tell them you will only correspond with them in writing.

Hi, thanks so much for all your replies. here goes..

As far as i recall i have recevied no letter from captial one regarding transferring this debt but to be honest i ended up just chucking the letter without opening :!:. Capital one no longer call me but FTC now do, eventually i answered as i couldnt take the harrasment any longer and confirmed who i was and said i would pay £20 per month, gave me account details and that was it, should i cancel the direct debit once is it set up? I did not pay a £200 deposit on the card. I have not claimed any charges back as i thought that they were allowed to charge £12 per missed payment/late payment etc? im so confused!!

Ok....no need to worry.

 

I'd not give a DCA a direct debit mandate. Personally I'd cancel it and set up a standing order for only the amount you can easily afford.

 

You need to claim those charges back as you will probably find that your debt is wiped completely and you will get money back in your pocket too.

 

Start a thread in the Cap1 forum and we can help you there with the charges reclaim.

Hi, yes cancel the DD asap as they can just

take what they like.

Get the CCA request off to them as well,

if they contact you re: the DD, your reply

should be along the lines of.

''I do not acknowledge any debt to you''

there has been no notice of assignment

of this alleged debt as is required, therefore

I am unable to accept that you have any right

to collect the alleged debt.

Ring the bank or get online ASAP and cancel this direct debit, NEVER EVER allow any DCA to set up a DD on your bank account, they WILL empty your account.

 

Once you have cancelled this DD, did you give them any other card details?? If so cancel your card and request a new one from the bank, YOU MUST DO THIS TODAY!!

 

The next thing is to STAY OFF the phone never ever speak to these fools over the phone, EVER. Keep everything in writing, this is solely for your protection, and it will give you an paper trail of evidence if it is ever required.

 

This debt is NOT a priority debt, you MUST ensure you are keeping on top of all of your priority debts first, your mortgage/rent, council tax, utility bills (less water) court fines, then you must ensure you have food, drink, nights out, enough for taxi fares, holidays in Barbados, new shoes/handbags, hairdo's cinemas, nights at the opera, the latest 'must have' gadgets, then AND ONLY THEN, do you look at paying these 'non' priority debts.

 

Stay OFF the phone, keep EVERYTHING in writing, keep a diary of events, keep all of their puerile begging letters, including the envelopes, mark the date you receive them on.

 

Your first letter to this outfit should be "Prove it" http://www.consumeractiongroup.co.uk/forum/content.php?428-General-debt-letter-if-you-know-nothing-of-the-debt

Send it 2nd class post, because it IS A TRIVIAL MATTER, but you must obtain "Proof of posting" from the PO counter for your records.

 

Then await their childish delights to land on your doormat....oooh what fun!

 

If they ring laugh and hang up, keep doing it until you or they get bored, then answer and place the handset on the side and go do something much more interesting like watching paint dry.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

u have cheered me up, barbados it is lol!! i have started a thread in the other place also. I gave them no other card details so they shoulsdnt be able to take any card payments off hopefully. Im going to keep an eye and as soon as i see the direct debit set up i am going to cancel it!

Hi there,

 

I am new to this site it has been a big eye opener for me, I am now helping my mum sort out problems with the loan sharks Blemain Finance but thats another story, I am the same with Capital One I fell behind with payments, sent them letters advising them of my financial problems and offering a repayment plan they never responded instead I got a letter from a company called FTC, the day after I received this letter I was off work looking after my mother the next day I returned to work they informed me I had a call from a company called FTC I was furious, I work in a large retail store, I called the number they left. I told them to remove all contact numbers they have on me, I do not know how they got my works number they agreed to do this they then asked my to answer some security questions which I refused to answer (advice I got from this site:wink:) I said to them that I would do everything in writing, I wrote to them offering monthly payments which I could afford, I got another nasty letter from them pressuring me to phone them or they will take me to court, fed up with these debt agencies. Sorry for long winded explanation

Never ever phone they will try to intimidate you.

Best thing is to send the ''PROVE IT '' letter from

the CAG library, headed'' I do not acknowledge any

debt to you ur any company you may claim to represent''.

Get proof of posting.

No doubt the letter you have received is just a standard

template.
