    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Greetings.

 

Just thought I would share the envelope that "pat" brought today!

Original amount charged to account - £171.00p

Statutory interest & my "admin"fees - £ 43.01p

 

TOTAL OWED £214.01P

 

My MCOL claim totalled £519.24p

 

This included all my costs, time of research, pen to paper etc. Just about ready to compile the court bundle................... ................

 

OWARD at d ALIFAX has offered £385.47 as an out of court non liability blah blah blah settlement.

 

ACCEPTED

Claimed for £70 + Interest + Court Fee after receiving the standard "terms & conditions" get lost letter...

 

...received letter from Halifax stating their intention to defend...

 

...a couple of weeks later received the letter saying "it is not commercially viable to defend" and "without admitting liability" they would settle claim in full...

 

...checked my account balance and money was in!

 

So, for all those wondering whether it's worth it?

Today 20th June I discovered that 2700.00 had been taken out of my bank, I rang Halifax and was told it was interest on a loan, I told them that I didn’t have any loans so she put me on hold and cam back after 5 mins and said there’s been an error I will get someone to call you back in 5 mins (I smoked 5 cigs in 15 mins) got no call back so I rang them and they said sorry about the error your account as been refunded with the 2700.00 what a cheek?

It has been pay day for a few of us today. Not even due in court till the 7th july. The only letter I've had is the one to say I'm gettin nothing. Low and behold £2030.61 mysteriously appeared in my account today

i went through the banking ombudsman route and claimed £2750. I have just received a letter from the ombudsman saying they had received a letter from the Bank of Scotland informing them they wish to settle in order to avoid a formal investigation and they have offered £3200 which i assume is including interest which i hadnt asked for but will gladly accept im glad this has worked out so well without having to resort to legal action

Hello I am looking for a bit of help, no use at this kind of thing!... Got a letter through today saying that after reveiwing my claim the have decided that they will not be refunding anything, i have been charged £2864 and was claiming for the full amount...

 

Whats the next step??

i suggest waiting till its 8 weeks from the date of your initial complaint to the bank and then contacting the banking ombudsman which will be successful for you and be no hassle at all with courts and things like that even martin lewis was recommending people take that route now

I have sent my letter asking for my statements, had them back after about 5 or 6 weeks, then on the 14th june i sent them a letter with my claim amount, recieved my letter from the bank yesterdaay which said they declined to offer me anything... So its around 8 weeks give or take a day or two!

Is there a link to the ombudsman site or is it best to send them a letter?

I have just received my 'Go to hell' letter from the bank for my claim on 2 account totalling 7300 pounds. I am just about to send of my LBA. but if this fails 'which it may do' which route is best Legal or FOS or is it possible to go legal first then if that fails FOS.

You have to go FOS and then legal if you want.

 

If you lose in court you cannot then use the FOS. This is a quote from their website "If you decide to go to court instead, you should be aware that if you lose you will not then be able to bring your complaint to us".

remember it has to be 8 weeks from the date of your complaint about the charges not 8 weeks from when you asked for your statements.

there is a link to the banking ombudsman site on this site but here's a link anyway Financial Ombudsman Service

you can always call them and discuss it with them they are very helpful and will explain it all for you including what happens when they contact the bank and they keep you informed by letter at every stage its pain and hassle free

been on with claim from halifax now 3 month..sent court letter thurs 21 june..my mrs sent 1 letter to loyds tsb..ive sent 4.....shes been doing it for a month..guess wat..she gets payed out straight away...she was claiming 845 pounds..they payed her 750 pound so she took that....:o .me still waiting..

:D My claim was settled thursday found the money in my account, well chuffed, received a letter from halifax this morning confirming. it was a long road i started my quest for my money last june what a relief. this money will repay a lot of debts and releive a lot of pressure and stress so i,m well happy :D thanks to anyone and everyone who helped me through the process. I,d like to make a donation to the website but am a bit unsure how to do this as unfortunately i no longer posess a credit card (cut them all up as i swore i,d never go down that road again ha ha) so if any of the administrators or moderators are watching please advise thanks:D
