  1. Thanks for the advice. I have contacted my previous employer again to offer them the chance to give me the information I need. They also still have my current address on file, inc my telephone, so my details are upto date. If I have no Joy then I will contact AXA direct to see if they can help. Thanks again aktiv.
  2. Hi all, Can anyone help with some advice? I have a final salary pension with an ex employer that was lets say very poor at communication when I worked there, now it's even worse. I have not had an annual pension statement from them, and I have learned that 2 of the Trustee's no longer work at the company. I have contacted the manager of the department where I used to work by e-mail. He very quickly notified me that my query would be passed on and advised that I would be contacted.(Approx 9 weeks ago) As yet I have heard nothing. This was not unexpected. I attempted to contact the Broker from the last information letter I received 2 yrs ago, but all I got in return was that the broker no longer existed and I should direct my enquiry direct to my ex employer. I have details of my pension scheme provider (AxA) and the number of my policy. What are their legal obligations to me? Should I receive an annual statement? (I get statements from other pensions I have) Should I have been notified of any trustee changes within a certain timescale? Lastly, Can I complain to the FSA about their mis-management of the fund? Any assistance would be appreciated.

  4. We Have Won ................... Checked our account yesterday 22/06 in the morning ..No payment. Rechecked our account last night 22/06..MONEY PAID INTO ACCOUNT IN FULL... This morning received a letter stating that "although the charges made to our account are fair and comply with halifax terms and conditions,we will be depositing the amount claimed in full including interest and costs into your account".. Thank you to all who helped us and many others to claim back our money. Keep going, be strong and you will triumph. A donation will follow. ColinGB20&Wife

  6. We received a letter yesterday 15'th June from our local county court saying that the Halifax filed a defence on the 13'th June. It states that they have 28 days from the date of service of the claim form with particulars of claim. Does this mean that they have 20 days in total since claim filed on the 04'th June. So in effect they have 17 days left? In the meantime we need to prepare in case we do have to go to court. We have downloaded the small claims pack and looked at this. Is that all we need along with our personal paperwork? Any advice now would be greatly received. ColinGB20&Wife
  7. Hi all, We received a letter from our local county court on 06'th June stating claim sent 31'st May and will deemed to be served on 4'th June. Goodo.... We received a letter from the Halifax on 09'th June (dated 08'th June).Sorry that you felt the need to complain blah,blah...But we feel the charges are justified blah,blah...so no refund. This customer service advisor obviously does not know we are at the court process!!! But heres the rub...the letter we got back states that we requested a refund also from our Halifax credit card... Guess what? WE DO NOT HAVE A CREDIT CARD WITH THE HALIFAX !!!!!!!!!!!!!!!!!!!!!! We made no mention or request. They could'nt even be bothered to amend their std letter. It really p*sses me off that they say they looked into our claim,like hell they did. Standard letter sent when our name reached the top of the pile more like it. Still they have 9 days to respond or we win.. will post again when we hear. GOOD LUCK to ALL..
  8. N1 filed at local county court and fee paid on 30/05/2007. Clerk advised 3-5 days before being served, so count 14 days from then. 14 days starts tomorrow so hopefully this is the final leg to getting our money back. If we do not hear anything within this time, do we contact the court or will we automatically get a letter? If the Halifax defend we should receive more paperwork in the post right?   9. Well, our N1 claim has been late in being filed with local county court due to me having to go away at the crucial time to start court process. Now I am back the court claim will start on Tuesday 29/05. Can you please just confirm that our claim date on the N1 form will be this date and NOT the original claim date of 16/04/2007 when we first asked for our money back. Also becuase we did not file immediately after the LBA deadline expired this should not cause us a problem should it? The Halifax sent a letter saying they will reply on or before 14/06/07. so continuing our claim, although late by our 14 day LBA deadline will be ok? Many Thanks
  10. We need some advice please. We are starting to fill out our N1 claim form and wish to clarify one point. Is the claim date on the schedule of charges the same date that the prelim claim was made when sending with the N1? The reason we ask is that the Interest would be different on the date of the N1 claim, around 16/05/2007 when N1 will be filed. We are not sending this yet,but we are starting to get ready for the court process. Many thanks. :-?

  12. Ok update time again. Halifax 14 days for prelim approach for repayment expires tomorrow 01'st May. LBA letter written, schedules copied and ready to post first thing. We have received no correspondence other than the standard reply. We have not contacted them either. We will however contact them by phone once LBA sent and at least 10 days into pending action against them. We feel we will have a better chance of settlement once they know we are prepared to go "all the way". If we go as far as issuing an N1 at court, we would appreciate a little guidance on completeing this important document. We have read the posts/threads concerning this area and are confident we can complete the form accurately. But a check over would be grateful. Hopefully this is the last stage, but who knows?   13. Ok update time again. My wife received a letter from the Halifax dated 18/04/2007 saying "We are sorry " blah,blah, and we have 8 weeks to respond, blah,blah. But, and here's the rub, they have completely left me off the letter. This is a joint account we have with them and all the correspondence has had both our names on it. We really are starting to believe that they seem to be using very limited skilled staff in customer relations just to cope with the workload, as previously we received a letter with our statements but with someone else's account number on it.....Still thats their problem, we can only gain if it goes to court, because we can show them to be negligent in their dealings with our claim. We now have the 14 day deadline in place, which expires on May 01'st 2007, so we will call them a couple of days before to see if they wish to settle before LBA sent out. Best of luck to you all.   14. Hi Dpick, That was cheeky of the Halifax to show "cash paid in" when returning your money. Why are they so secretive about paying you back, this can only mean the banks DO have something to hide !!! Now we are at the actual asking stage for our money, we will have a few more questions as an LBA & Court action grows more a possibility. So thanks again Dpick for your support.
  15. Ok update time.... Prelim letter sent yesterday requesting repayment of all charges by registered post. Will wait 10 days and give them a call to see if they wish to make a full payment before an LBA letter sent to them. We can only hope...... We will let you know how we get on.
