    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

    • Thank you. The receiver issue is a rabbit hole I don't think I'm going to enjoy going down. These people seem so protected. And I don't understand how or why?  Fair market value seems to be ever shifting and contentious.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys thought I would start my own thread on this with regards to 2 MBNA accounts.

I stopped paying around a year ago as I could not afford it. The debt has been passed to a few DC but it is still with MBNA and not sold.

Fredrickson international has now been employed to collect the debt. I send CCA request and they both look fine although Im not an expert to be honest.I have been receiving calls night and day, also I have just been sent a letter for one of the accounts stating LETTER BEFORE ACTION!

Pay up within 7 days or we will take further action, they also included court fees and solicitors costs of £85 and £80 if they take me to court. I haven't spoken to them via phone as I was adviced on a previous thread. I was also advised to open my own thread regarding this so hope someone can help.

I am going to send MBNA SAR request today but is there a letter I can send the DC Fredrickson international until I can see what charges I can claim back?

I am currently suffering from depression and have been put on benefits this week so the most I could offer is a token payment, would that be a good idea?

I cannot help with most of your thread, but to stop the phone calls you can send

That should stop some of the pressure and give you a chance to think calmly. Also read carefully the letter from Fredericksons, does it say they WILL take you to couert or MAY take you to court? If its the latter you have a bit more space before anything happens.

Im going through some actions with Fredricksons and Bryan Carter, it seems as though the letters are the same and eventually it will get passed to Bryan Carter they also share the same address :D, can you post up your CCA so we can see it, also is it a reconstruction? or original... there must be prescribed terms on it to make it enforceable.

 

I think a SAR has a 40 day time frame for response am I right guys?

Hi, the letters say they will take further action! and my brother has just informed me he didnt get a chance to send of the SAR request until this morning,:mad2: I asked him to post it rec delivery as he lives next to the Post office, but the little bleeder got caught up with something.

Its getting sent today, shall I write to Fredrickson international and state once I get the SAR details back I will have a better idea of the exact amount they say I owe, also is it a good idea to offer a token monthly payment in the time being?

Quite right Stevo, it is 40 days. Dont panic charlie and certainly don't offer them any payment until you know whether the agreement is enforceable or when ordered by court. If you can post "the agreement" up for peeps to give their opinion, first editing all personal details by using a site such as photobucket which is free..

 

Do not let FI bully you, thats what they thrive on - you don't need to write to them, just let them keep spending postage on their pointless threats, file them all away, and don't forget to use Royal Mail's track and trace site, printing off the details of when the OC sign for your SAR.

Thx guys, I only worry as I own my home, well the bank does, lol and going to court really does sound daunting at the moment.

I tried to upload my agreement on the original thread which there is a link to but as I don't have a scanner it didn't come out to well, I am going to reply to them stating im disputing the amounts with MBNA and can they hold off action for 28 days until I receive further information from MBNA, I have also offered £1 a week on each account to show good will, is that a bad idea?

Its your decision as always charlie, however if you do start paying them again after a year's absence, the clock does start ticking again i.e. 6 years from now until your credit record is restored. How old is this account anyway, if its pre-2006, they must have all the details in the agreement. I know you can't scan but some people take a photograph and upload it that way.

Hi guys,

Got a letter from Bryan carter solicitors a few days ago stating that if I dont contact Frederickson international that they would take me to court within 14 days.

I offered £5 per month to FI but they seem to have ignored it, I explained that I have just been given benefits due to being ill, they sent 2x payment cards but in there letter that also stated I hadn't reached agreement with them to make payments.

Im still waiting for MBNAlink3.gif to provide me with all the details I requested, Bryan carter stated If i dispute the amounts owed then could I provide proof, obviously I cant until MBNA get back to me.

Any ideas what I should do now? I will make my first £5 payment tomorrow morning to Frederickson international as it is all I can afford, any further help would be appreciated.

Hi guys, I have started paying £5 a month but Frederickson international have ignored this are threatening to proceed to take me to court, what I need advice on is what do I do if Bryan carter take me to court and I get a ccj? I own my house so I am very worried about this now, any advice would be appreciated.
