      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I have received 2 phonecalls today one at my home and one on my mobile from a guy claiming to be from a company called IMS integrated money soloutions he asked if i had a case reference number and i said i didnt know what he was talking about he said i am being charged with theft and money laundering as i received money into my bank and when the company tried to take it back it failed.

 

I said i dont know what you mean, he knew the name of my bank and my email address he said IMS own loan and payday loan companies here in the uk. he read out the charges and an afa david to me saying i have been charged with theft money laundering and fraud. I was speechless i explained i had payday loans but i have a payment arrangment with them and have kept up my agreements. He said i have not paid anything. I asked him who the laon company was and when the loan was taken out he said he cant tell me but it will be in the paper work he is sending me tomorrow. he says he will send it to the credit beurea , my home and my employer, I said you cant send to my employer i will be sacked,

 

He asked if i was getting a solcitor, i said i cant afford one, i was in tears on the phone. He then said he has checked my record and i have never been charged with this kind of offence before and that i have not had any judgments made. again i asked who i actually owe money to and he said IMS.

 

He said the balance outstanding is £248 but when it goes to court it will be £1200. i have googled IMS and their telephone number 02088199746. bthe man spoke in poor english. i cant find anything on google. i checked all my payday loans and none of them were due on end of april. However he knew my bank name and my employers name.

 

I work in local government and if they send papers accusing me of money laundering i will be sacked,. I have seen another post on here which is the same as mine but i just need help. i even rang my mam asking for the money but she is saying its a con i just dont know what to do.

 

The payday loan companies i have agreements and repayment plans with are

 

WDA

QQ

Money shop

 

and as far as i can tell none of these are owned by IMS or have an outstanbding balance of £248 what he is requesting,

 

does anyone know who i can ring to find out more info

stop panicking i had this phone call about 3 weeks ago .the third time he rang my partner answered it and said we were informing the ploice .he hung up and hasnt rung since .They want you to panic and pay just forget it .If he rings again tell him you have informed the police and hang up .

It is a con - you need to get to the local police and get them involved, ask to speak to the money laundering unit, especially as the guy spoke poor English.

 

If you really were had up for fraud the police would be there first, not some pathetic Piers Morgan phoning from a company.

 

Taking out a loan and running into difficulties with repaymets IS NOT FRAUD - if it was the ENTIRE GOVERNMENT would be in prison ... look at what they have done to this countries 'balance of deficits'.

 

Get complaining to the police now and also to

 

http://www.ripooftipoff.co.uk which is a Trading Standards site dealing with companies of this nature.

 

GET COMPLAINING AND DO NOT PAY ONE SINGLE PENNY TO ANY THIRD PARTY COMPANY

If they send court papers there are ways of dealing with it, a defence can be filed denying all knowledge of their claims, besides again you would be visited by the Police BEFORE the court became involved as this would not be via a normal County Court summons (as far as I know).

no i didnt receive anything .did he ask any security questions before reading the charges ?.I could hardly understand him cause of his poor english but he only said my name nothing else for security.dont worry .

Hi baileysmam, I had exactly the same thing, made me ill and I posted on here. I have informed action fraud of this. They told me they would report to police for me and gave me a crime number. I then had to ring my bank explain to them and have my card blocked and a new one sent out. Then I had to ring national insurance and tell them that someone had my NI number and personal details. This is to help us from identity theft and I suggest you do the same. If you need any help just PM me.

I was really worried at first and was shaking but now I am just angry. I have rang back several times screaming down the phone and annoying them.

If you look on whocallsme.com and type in the number 02088199746 it comes up with lots of people who have had the same.

Also, my papers never came, neither did the police it's people preying on the vulnerable people and it wants reporting by us all.

I was told it is probably due to the fact, when we filled in the form, the companies pass your details around to other companies ( we all know this happens as we get hundreds of texts and marketing calls from different loan companies, brokers etc after making just one application online and that's annoying in itself )and somehow they have got into the wrong hands.
