My brother has just lost in court to the tune of £12,000.

it includes their costs of 4 thousand.

To cut a long story short he never entered a defense in time, got a good telling off from the judge for

doing nothing.

The case was about a conservatory base.

Anyway, he can't pay it all at once so what does he have to do now?

Will he have to ask at court for more time?

He's really worried.

He said the judge mentioned 14 days but nothing is said on the order he received yesterday (wed)

so 7 days have passed already.

Any help?

Hi Series

 

He needs to write and request an installment order and attach it to a N244.Enclose a I&E. (no fee)

Is there a set template letter for this sort of request?

Secondly, is there a time frame he must keep inside?

Would he need to get the form from court or could it be downloaded?

Right I found the N244 form and have it printed out..

I beleive there is an income and expenditure form on here too.

I have seen it on one of Ell-enn threads...so just the letter now

14 days after judgment Series, after that there is a charge.

cheers..I have been trawling the site for a while looking for something..

got the N224 and the inc and exp..

will put together a letter..then ask for help filling the N244 in..

If you received a forthwith judgement it's an N245 form you need asking the court to vary the order to payment by installments - the fee is £40.00. I have recently assisted someone in the same position and used the N245 to get the order changed to installments.

Ell is correct Series forthwith = no redetermination must be installments N245.

N244 to suspend and ask for further time or to request a lower mthly payment already set by the court.

all the judgment says is

 

it is ordered that

1. judgment to the claimant in the sum of £8***.**

 

2. the defandant do pay the claiments costs summarily assessed in the sum of £4***.**

 

Dated 6 July 2011.

thats it. No dates when to be paid...he did say something about 14 days though.

He will need to clarify with the court, ask which option, normally forthwith is on the order.

when whatever form is sent, does he need to send a copy to claiment as well?

No, it just goes to the court - if he can't hand it in personally then it should be sent by recorded delivery and take a photocopy first.
