Homebuy, no credit agreement and mis-sold PPI

Hi there, hoping someone could help and point me in the right direction.

 

In 2006 my husband and i purchased a TV and DVD recorder on hire purchase.

 

I was told at the time we had to have the PPI insurance, which in total with the interest came to 1200!!.

 

Well i have been trying to sort this for years with no luck, every time i call they say a manager would get back to me.

 

I have now realised that we do not a have signed agreement with them.

 

An agreement was sent out by post, but we never signed it nor did they, i still have all copies.

 

Also out of interest i asked for a balance on our account and was shocked when they said £1300....

 

we have been paying £60 a month since 2006!

 

What steps do i need to take?

 

I also have another account with them for a sofa... PPI again was sold to us, 2006,

 

we do have signed agreements for this,

 

balance is £1300!

ouch how to be fleeced..twice!!

 

if you pop off to the FOS website

there are several 'example' PDF's there

and the PPI Complaint form

 

fill out one each for the accounts

and fire them off to the Company concerned

 

in the meantime

i would WRITE to their head office and cancel both PPI contracts.

 

time for some serious reclaming me thinks.

 

if you've been paying £60PCM since 2006, those items must be gold plated

 

you're in for a serious windfall.

 

if you have the agreements can you scan them up?

 

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

Firstly, welcome to CAG

 

Secondly, I have moved your post to the more appropriate forum - Hire Purchase and Rent To Own Stores, and

 

Thirdly, unfortunately I can be pretty certain you don't have a claim for mis-sold PPI insurance. (DX is absolutely right with his advice if you did, of course, but I think you will find you are very mistaken.)

 

What you have is a Hire Purchase agreement with a SERVICE COVER agreement and (probably) a DAMAGE AND ACCIDENTAL THEFT policy. These are not considered as PPI—although it may be possible to show they were mis-sold.

 

HomeBuy is a company very similar to BrightHouse, and have pretty much copied their business model. Therefore, a good read of our BrightHouse factsheet HERE would help give you an idea of what you are up against.

 

Looks to me like you started off with a two or three year HP deal on the telly and DVD, and as that agreement reached the end you added the suite—which would tie you up with repayments for another three years… Meaning, it should really be all paid off by now! But you still owe £1,300??? Something DEFINITELY ain’t right there!

 

The unsigned agreements is a concern, too. I think your best bet to start with is an SAR to Homebuy and find out exactly where you stand.

the sofa i took out the following month...in 2006. on the agreement the 'extra comes under maintainnace vouchers, for £1200! We were paying £78 a month for the TV etc and £40 for the sofas until about 2008 i think when we reduced the payments for £60 a month. We may have missed on or two payments in all that time but no way should be still be owing 1300 and each agreement, surely?

Definitely not right. You really need to SAR Homebuy and get to the bottom of things. I have a feeling (as you mentioned reduced payments) you may have had your agreements re-written (or re-financed). All very, very complicated - and the only way to truly get to the bottom of it is with a SAR.

From my experience of working for them as an Area Manager with access to customer data it is probably safe to say your account will have been rescheduled (Homebuy terminologyfor reducing payments and extending contracts).

 

In my time with the company I seen too many of these 'older accounts' similar to yours. The statements are very difficult to understand and the payments/balance don't seem to move.

 

Obviously if the figures you have stated are correct then the math does not add up. Hopefully you will have retained all your receipts and they will match with the company system. There have been issues with collectors and payments and hopefully this will not be case in your situation.

 

Do you know your collectors first name and your area - I may be able to put you in contact with your Area Manager.

I don't think the OP actually had a collector for her accounts, and has been paying by direct debit. In which case all she needs to do is get bank statements for the last 6 years (easy with internet banking) and that will show the total amount she has paid. She should still SAR Homebuy to obtain copies of whatever information they do have regarding her accounts.

 

This could turn out quite interesting.

homebuy do not have ppi, what you have been sold is omc, optional maintenance cover (not optional) homebuy do not have anything called ppi. The sales rep has explained the ppi wrong, the only thing there offer that is if you take out the omc and your circumstances change you send back the goods and make no further payments.

 

Last week they announced to there staff that they are no longer going to be providing new products to either new or old customers. The company has failed to secure 25 million in investment and as a consequence is left to collect out the existing accounts.

 

What i recommend is a hand written letter to their head office stating you wish to cancel the optional maintenance cover on all your products and a statement of your accounts then offer a £1 a week payment. They cannot refuse you on either account.

 

Next week a website is going to be launched purely for the scams homebuy pull on customers these include;

 

omc - not being optional

rescheduling of accounts - lowering your payments without your knowledge and still collecting full payments.

Returning of items - do's and dont's

 

also checklists on how to play their own system.
