    • We looked up the e-mail address so communications would be in writing.  If you do stuff on the phone the other party can just deny the contents of the conversation.  They can't deny what's written in an e-mail. So time to sort Pete out.  Check the following for accuracy and change anything I've got wrong.  Then e-mail Pete this evening.  I was thinking of threatening the pub with legal action but let's initially be nice.   Dear Pete, Re: PCN no.XXXXX, claim form no.XXXXX on 23 July 2022 I was a customer at your pub and I attach proof of purchase. I was picking up my cousin Ms XXXXX and her family as she was working as a cook with you at the time.  I entered the pub through the back door, went to the bar, and ordered a drink and a meal.  At no point did any bar staff alert me that I needed to add my registration number or did I see any signs advising me to do so.  I then took a seat outside in a small seated area so I could chat to my cousin while waiting for her to finish work.  We were joined by the management of the pub and bar staff during my time waiting  I was shocked a few days later when I received a demand for £100 from Civil Enforcement Ltd.  i contacted the pub and was told "don't worry, it's not enforceable". Well, that information turned out to be nonsense because I have now received a county court claim form from CEL. I contacted the pub again on XXXXX and was extremely disappointed to be told "there's nothing we can do". Of course there is something you can do.  You are the organ grinder.  You called CEL in.  You can call your dogs off.  Your pub has absolutely superb reviews on Google Maps regarding the way in which you treat guests.  Do you really think customers should be dragged to court?  I'm sure you don't. I am therefore requesting that you intervene and instruct CEL to cease court action. Yours, XXXXX

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I recently paid a cheque for £370 for 12 months member at Parkwood leisure which is owned by the local council but Parkwood run the business. Now when I asked to pay for 12 montsh they didn't really know the process or the cost (so I gather its not the norm) and I signed no contract either.

 

Now I recently received flyers through my door offering the same gym for only £26.00 a month which works out cheaper than my full 12 months payment!

 

In short, I want to cancel anyway as the gym is not very good and its open to public for 'free days' for kids and OAPS which if fine but it just makes it very overcrowded.

 

Can someone advise what my rights are before I wade in and request for a refund for what months I still have remaining??

Hi Willo,

 

We need a bit more info here.

 

You say the gym ".....didn't know the process or cost....."

 

So how did you come to write your cheque for £370. I mean, how did this come about.

 

Did you write the cheque at the gym or send it somewhere.

 

Did you log onto any computer sign-up system at the gym or use the internet at all to join, perhaps by simply ticking a box.

 

Have you a membership card and did you sign FOR this when you got it.

 

Even though you say you didn't sign an agreement as such, you may have entered into a contract. I suggest you ask for a copy of the gym's T&C's and look for info about cancelling.

 

Your case differs to most that we see here, which involve a DD for monthly payments. In that scenario, a "member" can stop the DD, leaving the gym to prove that there is a valid contract and that the payments are enforceable.

 

In your case, you already paid the full £370 and it would therefore be down to you to prove that you are entitled to a refund of some or all of it.

It was verbal conversation with the receptionist on the desk over the phone. They asked their manager how much I would need to write a cheque for years membership and £370 was given as the total. The monthly subscriptions was roughly £35, so I gatehered I was getting a small discount.

 

I then joined and paid the cheque over the counter. I was then issued with a membership card and that was that.

Hi Willo,

 

If you want to cancel the membership, I suggest you put briefly in writing your concerns or complaints.

 

You should mention the fact that you feel your enjoyment of the facilities is spoiled by the numbers of users that have free use, when you expected a degree of exclusivity having paid so much for your membership.

 

Mention that the gym gave you no contract, you have signed no agreement and you'd like a copy of their T&C's.

 

You may find something in the T&C's that'll be helpful in cancelling.

There t + cs are:

 

C. expressions Health and Fitness membership sales

 

1. This package is offered for a minimum of 12 months. Members can pay either by annual subscription in advance, or pay monthly by Direct Debit. For granting this credit, members pay an additional 10% charge which is incorporated in the Direct Debit payments.

2. If you wish to terminate your Direct Debit membership agreement during the first 12 months you must do so in writing to the Centre where you joined the expressions membership scheme. A single cancellation fee equivalent to 2 monthly payments will be required. Annual memberships are non refundable.

3. Direct Debit Payments will continue beyond 12 months until such time as you advise us in writing of your intention to cancel. Please notify us at least 14 days before

 

I am moving down south in less than 3 weeks and I still have 9 months on my contract to run. Is there nothing I can do to force their hands considering I signed no contract and was not briefed on the conditions before I parted with my cheque?

 

All suggestions all very welcome.

Hi Willo,

 

Did you write to them along the lines suggested by me in post #4 above. If so, how did they respond.

 

Can you confirm where and when you got these T&C's from exactly.

 

I assume no signed contract has turned up as you never actually signed one but please confirm.

 

If this is the case, I think they should have supplied you with either a contract or their T&C's shortly after you "joined". This would have alerted you to the non-refundable Annual M/ship and you could have argued about this earlier into the contract.

 

Although this may not be directly applicable to your own m/ship, I will seek advice about them charging an extra 10% if you pay by monthly DD. This sounds like a charge for credit and I'm not sure if they can do this without a Consumer Credit License.
