Hi there,

 

This is my first post so please be gentle!!! I do wish I'd come across this site years ago, just never thought to look!!

 

Just a brief bit of history for you.....

 

Due to many bad decisions and a bit of bad luck I managed to rack up roughly £37k in debt between 1998 and 2008.

 

And then through hard work and sorting my life out I managed to clear all of this debt at the end of 2008. It was an amazing feeling and a fantastic lesson learned. I've managed to keep out of trouble since then (Have a credit card and a Next account, both with small limits which I clear monthly just to give me some kind of credit status) and still don't owe anybody anything!

 

Or so I thought.........

 

At the start of April I received a letter in the post to my current address (Which I've been in since Sept 10) from a company called UK Search Limited.

 

They claim to be representing a company called Intrim Justia regarding an amount owing of £10k. They a quoting an address I've not lived in for over 10 years and the company they claim to be representing is one I've never heard of, let alone had any dealings with.

 

There is every chance this could be a debt of mine as I've owed a lot of people a lot of money over the years but having worked so hard to pay everyone off this is a bit of a blow!

 

As I previously stated, I've never had any dealing with either of these companies, I should know, I've dealt with pretty much all of the other collection agencies out there!! SO... are they just trying it on. Purchased an old debt from someone else?

 

To date I've had 4 letters, each one increasing in Red text, warnings, threats of court, door step collectors etc etc.

 

Have to say, they seem pretty convincing!

 

I've been looking around this site before posting and think I understand how Statute Barred debts work and I'm quite prepared to keep ignoring them.

 

My only question would be regarding this approach is, for a debt this old, how would I ever know if it was subject to a CCJ at the time of default? If it is my debt that is?!

 

When dealing with all my other debt I started checking my credit file frequently from about 2007 and there is no mention on there about this debt. SO what if this was subject to court action but I just never knew about it?

 

I've had 4 different addresses since 1998 and all my other debtors had no problems finding me, so why would this company come out of the woodwork all of a sudden having never previously chased me?

 

Would be hugely grateful for you advice!

i would very much doubt its anything you need to worry about

 

you're on a phishing list

 

they'll play their cards soon enough of they had any

pers i'd ignore

 

as you are aware all these dca's/searchers/fake solicitors have no legal powers.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Then ignore them till/if you get a reply

DO NOT contact/speak to them or confirm anything by phone.

Intern Jokia are well know for chasing old Statute Barred debts.

 

And UK search specialise in buying "gone-away" debt to trace the absconders to new addresses and then collect from them.

Ok Welcome,

 

What are the details of the alleged debt they are claiming, the original creditor ?

Have you had any correspondence contact of any sort about this before?

You can find out if there are any CCJs online at http://www.trustonline.org.uk/ by entering your previous addresses. Any that are older than six years will have dropped off the register and cannot be enforced without the permission of the court.... which is rarely if ever given.

 

Any debts older than six years with no CCJ (five in Scotland) which have not been acknowledged in writing or had any payments made will be statute Barred & no enforcement action can be taken.

It could just be a fishing exercise. Does it say in the letters who the original debt was owed to, and what type of debt etc etc? CCJs drop off your file after 6 years, and in our experience of trying to track down the paperwork they seem to cease to exist at the court also.

 

It would be helpful for the guys who know the stuff for you to give them as much details as you can. That way they can give you the best advice.

 

The way I see it, you have 2 choices......keep ignoring the letters until they actually send something more concrete than ifs buts and maybes, or send the "prove it" letter from the library.

Thanks for the replies.

 

The first letter I received mentioned my old address, an account number, the amount owing and that there client was Intrim Justia.

 

From the digging around I've done, and from what people have said on here, Intrim Justia are just another Collection Agency so they can't be the original creditor. So no, there's no mention of the original creditor and what type of debt it is.

 

They obviously know that I'm living in my current address as I've noticed a couple of recorded searches on my credit file from UK Search Limited.

 

My previous experience has taught me never to deal with these types over the phone so I'm thinking I might just continue to ignore.

 

It just really annoys me as I haven't had letters like these through the post in nearly 3 years and though all of that was behind me!

they come up with the full details of the alleged debt.

you say there was an account number......did it look like a bank account as that may give you a clue. Ignore until they come up with something concrete. Chances are it is statute barred or close to it anyway. It looks like IJ have used this company just to trace you, as that is what this company does (as well as some debt collection and Training (?!) )

 

Keep hold of all the letters, and just wait it out. Keep us posted of any developments :-)
