I wonder if the situation with the existing freeholders is such that the property is really unattractive, in ways possibly not obvious to someone who also has an interest in and acts for the freeholders.
    • i dont think the reason why the defendant lost the case means anything at all in that case. it was a classic judge lottery example.
    • Hello, I will try to outline everything clearly. I am a British citizen and I live in Luxembourg (I think this may be relevant for potential claims). I hired a car from Heathrow in March for a 3-day visit to family in the UK. I was "upgraded" to an EV (Polestar 2). I had a 250-mile journey to my family's address. Upon attempting to charge the vehicle, there was a red error message on the dashboard, saying "Charging error". I attempted to charge at roughly 10 different locations and got the same error message. Sometimes there was also an error message on the charging station screen. The Hertz 0800 assistance/breakdown number provided on the set of keys did not work with non-UK mobiles. I googled and found a bunch of other numbers, none of which were normal geographical ones, and none of which worked from my Luxembourg mobile. It was getting late and I was very short on charge. Also, there was no USB socket in the car, so my phone ran out of battery, so I was unable to look for further help online. It became clear that I would not reach my destination (rural Devon), so I had no choice but to find a roadside hotel in Exeter and then go to the nearest Hertz branch the following day on my remaining 10 miles of charge. Of course, as soon as the Hertz employee in Exeter plugged it into their own charger, the charging worked immediately. I have driven EVs before, I know how to charge them, and it definitely did not work at about 10 different chargers between London and Exeter. I took photos on each occasion. Luckily they had another vehicle available and transferred me onto it. It was an identical Polestar 2 to the original car. 2 minutes down the road, to test it, I went to a charger and it worked immediately. I also charged with zero issues at 2 other chargers before returning the vehicle. I think this shows that it was a charging fault with the first car and not my inability to do it properly. I wrote to Hertz, sending the hotel, dinner, breakfast and hotel parking receipt and asking for a refund of these expenses caused by the charging failure in the original car. They replied saying they "could not issue a refund" and they issued me with a voucher for 50 US dollars to use within the next year. Obviously I have no real proof that the charging didn't work. My guess is they will say that the photos don't prove that I was charging correctly, just that it shows an error message and a picture of a charger plugged into a car, without being able to see the detail. Could you advise whether I have a case to go further? I am not after a refund or compensation, I just want my £200 back that I had to spend on expenses. I think I have two possibilities (or maybe one - see below). It looks like the UK is still part of the European Consumer Centre scheme:  File a complaint with ECC Luxembourg | ECC-Net digital forms ECCWEBFORMS.EU   Would this be a good point to start from? Alternatively, the gov.uk money claims service. But the big caveat is you need a "postal address in the UK". In practice, do I have to have my primary residence in the UK, or can I use e.g. a family member's address, presumably just as an address for service, where they can forward me any relevant mail? Do they check that the claimant genuinely lives in the UK? "Postal address" is not the same as "Residence" - anyone can get a postal address in the UK without living there. But I don't want to cheat the system or have a claim denied because of it. TIA for any help!  
    • Sars request sent on 16th March and also sent a complaint separately to Studio. Have received no response. Both letters were received and signed for.  I was also told by the financial ombudsman that studio were investigating but I've also had no response to that either.  The only thing Studio have sent me is a default notice.  Any ideas of what I can do from here please

In both cases it was held by the courts that there was no need for additional ‘cover’ or ‘protection’ (or whatever you wish to call it) on top of the standard delivery charge, and P2G were required to pay up in full for both cases, which by then also included court costs and interest. I shall be including copies of both those judgements in the bundle I submit to the court next Wednesday 1 May, unless you settle my claim (£274.10) in full before then. Tick tock…..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks Donkey, Well i have been naughty and still hiding. Received a Schedule of Litigation from

HFO last week.

 

Says in 7 days i will get a Letter Before Action.

 

Then in 14 days they will issue a claim form by northampton county court.

 

same day an application for judgement if i fail to defend.

 

Then 15 days after that a charging order, attchment of earnings or warrant of execution.

 

Im sure i have had one of these schedules before, But time is running out for them. Year and a bit left and it will be

statute barred.

 

Still out of work and no signs of change in the near future. So attachment of earnings is going to get them nowhere.

 

So what are the chances of them actually following this through to court? And what is my defence? No work

no money and probably 5 or 6 other companies all asking for money i did not have and refusing to help.

 

Thats about the best i can think of.

 

I think it was citi that were the worst? Getting forgetful now... Anyway phoned to say ive been off sick for a few weeks

but they refused to assist unless i paid £200 and something pounds, I was getting £65 a week sickpay.

After that call i stopped talking to all of them and ignored the phone.

 

Then i get a letter saying they dont want to antagonize me. That was the final straw i flipped.

 

Never spoken to any of them since.

PS now getting calls from 08453304800 Not sure if its for the same thing or another debt passed onto

someone new.

Still awake and this is buzzing around in my head now.

 

I claim IB and thats topped up by income support, Partner doing a part time college course, 1 child just started college.

 

Income, IB + IS + child tax credit + family allowance. Total income approx £400 a fortnight paid into partners account.

 

Without the rent, council tax and CC bills and travel costs we dont seem much worse off.

 

Now i have a car worth approx £2000, Which my FIL and mother put money towards because we

help my inlaws a lot. Shopping and doctors and hospital appointments etc.

 

It sits there most of the week so my mileage is very low. If i lost that i wouldnt be able to go far and

we wouldnt be able to help the inlaws who are nearly 80 and not in very good health.

They are proud though and refuse help from carers, When they did accept one to help the MIL

they got annoyed because they wouldnt turn up at the right times or not at all.

 

Electric and Gas takes £120 a month, Water about £20 i think. Wonder where the bill is for that?

These i have kept up payments on since changing company. Original company we were in arrear when i was

1st off sick but managed to clear that when the sickpay ended and i claimed IB.

Seems i should have been able to claim whilst sick but how am i supposed to do that when im sick? Backdate

you wish they said.

Even had to pay rent and council tax for a few weeks because they failed to give us the forms to claim it.

 

I offered them £2 which they accepted but did reply if we took you to court you would pay £2.64 minimum. How petty.

 

Anyway, £23 month for childs travel costs, Maybe getting something towards that from the college. upto 3 months worth

of travel vouchers.

But so far cost nearly £60 in books. One book she mentioned seems rather rare only seen one for sale £30+.

 

One thing that maybe a problem is my sister has a contract phone for £35 in my name. Which she gives me the money for

each month. I have a phone £12.50 a month that my daughter mainly uses now.

 

Will either of these ( luxuries ) affect my position when they work out any repayment?

 

Also wondering if they take me to court and i show i have debts to 5 other companies. Will payments have to be shared between them

or will just the company that takes me to court get any money leaving none for any others?

 

I read posts on here and people say they cant do much but it still makes me wonder, I dont want to be an exception where they have

the correct paperwork and will take me to court and awarded more than i can afford to pay.

 

Also worried about writing to them in case it resets the statute barred clock.

 

Thats for reading my wittering on.

 

Action time but i would rather hide under the stairs? I do realise that any court papers are not to be ignored.

Do i need a solictor or something?

Did you ever make a complaint to the OFT as advised? You have the whole set of complaints:

 

1. Sitting on your account for years then pretending they have previously contacted you by issuing a ‘reminder’ notice of assignment.

2. Sending out false ‘courier’ cards – who was yours from? Silverpoint?

3. Saying you do not have any defence to court action, which they cannot possibly know.

4. Charging 12% interest without any contract

5. Threatening bailiffs will call WHEN they get judgment, not IF.

6. Failure to properly fulfil a valid CCA request.

 

And the list goes on...

A complaint to the OFT in this instance, as well as to your local Trading Standards, would be well advised. It would let them know you are not going to roll over and be treated so unfairly. If you want help with wording, let us know.

Spooky or what i have received a letter from ruthbridge about the citi account, Dated last week. I have had no letters

from anyone named newmans. So not a clue who they are or what debt they are claiming.

 

Sorry i did not complain to anyone,

 

1, I dont remember any notice of assignment, I have had reminders letters but, I check they are not court letters and now keep them

i dont put them straight into the shredder. But i have never really took much notice, At one point i was receiving several letters a day from

the same people. I feel quite left out i rarely get post these days.

 

2, I dont know who the card was from, Logistics something on the card, Been a while now.

 

3, err no idea on that.

 

4, I think the interest has only been added fairly recently. I did wonder if they could do that.

 

5, Yeah threats did worry me at 1st but these sites and the fact they say will affect my credit rating, But im sure

thats wrecked after the 1st few missed payments. And i dont want anymore credit thank you i have learned

a valuable lesson.

 

6, Err sorry again i still have not asked them for one.

 

Is it wishful thinking that they will not take me to court before the statute barred date?

I will expect one soon as I have stopped paying CABOT for a CC debt which they have not furnished the CCA.... hope there looking hard for it, should be in the musky archive somewhere 1992 I took that bad-boy out.... hope the muppets are looking hard.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Well no news to report, Despite the Schedule of Litigation letter i have heard nothing from HFO.

 

Rutherford have written offering a discount.

 

How is the statute barred date worked out? Is it from the day i made the last payment or the day after or other?

 

When this started and the letters were dropping through the letterbox in bundles on a daily basis i though there is

no way i could hold out for 5 years. But on the otherhand i didnt have the money to go bankrupt either.

 

But there is only 2 and a bit months left of 2011. Then the countdown starts in days not years.

 

How can i find out the exact dates of last payments? Credit report or bank statements or must i contact the

companies involved?

I know a credit report is fairly cheap but i dont think bank statements are?

Anyway, there are far more serious issues with HFO Capital’s supposed ownership of this account. Forget SB – if they take you to court, they’ll have some pretty huge hurdles to get over. Why else would they offer you a ‘discount’?

Did you send a CCA request to HFO? Monument Cards are very difficult to get information on - you have to contact Barclaycard and they seem to be having difficulty finding the Info. Checking your Credit report is a good idea. You can sign up for a free Trial with Experian and Equifax but make sure that you cancel within the time scale. The Credit report may show the default date but the last payment date may have been a long time before this. A phone call to Barclaycard may be worthwhile to get the last payment date. For SB it is 6 years(5 if you live in Scotland) since the last 'cause of action' and this will be one month after the last payment was made. The numbers for Barclaycard are Barclaycard recoveries 0844 556 0066 and DIRECTORS OFFICE TEL: 0844 0903111 (if you get nowhere with recoveries)

Think it is Ruthbridge who are offering a discount for the 'Citi' debt? The HFO one is a Monument Card. Two many DCAs on one thread here, think you need to start a new thread for the non HFO ones

Again yes Ruthbridge offered the discount on the Citi card account.

 

Heard nothing from HFO since the schedule of litigation letter.

 

I know the last payment was late 2006. Not sure if the exact date as i may have made token payments to some creditors

but dont know who / what /where.

I do know i have never paid or even spoken to anyone from any of the debt collection companies.

 

 

Sorry for the confusion with the different companies.

 

I think it would be a nightmare starting a thread for each debt collector, Ive had letters from all of them at some point i think.

 

Mercers, Arrow, Wescot, Credit Solutions, Mackenzie Hall, Cabot, Robinson Way, Lowells, Scotcall, First Revenue Assurance,

JB Debt recovery, Clarity, Buchanan clark and wells, Credit Security Limited, NCO, Hamptons, Bryan Carter Solictors, Fredrickson

International. RED.

 

And probably many more.

Sorry i dont listen to you all and your great advice, But i cannot get it out of my head that contacting these people will make matters worse.

 

Maybe i should start a new thread? ( which section? When i posted this it got moved to here.)

 

I have just found some paperwork that missed the shredder. Quite a bit really so the missus must have hidden it.

 

One was a notice of assignment to HFO for a BC debt, Not the monument one. Dated Oct 2008.

Strange the original demand from BC for payment was £1600 but the letter said i owed £2000 and i think HFO want £2500 now.

 

It seems bryan carter were going to issue court proceedings against me in Jan 2007. So my last payments were probably a bit earlier than i thought.

 

It was late 2006 though. I am sure of that, So Sept - Nov last payments made.

 

I had signed upto the free experian report a long time ago and actually paid for a bit but cancelled soon after. So a free check is probably out.

 

OK my ears are open. 1st step?

 

Make a list of original debts company and figure?

See who is chasing it now?

 

I still keep thinking how did i get into this much debt. Foolish.

vjohn82, Had a letter from HFO regarding a barclaycard notice of assignment which was not actually supplied by barclaycard. And was actually sold to rutherford. Could explain the £ difference between the barclaycard letter i have and the assignment letter figures.

 

Oops i forgot to post this its been sitting in an edit bix since last night/early hours.

 

Reading vjohn's posts made my head hurt. I presume some of that may apply to me with the dates being similar.

 

I dont think i could have lasted out that long.

Still nothing to report. Except i got a CC application from vanquis in the post this week. Made me smile as i shredded it.

 

Is the Experian £2 Statutory Credit Report all i need? Wonder whether to try the Free Trial?

 

I had the free trial before and paid for a couple of months, But then cancelled as money became ever tighter.

That was a fair few years ago now though. What are my chances of a free trial?

 

Dont want to risk getting charged £15 if i only need the £2 report.

Stupid system, Clicked the yes ive used them before box but still asked for all my details and card number.

 

Then tells me i am already registered and to use my original login details. Except i dont know them.

 

Email address? I was on AOL back then and had 7 email addresses. None of my long standing ones seem to work.

Possibly a deleted email address.
