    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Have 2 loans with the mentioned companies, been happening every month spiralling outa control untill its taking my whole wages, ive just had a payrise and if i never had this debt every month i could live comfortably.

 

I have opened a new bank, and getting my wages transferred into there tomorrow.

 

Should i email WDA/PayDay Express today or wait for them to contact me when they cant take the money?

 

i owe PayDay Express 500 and WDA 600,and obviously i only have a small amount of expendable income so wish to pay them back as little as possible, so is the minimum i should offer them and try to scrape together when they ask?

 

What are these 2 companies like to deal with? any good/bad experiances?

I have both Payday Express and WDA as PDL's and defaulted at the end of last month. I let them know about 4 days before my loan repayment was due. WDA, after a couple of emails/phone calls let me set up a payment plan to be reviewed after 3 months. I owe them just under £400 and they have agreed to let me pay £48 per month for the minute. They weren't too bad tbh but they did slap on £36 charge! They did however agree to freeze the interest and any other charges so all in all not too bad with WDA.

 

Payday Express - different kettle of fish! Wouldn't agree to anything (well not yet anyway), I am still emailing them all the time though so hopefully they will get fed up listening to me and either come to an agreement or sell on to a DCA, in which case I can negotiate with them.

 

Only offer to pay them the original loan plus one month's interest and don't let them get away with slapping on extortionate charges, stick to your guns, work out how much you can honestly afford to pay them and stick to it.

 

Most importantly though you need to close your bank account and open a new basic account somewhere else. Regardless of whether you are able to negotiate a payment plan with them they will try and raid your account.

I will contact the 2 loan companies this evening and let you know what happens.....

 

Ive read other stories on here that PDE are Ok.... your story there makes me wonder what they will be like wth me, what are these companies like with calls? are they going to be calling me at work all the time etc...?

 

if i offer £75 a month each, would that be seen as a reasonable offer?

Providing you stick to your guns you should be OK with PDE. You are in control now and they will have to be reasonable. make sure when they are ready to negotiate that you have interest frozen and no charges etc. No agreement = no pay. Good luck

Hi All,

 

Well today, WDA have taken a direct debit, although I believe this will bounce as im way over my overdraft limit.

 

I emailed them letting them know this morning....

 

I Also emailed PDE... who called me, i explained im in financial difficulty at the moment and want to pay it back monthly....I told them i can afford 75 a month. They want me to try and get 100 so it can rollover to next month? I dont see what good this will do me, surely this will just make the situation worse and delay it another month?

 

Are they trying to get me to pay the interest again or something? I dont quite understand...

Yes, PDE tried that one of me too. What is the point of rolling over each month? Anyway you can't give them what you haven't got. £75 a month is a fair and reasonable offer so I would stick to your guns imo.

 

I thought you changed your bank account so that they couldn't touch your money? If you still have an account with your previous bank then let them know what's happening. The PDL's will still try and raid your account so keep a close eye. Best thing to do though is close the account entirely.

 

Don't let them intimidate you Russ, you are genuinely trying to take control of your finances and are doing the right thing by trying to negotiate. You have to live, pay your utility bills and priority debts so PDLs are way down the list. You are taking control so be proud of the fact that you are doing something about it. Keep us posted x

Thanks glo, feels good to have people like you and others on the same side so to speak.

 

I have changed my bank, so my wages gone to a diff one.

 

My old account is right on the Overdraft limit, direct debits that tries going over gets bounced, WDA try to take out with direct debit which will come out then get bounced, usually late that day.

 

WDA have contacted me saying I need to wait till tomorrow till it comes back - this kinda makes sense to me, if my bank honour it, then I will just owe my old bank money and can pay that back being even more flexible, so I wouldnt mind.

 

So what exactly do I need to tell PDE? theyre calling me back after lunch...

 

£75 a month is what I can pay, with interest frozen? cannot do anything else?

Russ - I emailed all my PDL's with this, change the wording to suit your situation.

Unfortunately I cannot now afford to agreed monthly payments because xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx Also, the interest on payday loans has made it impossible for me to now pay off lump sums on a monthly basis. I only have a monthly sum of £xxxleft for my creditors. I am willing to pay the original loan of £xxx plus one month's interest. The offers I have made have been worked out on a pro−rata basis.

In view of my circumstances, please would you agree to temporarily accept a reduced offer of £xx per month initially for xxmonths. If charges are being added to the account I would be grateful if you would freeze these so that all payments made will reduce what I owe you.

Russ, even if you try to set up a payment plan with PDE please be aware that they will still try and take the money from your account. However, as you say, you might be able to agree something with your bank, then it might be prudent just to "get rid" of the PDL's and try to negotiate a payment plan with your bank for your overdraft instead?

PDE are the most awkard of all Pay loan companies to agree a payment plan. They will guide you down a few blind alleys such as asking for personal information such as I + E forms and most recent wageslips which they are certainly not entitled to. Only if the case went to court and the judge agreed to an attachment of earnings would you have to by law provide such information.

 

I defaulted back in August and offered £75 monthly payments but they refuted all attempts. It got to the point were the debt collection department of PDE would not reply to my several e-mails and stated that the account will have to naturally wait until it gets passed to a DCA. It ended up going to Castlebridge Debt collection in the end which is a arm of the money shop, surprise,surprise!

 

They agreed a payment plan of £50 a month but the dastardly crooks put almost £250 interest and charges on top of an original loan of £400. I don't have the time or the energy to argue against this at present, but I will be after two payments already, I highly doubt I will pay the full £750 back.

 

I will miss payments deliberately if needs be and this will force them to agree a reduced settlement as the debt risk will increase.

 

I can provide e-mail addresses for PDE but in my honest opinion it will be pointless as it seems their processes are completely against payment plans.

Just an update... PDE never got back to me, they were suppose to call me back at 1pm yesterday they never, I sent an email no reply either.... shall I just wait?

 

WDA emailed me today to contact them, so I emailed them again... waiting a reply...

 

thanks for your help and Willo - sounds like PDE are the wrong company to get into debt with =/ oh well... live and learn =) got my months bus pass so no worries about how im getting to work for another month!

Just an update WDA accepted my offer, PDE want to see bank statements etc if i fall into one of their categories.... got another problem now though :( going to pop into another forum here for advice :( :( :( :(

Hi dizzyhead. If they have your bank details, yes they will try every trick in the book to raid your account. When is your default day? Is there time to set up a new account somewhere else?
