Any amount above £750 can be liable to threats of bankruptcy, however toothless are possibly the least likely muppets to carry out this threat, it is more than likely a threat to get you to contact/pay them.

 

Can you just clarify BC's CCJ?

Were you aware of him applying to the courts for this? Did you receive the court documents?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

As Bazooka will tell you that BC is one mean mother... goes to court me thinks at a drop of a hat. I am awaiting my turn to fight him but as yet he has not reared is ugly head.... Can't wait for any of mine to issue SD will run round there in person and take them by the hand to the court........ Save me one of hell of a lot of money.

Bazooka, who does he usually act for????? what nasty reptiles of the big institutions does he cosy up to... might give me an insight as to when he take's on the hippy!!

Johhny, can you confirm that the CCJ which was awarded you knew about, and failed to submit a defence, what payment did the court order, you can't just pay a bit here and a bit there?

yes i did not make a defence i was meant to be paying £10 a week and i think it was for £680 and i got it down but now i have not been making payments for ages and yesterday i got a letter saying balance£398.32 YOU ARE NOW IN BREACH OF YOUR PAYMENT AGREEMENT AND FURTHER ACTION WILL NOW BE TAKEN TO ENFORCE PAYMENT OF THIS DEBT.IF YOU WISH TO AVOID FURTHER ACTION ,IT IS ESSENTIAL THAT YOU CONTACT US IMMEDIATELY ON 08453133128 THIS IS A SERIOUS MATTER AND YOU MAY WISH TO SEEK INDEPENDENT LEGAL ADVICE YOURS SINCERELY BRYAN CARTER

is it worth taking out a £3000 loan with FLM or would that make matters worse

 

Worse, you need to sort out what you owe. Can you get a loan with the debts you have and what would the interest be?

Do not take out new debt to pay old debt it is a very slippery slope and your footing is not too good on that slope. (just like the rest of us lol).

 

Today is the day you regain your control Important debts first (if the owners of non priority debts choose to go down the "Charging Order" route you can deal with that at that point, by that time you will be much more aware of your rights and we will be here to back you up and give advise.

 

Do not be afraid to go to court, it may actually help you, as a judge may order them to reduce the payments to a more affordable level, however, I say this to ease your worries not so that you give up and let the court deal with it, this would not be seen to be good.

Write and tell them you are re-assessing your finances and offer a token payment of £1 (or more if, and only if, you can afford it). You may if you wish tell them that this is a temporary measure for 3 months and after this time you will have a clear picture of your situation. Also tell them that once this has been done and your disposable income has been calculated you will apportion this accordingly based on the amount owed (ie least owed gets least amount).

 

Booking yourself an appointment with citizens advice would be a very good idea. If you do, tell that to the creditors also it might get them to back off once they know you are getting help from people who know your rights.

 

Remember do not talk to these people on the phone everything to be done in writing ONLY.

 

Use the Telephone Harassment Letter if necessary

You need to do a budget - find out what you CAN safely afford to pay to your creditors after all your priority debts and household living expenses. The divide the amount of Money that you can spare between these other debts.

 

Offer what you can afford - NOT what they want. A Court will only do the same.

My advice is to contact Citizens Advice Bureau or contact, via telephone, National Debt Line, you should be able to find telephone numbers for both organisations in the telephone directory. There is a website for the Citizens Advice Bureau. You should be able to find where the nearest CAB is to you from this website.

 

If the amounts of money being paid to these debt collection agencies is such that you are not making regular payments to your priority creditors such as the utilities, mortage or rent. Then reduce the amount to a nominal £1 per account per month. whilst maintaining payments to your priority debts. Meanwhile inform the debt collection agencies that you are seeking advice on your rights and that you will contact them later once you have received help. The CAB or National debt Line will advise you of your rights and will help you to deal with your debts.

JC This is good advice given here - strongly suggest this is the route you take.

When calculating your I/E with the CAB or National Debt Line make sure you calculate EVERYTHING you can think of including your 2 cats and dogs + vet bills. Get it it down so that you have very little income left to pay these DCAs.

 

Don't speak to any DCA on the phone EVERYTHING IN WRITING send recorded and keep copies for yourself.

JUST HAD BRYAN CARTER ON THE PHONE WANTING £10 a week from today and dcl kicking off because i cancelled the dd ....tonight i am gonna put on here every debt i owe,how much,and what they want each week
