It still doesn't tally - we are both talking about the Credit Reference File and the first post clearly says it has been explained to me that this will go down on my credit file as a 'partial settlement'and yet in post #4 it says satisfied will be put on the file. There is a big difference between the two so the OP needs to find out which it is.

Hi, I am on a payment plan with Barclaycard (Bal was over £10,000 now £9,000) they have put me on interest free.

 

Prior to going on the payment arrangement with them I did write to see if there was still an agreement going back as far as 1978 …

.Barclays were unable to provide a CCA.

 

However, I guess I have acknowledged the debt by going on the payment plan.

 

Prior to this Barclays upped the C/L WITHOUT my asking OR SIGNING anything over the years.

 

My question is:

- Can I still put the account in dispute and stop paying?

 

I have just had a call from a company calling themselves DWS Claims who told me that I should not be paying them anything…etc. that I have a claim for compensation.

 

Personally I think it’s all too late.

 

Any thoughts/advice greatly appreciated!

Hmm, you really should not be listening to claims companies that tell you such things. This site is littered with people who have.

 

What compensation do they believe you should be entitled to ?

 

If there are charges or payment protection insurance which might have been mis sold, then you can claim these back.

They basically wanted £250 upfront. They stated that I should not have to pay ANYTHING on this account as B.card should never have upped my credit limit without my signature. They said they could get the WHOLE amount cleared. Also, I would receive at least £1700 compensation.

Sounded tooo good to be true! Probably is!

has there been a period of 6yrs whereby you did not use the card or write to them about it was there?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I rather suspect that you have been misled. Credit card limits were universally increased and unless the terms and conditions radically altered, then there would have been no need to obtain a further signature from you.

 

Please tell me, you havent paid these people £250.00 ?

No, I have not paid anything to them...thought I'd check here first! :wink:

 

The card was used right up until my husband suffered a heart attack and we had to cancel our holiday. We are separated now...which has an aweful lot to do with the debt we have accrued.

I cannot go boring you with the details of how this debt came about ..suffice to say there is a sad story behind it.

I have received a letter informing me that one of my credit card debts has been sold to Moorcroft debt recovery...anyone know what this means for me?

No it is ok to stay here for the moment :)

Has it actually been sold/assigned to Moorcroft or have they simply passed it on for collection ? There is a difference.

Do you have a payment arrangement with the original creditor ?

It is actually quite important how you arrived at the point where you are struggling to meet your financial obligations. If your bank/creditor is unsympathetic or fails to treat you fairly when in genuine hardship there are consequences for them.

After you have perhaps read what I have posted above, then you might want to have a read of the BCOBS articles in my signature - they are highlighted in green.

The Moorgate letter which arrived Friday states

“ has been purchased by Britannica Recoveries S.a.r.l acting in the name and on behalf of it’s compartment Mortlake (Britannica-Mortlake)

and welcome you to Moorgate Loan servicing Ltd. “ Moved to them from 30/1/12

 

The missed payment were genuine errors not actual missed payments.

I have been paying my husband a/c also as he more or less had what I'm sure was a nervous breakdown.

He eventually took over his own a/c and somehow MY dd got cancelled by whatever he did.

MBNA never gave me the impression that this was ever going to happen..

 

.what do it mean?

Ah right, so it wasnt Moorcroft who actually purchased the account.. It does look as though you have been advised correctly of the assignment.

 

It simply means that Barclays have written the account off their own books and the account now belongs to a "new owner".

 

DX has suggested that you obtain a copy of your credit files this will show if the debts are being recorded/defaulted or even if they are on there at all.
