On 31/08/06 I sent off my DPA letter and £10 cheque. Today I received this reply ...

 

I am sorry you have had to contact us about concerns regarding your Monument account. Thank you for taking the time and trouble to do so.

 

I am looking into your concerns and will let you have a response or update as quickly as I can but no later then 3rd October 2006. In the meantime if you need to speak to me please call on 01293 802 473. I have enclosed a leaflet explaining how Monument works to resolve complaints. I hope you find this helpful

Why couldn't they just send me a list of charges??? The letter seems to imply that I am complaining not reclaiming charges.

They have 40 days to supply you with the information you require so, if they do respond by the date they mention, that is inside that period so there's not much you can do but to sit and wait.

My 40 days are up today and I have had nothing apart from the initial letter (see first post).

 

Not been in this position before ... any advice as to where to go from here.

Ok, sorry, found out what to do in the bank template library (Isn't it always the way that you find it AFTER you ask what to do, lol)

 

I will get my letter (template 3) printed tonight and ready to send after 1st post tomorrow via recorded delivery (along with my questionaire to the court for my Cahoot claim).

I have just rang Monument asking where my list of charges / statements are and was told that as my account went back to 2001, they are trying to access these details from the archives and that it it taking a bit of time. I was told that it is being chased up everyday (ho hum) and that they cannot apologise enough for the delay. The lady said she understood that it was important for me to get these asap and thanked me for my patience.

 

I told her that I would wait until next Tuesday before I take action (7 days after they should have arrived) and she again said she was trying all she can.

 

She was talking that fast and nervously that I'm surprised she didnt bite her own tongue off, lol.

 

So what I'm wondering is ... are the 7 days I have given her the same as the 7 days notice set out in template 3 of the non compliance ... and then after that start a claim in the county court for these documents

 

or

 

Do I still need to send the 7 day letter and if so do I do that today or next Tuesday?

You need to say, specifically, that unless you get the action you require by a given date you will take "further action"
