The information requested is as follows:   My wife and I are sole traders supplying bespoke, handmade wedding trays and other items through our website. We do not sell on ebay. We had an order for two trays (invoice value £370) that were shipped on Monday 25th March. We used P2G as the broker and Evri as the shipper. We declared the value but did not take out insurance. As the trays were a present for a wedding on Saturday 30th March we checked the progress of delivery on the Thursday to see that there had been an attempt to deliver on the 27th but the driver failed to deliver as the customer’s gate was shut (customer informs us that the gates are open between 7am-7pm. We contacted the customer who informed us she had been waiting in all week and there had been no attempt of a delivery. Evri allege they attempted to deliver on the 28th & 29th. On the P2G web site on the 4th April at 14.17 it stated that the customer refused delivery. At 14.28 it updated to say there was a problem with the address and at 14.32 updated to say the customer had refused delivery. At 14.35 updated again to say it was being returned. Last entry was on the 7th April that it was being processed at the depot. We never received it. I have had six web chats with P2G between the 4th-30th April. On the 26th April, I had an offer of £20 plus cost of delivery (£6.72) from P2G which I rejected. During this time, I also contacted Evri that resulted in an email from Evri Customer Services (20th April) stating that they had lost the parcel. I replied requesting details of the attempted delivery but received no reply. After emailing Evri again on the 23rd asking again for the information I received a phone call from someone called Haleemah on the 25th who apologised and promised to send an email with a link to submit a claim form. I subsequently received an email with the link which only took me to a page that stated “Page not found”. After informing Evri customer services of the problem (to which no reply was forthcoming) a couple of days later I retried the link but it only took me to the Evri website. I believe that I have a good case against both companies but would appreciate guidance on which path to go down. I have read most of the information on this site, which has been very helpful and much appreciated, particularly the various court transcripts. I appreciate that this process is a marathon and not a sprint and am fully aware that I need to get everything in the correct order before starting on the legal road. I am sure this covers the current position but if further info is needed please let me know.  
    • Everything at small claims revolves around informality and common sense, there are no "special" ways to have to do things. The site manager's WS will be like yours and the one I linked to - just much shorter.  There need to be the introductory hearings about the case, the parties, etc., and the concluding Statement of Truth. In the middle just a couple of paragraphs where they say who they are, how they know you, and about permission being given by the landowner to use the car park. Superb.  I've added another section about the signage to the suggested WS sections three posts above. Yes, it's perfectly possible.  It'd be a good idea to phone the court on the 18th to see if they have paid.
    • OK thank you very much. I will prepare my WS as you advise.  I will indeed be preparing the WS over the weekend. I will also post UKPC's on Wednesday by 2nd class mail. As they have until the 17th to pay the court fee, is it possible they might discontinue at that stage too? Also I wanted to ask, in what form should the site manager's statement come? And the site owner if i can contact them? I will get photos of the signage to share with you also. Thank you.

    • You have five days yet to respect the WS deadline which is next Wednesday.  As others have said,  you can e-mail the court their copy.  That gives you the whole weekend to get the WS prepared.  Personally I'd post UKPC's theirs by 2nd class post (all they are worth) on Wednesday too, the court won't look badly on a short delay from a Litigant-in-Person. Another point.  In your WS you say their signs are rubbish.  That's a great point if their signs really are rubbish.  It's a dreadful point if their signs are fine.  So have you got photos of their signs?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, sorry if this sounds jumbled up, but i am in quite a state.

 

I have just had 2 telephone calls from an Agent from 4 Point Financial Services about repossesion of the car.

 

Firstly my wife answered the phone and asked who it was, they would not say who they were and what they wanted, it ended up in the "agent" swearing at my wife.

When i called, i barely got his name and who he was "supposed" to work for. (He said he worked for quite a few companies)

He informed me he worked for "4 Point Financial Services" and that he was coming round to cease the car or to pay an unpaid debt. He informed me he worked for a "number of companies" of which i could not get any names or numbers so i could call and complain about his behaviour.

 

Now the unpaid debt, is being dealt with through the PPI claim and i called the originating lender of the finance (car) asking why they are sending our agents to my house, calling my telephone (I also asked the originating lender only to contact me through letter only and no direct callers or door stop collectors) when the claim is being dealt with through the PPI company. I was informed that they had not received any monies for a number of months, although i have been sending in AB I1 forms to them. They also informed me that the finance is now closed and they want to recover the car or the loss of payments. I asked them if they had contacted the PPI company as to why, and they told me they do not do that and that i should intervene.

 

Now...can they just come and collect the car as the agent said or is there something i can do?

4 point financial are members of the Credit Services Association.

As such they are required to be seen to uphold codes of conduct and working practices.A breach of that is a breach of the Unfair trading regs 2008.

me thinks you need to give your ppi reclaim co a kick up the backside and tell them to get on with it....or do it yourself.

 

have you sent the a/c in dispute letter?

if not do so.

 

if the a/c is in dispute then collection activities must cease.

Hi all thanks for the input, will certainly give the above mentioned an e-mail as their "officer" falsly claimed who he was working for. It was only till i called the O/C that they gave me the "true" name of the company this person worked for.

 

Just a thought, (blind question i know but..) Even though the account is with the PPI company, will i still be charged "agents" (I presume by calling themselves agents, they mean baliffs or debt collectors) fees on the account?

The reason why i asked is because the account is now with the PPI company and they are paying the finance to the original finance company...who appear and have said "they are closing the account and cannot wait any longer", hense the 2 seperate "outside agents" (baliffs???) contacting us over the last week or so.

Thank you cymruambyth for clarifying the difference to me. I was a little worried as the phone conversation i had last night seemed like it was from a Baliff. Also the person who called several times last night, failed to give us the correct company of which he said he worked for. Is this legal? He basically left out words of the company name, misleading us, and leading us to beleive he worked for someone else.

I'm sorry but I have limited knowledge about car repossession. I think it is dependant on how much you have paid. Do you have your original agreement because I think this states an amount or percentage that has to be paid to'make the car secure'.

as advised, look at your agreement, how much have you paid? and is that passed the typical 1/3rd point where they cannot repossess without a court order?

 

if you feel you have, then make the car vanish for a bit.

HI all thanks for the input. Just to update...The PPI company are now paying the finance on the car after missing payments for a number of months. However the O/L has i think got a DCA onboard to help recover missed payments, and the DCA company are now ringing all the time. (6 times so far today and counting!!)

 

Am i liable for the DCA fees even though the account is being held by the PPI company?

Thanks DX for the information, (that eases some of the worries!)

 

I was on the understanding that they could add fees. It seems that 2 DCA companies acting on behalf of the O/L are chasing me for a debt that has now been paid by the PPI company looking after the account since i was made redundant.

 

I shall await further phone calls from DCA later tonight as they always tend to ring last thing at night. I am tenmpted to answer their calls and give them what for now!!

Tell them you find it much easier to speak about personal matters away from the home and give them the number for the insurance underwriter to call you back on during the day......if nothing else it'll get those payments up to date a little quicker.

A little information, i was made redundant late last year, purchased a car from Carcraft with added PPI (was told i had to have PPI or i could not have the car), called PPI up and they said they would start paying after 3 month wating period.

 

The finance company have had 2 payments since Oct last year, i questioned this, and have paid from 03-06 this year.

 

Now in a letter from the PPI company they say they need evidence from myself looking for work. I have looked through the policy and it doesn't state that they need evidence at all. I send them ABI1 forms fortnightly as proof that i am out of work and actively seeking work.

 

I called them this morning to question why payments had stopped and they have now said the underwriters need this information (evidence of looking for work) that is why payments have stopped.

 

Well i called the underwriters and they have no idea what is going on and have logged a complaint.

 

Are the PPI company trying to pull a fast one (as it were?) I send relevant forms from the job centre giving proof that i am out of work and actively seeking work, (surely this is sufficient evidence).

 

Also during the converation the CSA asked what i was doing to look for work, what kind of work i am looking for etc. Do i need to disclose to them what i am doing? (I did explain that by being on JSA i have to provide proof to the job centre that i am looking for work, otherwise i would not be entitled to benefits)

Any help or ideas would be appreciated.

Yes I believe they are trying as you say to pull a fast one :eek:

 

Sell the PPI make a shed load of money and if a claim comes in find an excuse to not pay the claims.

 

You IMO should get all of the data and paperwork if you do not already have this. If not ask for the data using this.

 

Full SAR for ppi when you send the PPI ask for::::

 

You can be specific with what data you request although the Subject Access Request is really asking for everything. The Statutory fee is £10.00 Postal Order is fine but keep the details of the number for future reference. The post office will be able to confirm when it was encashed (just call 01246 542091 they will even send written confirmation if you request it) Send all correspondence by at least recorded to be signed for so you can track delivery through Royal Mail

 

You should request the following documents:

 

A true copy of your Consumer Credit Agreement with the Terms and Conditions that were applicable at the time you took the loan/card/mortgage.

 

Copies of all statements applicable to the loan/card/mortgage.

 

Copies of all correspondence that apply to you as a data subject ie letters, emails, faxes etc.

 

Copies of all recorded telephone calls or transcripts of the recordings.

 

Copies of any notes made by bank/loan company staff in their dealings with you as a data subject.

 

Do not be fobbed off by them citing issues such as relevant filing systems.

 

If they have any records/data on you as a data subject and it is held under your name, address, post code, account number/s or any other system where the data is identifiable to you then it is a relevant filing system. Even if it is a specific serial number on microfiche records and the serial number is applicable to you.
