    • Don't give them your e-mail address, don't give them your telephone number and don't fill in their forms. They send these things to pretend they are some sort of statutory authority. In reality they are a disgusting cowboy company who use sixth-rate solicitors who can't get any other work so are reduced to doing everything on the cheap with no due diligence for private parking companies. Your letter is meant to totally ignore their procedures and show you've sussed them for who they are.  From their point of view it would be better to drop you like a hot potato and instead concentrate on going after people daft enough to give in. That's why I went on & on about their previous court humiliations, to show them that if they continue with you they'll just end up with another thrashing.

Yes, they say I have to tell them who the driver was, but as I am the only one using my car it would be me anyway. Due to the location of the alleged offences I am pretty sure it is to do with this lorry driver.  I am happy to say it was me driving, but should I also give a written account of my side of events , as they have kindly provided a blank piece of paper for me. But not sure as these are criminal charges, whether I should put anything in writing at this stage I don't really know what it's about and don't know on what evidence these allegations are based on, given the fact none of the above actually occured.
    • This sounds like someone has alleged that you wee involved in an accident which caused damage or injury to a third party or their property. If the request is issued under Section 172 of the Road Traffic Act (and it should mention that) you are obliged to respond by providing the driver's details. But that is all you are obliged to do at this stage. As far as the failing to stop/report charges are concerned, you could inform the police that you did neither because, as far as you are aware, no accident requiring you to stop occurred.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bailiff removal notice for council tax i wasnt aware i had to pay

I have received 'Removal Notice' from equita yesterday. This is the first letter i have received regarding council tax from my previous address which i haven't lived at for over 5 months. I was claiming full housing benefit and council tax benefit as i am on JSA and was on JSA when i lived at my previous address, and wasn't aware that at any time that i lived at my previous address i was 'supposed' to pay council tax.

 

On the letter is states that if i wish to make a full payment (which it doesn't tell me how much is owed) than i have to ring them. If failing to do so the bailiffs will be round to my new address in two weeks to remove my goods

 

Is there any advice you can give me please?

The bailiffs cannot force entry unless you have let them in previously. They cannot remove goods unless they can get it. They can however take a car or whatever is in your garden.

Just remember to keep your doors and windows locked and there is very little they can do. They will most likely try to collect 2-3 times before passing it back.

 

Worst case scenario assuming they cannot get in is they will huff and puff with threats about locksmiths and police through your letterbox for 30 mins or so then leave.

 

Locksmiths are ONLY to gain entry if they have been in before but they like to use this threat to un-aware people and police are ONLY to keep the peace and they are not supposed to get involved but some police are very thick when it comes to bailiffs and what powers they dont have. Just politly ignor the police.

 

But if you do what seanamarts has said and go talk to the council then its very possible the bailiff action will cease anyway.

It is about time that the public really started making complaints to the relevant bodies if they are unhappy with letters received from bailiffs.

 

There can be NO OTHER type of business that could be possibly be allowed to get away with sending a letter to demand money and not provide the amount but instead, but instead lead to you ringing a MOBILE TELEPHONE to discover what you owe.

 

I am aware of many recent complaints that have been made on this point to the Office of Fair Trading or Trading Standards.

 

Another point that I will make is that almost everyone receiving such letters BELIEVES that when the bailiff says that he will attend and remove goods "IN YOUR ABSENCE" this means that he is going to BREAK INTO THE HOUSE. This is NOT the case.

 

If you are silly enough to leave a door or window open then yes, he could gain "peaceful entry" but what the bailiff REALLY means is that he can remove goods from OUTSIDE of the house. This could be a lawnmower. garden table etc from the garden or goods in an unlocked garage.

Who are the appropriate bodies to complain to? The local councils appear to work hand in hand with bailiffs and condone much of what they do and charge. If there is a list of people to complain to would someone advise please. I have contacted consumer direct who inturn informed trading standards and the OFT they say bailiffs do not come under their remit.

Unfortunately there is no one to complain to who will take your complaint seriously. The Bailiffs and Council will have you believe that the ESA will listen but they are a trade body paid for by Bailiffs.

 

To find out where you are at you need to ring the Council in the morning and ask:

How much the Liability Order was for

How much is still outstanding

For what period of time it is for

When it was passed to the bailiffs

 

If you ask them to take it back they will refuse but you should impress upon them the fact you had moved so never received any prior notification. If you are with the same Council did you tell them you were moving. It may be they are trying to charge you for a period of time after you moved. You should also contact your local Councillor for help ASAP.

Thank you for all your information,

I have looked through all my letters i received regarding my housing benefit and council tax benefit, and i have come across a letter saying from the 1.06.2009 (which was the date i moved into the property) to the 31.3.2010, i didnt have any council tax to pay. I left the property in Jan 2010 and informed the council that i moved, and also that i moved out of the area, that is how they have my address now.

Would that letter be any benefit for me to help fight this case?

got in touch with the council and they said that the bill is from after i moved out. but there problems with what they are saying, which dont seem to be right, i.e, saying they sent out a letter on the 19th Jan to the address i am at now, although i didnt start renting this property on the 22nd Jan.

- spoke to the bailiff on the phone to sort out payment, i was asked what i would like to pay monthly so i told him, and he said it wasnt good enough they wanted more. Will be going to the citizens advice for any info i can get

if the date the council tax relates to is for after you moved out of the property then you owe the council nothing
