    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

    • Hello All,  I’m hoping someone can help me urgently here. Firstly, I’d like to say I have read multiple other threads and have some what an idea of what I should be doing, however my case might be slightly different so coming with my own questions here.    my situation is I lived in Dubai and had a credit card and a loan, loan with HSBC and credit card with Emirates (or the other way round), I lost my job and was forced to leave the country as I was staying in the country on my companies visa.    since coming back, after a few years 2 different debt collections agencies have been approaching me (one being IDRW and the other J&P). I’ve never answered IDRWW and they constantly chase me by calling and messaging me and my employer. My current company is ok with this as I explained the situation but I’m soon to be joining a new company who definitely won’t be ok with being messaged and called. I’m afraid to continue to ignore them as they may message and calm the new employer as they have before and I’ll lose my job. However, it seems clear from these forums that dealing with the debt collection agencies is never a good idea. You shouldn’t agree to the amount or pay anything.    j&p caught me on my phone but I still haven't sent them any money or confirmed the amount they’re saying is owed, they keep pushing to pay off the “principal” amount by making monthly payments, from reading these forums it seems like if I make one of those payments (they have provided bank details for ENBD), then it’ll just be paying off interest and not actually clearing the principle debt and the bank won’t even approve receipt of payment or that it’s coming off principle.    this is my predicament as ignoring them might not be an option if they chase my new employer. Maybe there’s a way to ensure the debt collection agency don’t contact my new employer?? I don’t know? Massively appreciate peoples help here. Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The take-up of the CAG toolbar is low - and we really do need some help.

 

If you haven't downloaded it then please have a look. The most important thing for us is that you use the search function because it will generate some revenue for us if you click the sponsored ads.

 

It doesn't cost you anything at all. The money comes from the sponsors of the ads.

We have bills to pay and it is very tight at the moment.

No one gets paid except one person who does admin for us.

 

Donations are very down. Book sales have become a trickle and the couple of advertising links that we have don't produce anything much at all.

 

At the moment, any revenue of any use is produced by our search boxes at the top and the bottom of the forum.

 

We think that we can increase this if you use our toolbar on your browser and get into the habit of using it for your normal searches.

 

The revenue problem is a problem for the CAG and it is a problem for all of the people who come to us for help because it means that our existence becomes precarious.

 

You would imagine that with over quarter million registered users and 700,000 unique visitors per month that donations would be flooding in and that everything would be hunky-dory.

Well it's not like that at all. Hardly anyone donates. Some people donate £10 but most people who donate are now donating £1 or £2. I appreciate that for many people even these small sums are a sacrifice but after Paypal takes its cut, there isn't much left. And of course, the vast majority of people just don't contribute anything at all.

 

 

How can you help us?

 

Of course, if you can donate then that would be great. But if you can't afford it, then don't worry. Don't get yourselves back into debt on our account - but what you can do, at no cost to yourself, is to download our toolbar and use it to make your web searches. If enough people did that it would make a big difference.

 

How else can you help? Refer to our toolbar in your forum signatures and let your friends know.

You could even include a link to our toolbar page in your emails.

 

Whatever you can do to help.

Just a suggestion might not work but might not...

 

Keep registration and access free; keep the donation system and book selling.

 

However would it not be sensible to say to each person that clicks to start a new thread they must register there bank details and take a direct card payment for starting the thread or bank payment? So in my case when posting my default notices cerberusalert instantly looked and gave advice the advise would still be free yet to start the thread you pay £1.00 or £2.50. That would stop people starting silly or multiple threads and make people read more on other threads giving the site team more time on each thread. Possibly charge a fee for a resource book (collaboration on basics on challenging debts) For example no need for complexed book just a summary of previous cases, letter templates comments by say Pt2645 or someone else. Some people don’t like searching lots of threads and reading page after page of comment they would possibly want to save time by buying the summary for say £9.99 or £14.99 if you included say how to deal with DCA and some legal issues...Sorry if you already do some of this just trying to help.

 

Possibly even a VIP area “coffee room” where if you prefer to only have you questions answered by the site team or authorised contributors the you pay say a standing order for monthly access and post your questions so on that may appeal to both more educated people that want an intelligent response and also to people who find the whole thing difficult and want to have there hand held a little.

I think that if we did this, a huge number of people would not bother to post at all. This means that the information base would become outdated and the resource would die.

Also we have always kept completely away from anything which might discriminate between or distinguish between rich and poor (so-to-speak). So access is available on an equal basis for everyone.

We don't award badges or colours for people who donate and we don't operate VIP lounges or any other system of privileges to reqward contributors.

 

Finally, it would worry me that the Min of Justice might say that we are giving advice in return for payment - not to mention the risk of incurring legal liability for peope who suffer loss for relying on the advice here.

 

At the end of the day we have to rely on people's own sense of value

(and that doesn't seem to be working too well at the moment!!)

This site is amazing and I think that what you have done is fantastic. I suppose I just hope it makes you some money so that you can keep it going and provide for your family.

 

One last thing what about a separate business using your servers to provide a web hosting service?

The kind of business you suggest is very interesting but we only have one server and our disk space is limited.

 

Also, running this forum for nothing is personally very demanding. I don't think that we have the personal resources to run to another business.

That wouldn't be a good idea tbh - you'll get a lot of support issues etc and if you don't have a strong team behind you then it will fail, and cause you more hassles than it's worth.

 

I will be sending through a donation over the next week or so, as soon as Barclays and Lloyds transfer the refunds to my account. Also, know what you mean about PP fees, pretty much suck up anything under a couple of pounds (have you thought of direct bank transfers, as I'd prefer that).

Also, you might want to check on the link for the ad banner on the left (the yellow one on baliff law) as when I clicked on it I went to a 'restricted page'.

Bankfodder, was that aim at me? I had a couple of 'wins' early in the year but didn't need to start a thread as I grouped some together - anyway I sent a cheque the other month.

 

Oh and Tatsuyace - what's a 'web advertising strategy'? Adwords by any chance? What CAG needs to do is create about 1,000 pages of content approx 750-1,000 words long and link to different threads on here - then they'd get more 'love' in the search engines. It would then be 'easier' to moneytise those posts than placing ads all across the forum, as a lot of the ads on here won't be viewed and their clickthrough rate will be rubbish due to 'ad blindness'.

I have to say, the problem might be that it's not at all obvious how to make a donation.

 

I'm looking at this page, about the donations crisis, and I don't see a link on it to make one. Looking at the Main Forum page, I don't see one there either. Have you considered putting it in the main navigation bar, and/or the footer at the bottom of each page?

 

I don't mean to be negative about it but I'm not a big fan of installing toolbars. They use resources and take up real estate on the screen.

Well, I have to say, I've never noticed that, so it can't be working very well :)

 

I don't read notification emails properly, I just click the link.

 

I used to work for a local charity and was responsible for the website. We had a little piggy bank under the left navigation menu with a couple of words asking for donations. That seemed to work.

 

Also, why use Paypal to process the donations and pay a large part of it as a fee? There are organisations that specifically deal in online donations.

 

We used to use efundraising.org.uk, though their website isn't responding just now - not a great advert. I have a friend who runs marathons, and raises quite a lot of money through justgiving.com.

 

The (very visible) bit on our site used to say

 

We rely on donations

to continue our work.

Please click here to donate

via credit card, debit card or CharityCard

(Picture of a little green piggy, which the forum won't allow me to post)

 

I'll make a donation once I've paid my winter gas and electricity bills.

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

then hit reply button

dx100uk, I'm not sure where you're going with the PDF instructions, but in the list of what I can and can't do at the bottom of the page, it says I can't attach files.
