Hi I've served a claim form on a company I am suing in the small claims court. They have filed their defence at court and sent me a copy of the defence together with a part 36 offer to settle. The part 36 has no signature on it is this a legal document without a signature?

My reasoning is if I don't acknowledge it because it is not legal then it cannot be used against me at a later stage.?

Have they mentioned the offer to settle in their defence?

 

Have you contacted them to ask them why it's not signed?

 

Do you want to accept the offer or is their defence pants and you feel you have a good case to get everything returned?

I've received the part 36 with their defence. Their defence in my opinion is weak and the offer in my opinion is too low, however it's the costs that are awarded to them if the judgment is lower than their offer that I am worried about.

 

I have made no contact with them as yet as I think I'm not going to accept the offer. is the offer legal without a signature?
