  1. Hi all I had a 900.00 overdraft which was taken away because of arrears elsewhere. When the facility was taken away it meant that I owed the bank 900.00. 895.00 consisted of charges put on to the account. So in theory I was paying off the charges. The bank agreed I could pay off this amount with no UOF and no interest because of financial difficulty. All was going well with repayment until I missed a payment and the whole process has started again. they have started to add UOF on the account In my mind I am paying off bank charges and have already been penalised once. Is the bank able to add an unauthorised overdraft fee on top of another fee i.e a penalty fee?
  2. Hi Thanks for your advise. With reference to the LA I have a contract where there is a fee chargable if I give notice to the LA and the tenant is still under contract. The LA was in breach of contract as they didn't produce a valid gas safety check until prompted by me. Can I end management contract with LA with no fee payable if they were in breach of contract?
  3. I thought that with a Stat P T there was no need for a new contract and the tenancy just rolled on month to month?
  4. Hi My tenant wants to renew their ASTcontract for a further twelve months. The property is managed by an agent and up until now the rent has been paid on time. The property inspections have reported nothing untoward so I see no reason for the tenant to leave. The LA wants 50.00 to renew the AST can I just ask that the tenant go on to a statutory periodic tenancy or is it in my best interests to sign a new contract.
  5. I'm not sure whether I put the cancellation in writing or whether I told them at the branch. I'm not sure about the account number being the same at the second time of issue. After the second time of issue the card was changed from Visa to mastercard. A new card and number was issued.
  6. Hi I has a credit card pre 19th May 1985 used the credit card paid off the debt and told the company i no longer wanted a card at that time. Ten years later I asked the bank if I could have another card. This application was made over the telephone they asked me several questions over the phone and then sent the card to my address. My question is should i have signed another CCA agreement after the ten year lapse.
  7. Hi I have a buy to let, interest only mortgage, which has accrued 1000.00 of arrear fees etc. I want these removed from the account as I am obviously paying interest. Does anyone have access to a templated letter to send to the Mort comp.
  8. I'm currently suing for breach of contract/negligence. The amount is for under 5000.00 so I assume it will be via the small claims track, although the case has not been allocated at present. I want to make an offer to settle but am not sure how to do so. The only info I can get is regarding part 36 offers is this relevant to a case that has not been allocated a case track?
  9. I've received the part 36 with their defence. Their defence in my opinion is weak and the offer in my opinion is too low, however it's the costs that are awarded to them if the judgment is lower than their offer that I am worried about. I have made no contact with them as yet as I think I'm not going to accept the offer. is the offer legal without a signature?
  10. Hi I've served a claim form on a company I am suing in the small claims court. They have filed their defence at court and sent me a copy of the defence together with a part 36 offer to settle. The part 36 has no signature on it is this a legal document without a signature? My reasoning is if I don't acknowledge it because it is not legal then it cannot be used against me at a later stage.?
  11. I'm not sure whether i'm in the right posting section but here goes. I'm in the process of taking an ex Letting Agent to small claims court a process I have never been through before. I have upto date got all of my info on how to proceed to small claims court from reputable books and internet sites I am a little confused at the moment as I have just received notification from the courts that the defendant has filed an acknowledgement of service and that it is the defendants intention to defend part of the claim. Am I right in assuming that because the defendant is only defending part of the claim that the rest of the claim is admitted and therefore they are liable to pay the claimant the amount that they admit they owe. If this is the case can the claimant accept payment for the amount admitted and still proceed with the disputed amount in the small claims court?
  12. I am the Landlord who has a full management agreement with a LA. My agreement stipulates that my property will be inspected every 3 months and I will receive a written report. Today I told the LA that I had not received a written report regarding the quarterley inspection and that it was due on 28.02.10. I was then told by the LA that the property had been inspected and a leak was reported, (this is being sorted at present) they stated they would not issue a written report until the repairs regarding the leak had been completed. I want the report to see exactly where the leak has caused damage as the LA is very vague. Can the LA withhold the inspection report until repairs have been done?
  13. What is the protocol before suing? Do I have to give the first contractor the chance to puts right?
  14. My property's roof was leaking in December 09. I hired a flat roof specialist to take a look and inform me of his findings. It was reported that the roof was holding a lot of water and that the best solution to start with would be to install a new drainage system. Also as the roof was fairly old parts of the felt needed attention. The roof continued to leak so My LA acquired a report from a builder who states that the drain that was installed was not done correctly, and needs attention and also that the roof needs a 3msq lay of fibreglass. I am a female landlady and unfortunately do not know of any reputable contractors so I have to place my trust in people's honesty. Any advise please!!
  15. I am not interested in serving a section 21 on the tenant as I think this is unnecessary. My AST states that I have to keep in repair and good working order the Indesit washing machine that is listed on the Inventory. Now that the W machine that is listed on the Inventory is broken and needs replacing. Am I legally obliged to replace it I'm not really interested in whether the washine was misused as the previous tenant gave it to me as a gift so therefore I didn't pay for it, and don't usually supply a washing machine. So therefore what I received as a gift is going to cost me time and money in the long run.
  16. I have just read the clause that relates to the repair of the w machine and it states that I have to keep in repair and proper working order the washing machine that is included in the inventory. As there is no life left in the w machine I am liable to replace it?
  17. Can you explain how replacing a washing machine and then serving a section 21 would be cost effective for the Landlord?
  18. I have a tenant who is on an assured shorthold tenancy. I have been informed that there are other people living at the property paying the tenant rent. I am not opposed to this but the tenant should have asked permission as it was written into his AST agreement. The LA has just informed me that the washing machine that I provided has now broken and needs replacing. According to the AST I am responsible for W machine repairs or replacement. As the tenant has breached his contract by not informing me that other people are living at the property am I still liable for these repairs as the machine could have been broken by the illegal tenant.
  19. Hi Scott Yes I have heard about this. But I thought that there was a right of appropriation where the banks couldn't just take any amounts of money that might be intended for other things such as rent or mortgage payments.
  20. Yea I did add interest. Can I argue that in theory I have paid them in cash so I want the amount in cash? I need the money becasue I am unemployes and like so many others struggling to find work.
  21. Has anybody experienced the same. I've recently been told by RBS that they will refund my credit card charges. They plan to do this by crediting my current account by the total amount of charges. They know that I am in financial hardship. Can they do this?
