      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My hsbc debit and savings cards were swallowed by the atm recently,

 

i recieved a letter from colin langdale ? asking me to detail the charges i was querying then got a futher reply from some woman, saying basically i was getting nothing-end of.. so i suued a lba today with 14 days notice. also from tomorrow my car will be signwritten with wording " sick of getting ripped off by hsbc, etc,etc. and i then intend to park my vehicle outside the cheriton branch near folkestone in kent. it will be intersting to see what reponse i get.:-D

I'm thinking of buying a T-shirt printing kit printing up a T-shirt which says "I took my bank to court for £x,xxx.xx and WON then I am going to ring and ask for an appointment to see the manager. Whilst I am sitting there for the usual half hour I will remove my coat to reveal the T-shirt and then see if it does take the usual half hour :D:lol:

i got my car sign written and have great fun riding around- with *the words -Are u fed of getting ripped off by hsbc -etc.-* i get a lot of looks off people ether in traffic, or whilst i am parked up, i have about 12 (working)days till i file my court action against hsbc.

Tim - that is funny - do you know one of those big "bill boards" that some advertisers use and tow on the back of a big van would do it nicely wouldn't it??

 

I saw one of these big bill boards being towed around town here today and they were using tannoys (loud speakers) to tell people about a new shop etc.. - sort of only take a few of these around town to upset the banks wouldn't it??? I do wish I could drive I'd sure be tempted to do that!! :D

Just watch out for me i am in a white metro .i get people in garages asking me what its all about, my friends in the street said-oh that must be tims new car!!, so far i have been in folkestone, dover,cheriton, and canterbury, so look out ashford ,ramsgate and broadstairs, the big man in the little car with his hsbc protest is coming soon.haha

Tim - I sure wish you'd come and drive near where I live!!

 

Today I was at Halifax Bank - I went in and requested Hubby's DPA etc.. and paid £10 - faces were so worth watching!! (I posted on a Halifax thread I am writing for progress etc.. - it is the funniest thing I have done in a long time!!

 

The girl at customer services desk had to go ask a manager how to deal with me!! So I just kept smiling "cos I'm right - they're wrong!!" or is it "cos they're big - I'm little??" :D:D

 

So worth going into a branch to do it - just to over hear their conversations and see the "what do I do now" looks on faces!!! :D:D

 

I had to smile when girl told me "can you go take a seat - while I ask about this" - so I did sit and listen (ear wigging all they way!!) and sat and looked cool, calm and collected :cool: - while they all panicked!!! Such a fun thing to do!!

 

My son did laugh "let's just hope you read right on that website mum - or you're in big trouble for this!!" he warned me as we came out of the branch!!

 

"Did your mother never tell you - she is always right?" she warns son!! :cool:

I went to canterbury to file claim against hsbc today, so ill have to wait and see, some of the staff were quite helpful, others werent so helpful/knowledgeable/bothered delete applicable, i then zoomed over to Cheriton with my protest metro " fed up with being ripped off by hsbc etc,etc.". and parked outside the bank for a little while, i could barely contain myself as i watched people enter and leave the bank , looking increduously, hahahaha.

 

Also as i have no decent debit/credit cards now - i came across this site,

easyMoney.com : personal finance from Stelios the founder of easyJet

whereby you can get a pay as ugo visa/visa electron/ or mastercard for about a tenner. with no checks, i think that the travelex one is free, and you can load free at either going places or first choice.

At least this way you can have a card for net payments etc.:smile:

The post office do something similar already.

Its a visa Electron and you load it up with multiples of 50.00.

You can choose between dollars euros or sterling so its good for holidays too.

Theres a one off 10.00 opening fee.

Hi, d and g solics have written 2 say they will defend claim , i refused 1st offer, so they have 28 days to respond, bring it on hsbc.:)
