    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Advise please on an unknown issue that I want to complain to somone.

 

 

me and my sister just pulled onto Neto car park and their was man and woman having huge argument at the side of the mans car, he had a child in his car also.

 

anyways the woman was shouting and screaming and swearing at him , calling him every swear word possible, each time he tried to walk away she followed him to car and was up in his face, this poor bloke was ovbiously coming off a lot worse in the argument (nothing physical) . . .

 

Me and my sister watched from a distance but didnt step in as they could of been partners and its not our place we couldnt hear the specifics and when we arrived we was at the latter end of it, i imagine they had been at it before we arrived.....

 

 

anyways when the poor bloke finally got in his car and drive off we went into netto and did shopping came out and this woman had a clipboard and was writing out regs and was clearly a trafic warden but in civvy clothes, she had a van with the name excel parking. . .

 

what should I do, im furious this was a parking dispute, no matter what was said previous or what the specifics were she had no right to verbally attack. . .

Sounds as if Excel are managing the car parks for Netto. Trouble is, you don't really know what happened to spark the argument although, it sounds as if the lady was acting extremely unprofessionally, regardless of the cause.

 

I would be inclined to write to the manager of the Netto store, explaining what you witnessed and how upset and disturbed you were by the whole incident, particularly as the gentleman concerned was accompanied by a young child.

 

They may have CCTV so a time and date would be useful.

 

You could try writing to Excel Parking also, but they may well not be overly sympathetic. It's their Client (Netto) you need to target.

 

There is also a remote possibility that this may have been a domestic, but seems unlikely based on the information supplied.

No she wasnt a traffic warden, just a goon paid the minimum wage or less to stand out in the rain attaching toilet paper to cars. As the above post, I'd complain to Netto. No point complaining to Excel, they won't give a toss.

Thanks heaps, I know nothing of traffic offenses but know that she was out of order, the odd words I heard was swear words from her like calling him a "gobsh*i"e"and how she meets ppl like him everyday, but forget what she said she was really in his face and pushing for a fight, unbelievable.

 

Is their no governing body for these trafic enforcement agencies that would take a letter ? ....... I just hate to see somone treated this way and if I had been there from beginning and also knew it was a trafic enforcer at the time I would of steped in.

They are not "traffic enforcement agencies", just a bunch of chancers. Have a good read on this forum about private parking companies [ppc's]. It will open your eyes to what they really are. There is no "Governing Body". [problem] artists tend not to have them. Unfortunately you witnessed behaviour typical of PPC employees. If you think she was bad you should meet a few clampers!

Its amazing that companies like Neto who would want to uphold customer service would contract to such bad apples to police their land and terorise customers.

Tickets, fines etc from private companies are just invoices or requests for money. Most people just pay up making the cowboy chancers very rich!

the two people that run Excel pull down the best part of a million a year between them. the poor schmucks in the carparks pull down minimum wage. keep an eye out though as PPC operatives not in livery is now a breach - and gets the PPC 'points'. Digital cameras at the ready folks when you are in PPC territory ! :)
