Hi guys,

after reading all the posts in this forum my mind has eased a bit.

i moved away from the uk about 9 years ago to Ireland. I recieved a letter yesterday addressedto the occupier of a house i live in a year or so ago here in ireland. it looked like it was knocked up on a word processor no proper header or anything, just asking the occupier to contact a number quoting a reference.

then today i get on with a proper header ect even though it looked like a photocopy addressed to me stating,

 

we not you have failed to respond to mail directed to you

YOU HAVE BEEN TRACED AS LIVING AT THE ADDRESS STATED ABOVE. PLEASE CONTACTOUR RECOVERY DIVISION IMMEDIATELY.

 

if you have not established contact with this department within the next 5 days a local agent may call

 

signed by the famous Jason Evans.

 

none of the 2 letters state what its about or who they are acting on behalf of.

do i ignore them or make contact??

Ignore!

 

This is a time when you need to check CRA's for this companies search entries. If they have done an address search that should simply be that. If, however as many of these cunning lowlifes do is to make a 'credit' search. If they have then they'll have tried to circunvent the 6 year rule by entering something like 'Outstanding Debt. If this is so, contact the CRA who will probably come back to you that Ruthbridge (or whoever else) say it is valid.

 

It is NOT valid but the CRA will NOT remove it. In that case get a swift complaint about them to the ICO. Weeks/months later you'll get a solution from the ICO. If you are hassled then also send the DCA a letter defining that the case is 'statute barred' (over 6 years). There's a template around for doing this. The problem of an entry like this is detrimental to any credit searches you might get in the future and they stay on file for 2 years.

What ever you do DO NOT contact them by phone or you will be bombarded with threats. They will threaten all sorts, such as Bankruptcy, bailiffs etc etc. Its all lies though but threats scare people to pay up what they may not legally have to. These people are cowboys. No local agent will call, I bet my life on that.

I wouldn't worry at all, and would welcome the knuckle heads to ring your door bell!

If the debt is as old as you say it is, and there has been no payment or acknowledgement that it exists, by you, in the last six years, it is firmly statute barred and can easily be put to sleep.

 

The tracing aspect is different, they may have said they have traced you to this address, but!, they very seldom have any knowledge of any tracing skills whatsoever.

If it was addressed to 'The Occupier' then be assured that all they have done is to send anyone with the same name in that area with the exact same letter, this is as far as their 'Tracing' goes.

it just surprised me that the day after the letter to the occupier arrived the one addressed to me addressed, considering i have been in Ireland for nearly 9 years it surprised me to even get something from a uk company. i just couldnt work out how they got my irish addreess

in that case why not just write and so - ok pal- send your guy around and ill discuss with him the benefits of not calling at my home uninvited

If it's anything to do with Ruthbridge then it's 99.99% guaranteed to be Statute Barred anyway - as is the case with you

Oh and by the way jason evans doesn't exist.If you do phone them insist on talking to the mythical evans. Dont accept anyone less than the man himself. Get him to prove his idenity. Fun perhaps but i wouldn't waste my time with his bunch of cretins. How they make money escapes me.
