Able to provide original documentation???

Hi,

 

I got into alot of debt with about 5 different companies 3.5 years ago... since then i have lived out of the country and in the uk and kept my head in the sand.

 

I have receievd some letters address to me at a distant relatives address (which i do not understand how they know about then or why they are associated with me??) and it says the Debt has been passed to DHS, from 1stcreditLTD which was given to them by Cash Euro Net. I no it is from a pay day loan, but I do not know how much it should be... It just says 465 on this letter to pay.

 

Do I have a right to request original copies of what the charge is for??? and what if they cannot provide this???

You have a right to know to whom you owe money and how the amount has been reached. In all likelihood, they have sent the sme letter to everyone in the area who has a similar name, your distant relative should complain about this to trading standards as it is not allowed.

 

Also, it shows that they still do not know where you are.

 

If the account is a payday loan it will be covered by a CCA request, this should be sent (unsigned) along with a £1 postal order. the template letter can be found here: http://www.consumerforums.com/resources/templates-library/86-debt-collectors/581-cca-request-letter

 

Before you go down that route however, how long is it since you acknowledged the debt in writing or mada a payment against the debt? if it is six years since you have done this, then the debt may be statute barred, you need to be fairly confident of this time period.

thanks... the loan is only about 2 years old... unfortunatley....

 

regarding the CCA, what happens if this cannot be provided??

You can legally withold any payment until they provide an enforceable CCA.
