Hi

 

Think I am am finally getting the basics of filing my claim. My Branch address for BOS is in Scotland (I opened the account when I lived there in 1995-1999) - but have lived in England since 1999.

 

Do I make a claim through Scottish Courts system or English Courts system?

 

The address I have been sending letters to was originally the BOS Head Office in Edinburgh, but more recent letters have been sent to HBOS customer service in Leeds.

 

I read on one of the forums that if I could find an address in England for BOS, then it would be through the English courts, but what address should it be?

  • Bank Of Scotland - Claiming £1221.27.

  • 17/7/06: Sent Prelimary Request For Payment. :)

  • 20/7/06: Received reply saying Customer Relations will investigate and I will receive reply 'no later than 4 weeks'! :mad:

  • 1/8/08: Sent Letter Before Action. :)

  • 8/8/06: Received letter offering 'Goodwill gesture' of £137.00, which I have replied 13/8/06, saying I would accept as part payment. :|

All quiet on the Western Front - no contact from them...

 

  • 29/8/06: issued Court Claim via Money Claim Online for £1221.27 - Keep your fingers crossed because I have just paid £120 Court Fees and am a little nervous. . . ! ! ! ! ! :?

I'd use the English courts - less limitations and closer for you to attend. Use HBOS at the Trinity Road address (see the Halifax forum stickies).

Halifax joint a/c (£3800 charges + £40 interest on charges over 11 years) - paid in full 23/06/06

Halifax joint a/c new charges £1100 - LBA sent 02/08/06

Halifax 2nd a/c (£1500 charges + £150 interest on charges) - partial payment received 13/07/06 (no s69 interest) - AQ filed 07/08/06 - Court awarded 50% of s69 interest (Bank didn't turn up!)

Halifax Visa (#1) Data Protection Act sent - statements arrived - £350 so far

Halifax Visa (#2) Data Protection Act sent - refunded £170
