but having been in debt I think this might either be a [problem] or I've got some debt I'm not sure about.

 

I've had a call from 01932332007, then also received a text from 07508 355162 with the following:

please call Roxburghe on 01932332007 quoting ref use option 5.

 

I rang said number and spoke to, let's call him Jeff. Below follows rough transcript of conversation:

 

Jeff : Hello I need to take some personal information from you

me : I'm not at liberty to divulge any personal information until I get advice on either your company, or on whose behalf you are contacting me.

Jeff: I cannot tell you that due to European Data Protection laws

Me: oh well I'm definately not providing any security information until I have necessary assurances that you are not trying to [problem] me.

Jeff: I think we'll cut the conversation there. Thank you

 

Hmm thought I, this is a bit fishy, lets try to spaek to someone else.

 

Me: I'd like to speak to someone in a position of authority

them: pardon

me: I'd like to speak to someone in a position of authority

them: if I can ask you some security questions

me: I'm not at liberty to divulge such information

them: well we can't do anything unless you do

me: who are you working for, or kindly tell me what your company function is?

them: we can't tell you that due to UK and European Data Protection Law, if you can answer these security questions

me: I cannot answer your questions due to my Data Protection, I've worked in debt collection and in marketing, and at no point are you under such a code of conduct to not discuss the company you work for.

them: ok we're not getting anywhere here, I'm going to end the call

me: ok have a good day.

put phone down.

 

I bank with 2 banks, am on good terms (within my overdraft) on both, have received no written communication from any company, I am up to date with payments on my credit card, but with a limit of £150 I'm hardly likely to get into trouble on that. I have a student loan, which as I am below the payment threshold I do not have to contribute towards so I am failing to see why this company should be contacting me.

 

I am concerned how they got my name and my mobile number. Surely that contravines any data protection laws?

They are on a phishing trip ignore it and don't worry. As to where they got number from is anyones guess you only need to put your number on line, it has just been Divulged that the DVLA are selling peoples info for £3 a shot apparently they have raised £40 million. Wait and see if you get anything in the post, if you do come back to the thread.

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

I've just had another phone call from the most patronising of men, I've informed him, yet again that I'm not going to give any personal information out and if they continue to harass me then I'll go to the police with their details. I also told him that the data protection act was there for my benefit, not his. I've aslo told him that I'd be refusing all phone calls from these particular numbers and if they have anything further to say then they must put it in writing.

 

According to him the calls are for personal monatary issues pertaining to me, but would not say what. After some research I've found their website Welcome to Roxburghe - Fresh approach, better results

 

They won't tell me who they're acting on behalf of, I know my affairs to be in good order, and as for outstanding matters whenever I change address I always leave forwarding contact details, but as all my post has been going to my current home for 18 months, including a mail redirection service I'm at a loss as to hwat debts I've accrued!

 

Has anyone else had the misfortune to deal with these people?

As said above ignore them and just hang up, wait for something in writing. You will end up saying something and that will be the ammo they need, just hang up When and if you get something in writing then you can reply using template letters etc.

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

The above is from the OFT Guidelines, as you now have an idea who's calling you just quote that, if you can be bothred to answer the phone that is

that is awesome, thanks for that. I've got it written down and waiting should they ever try to contact me again. I've spoken to my local police force, and registered my concerns with trading standards. I've ordered my free credit checks from experian and equifax, but I know I'm up to date, just to see if anyone's been naughty at my expense. From reading through other forums they sound like a right bunch of n0bs that seem to specialise in aged debt, I'm just ignoring them, they WILL go away :)

for a laugh I would use there website to request a calllback and put down the number for your local trading standards. but all joking aside as has been said if you do give them any info they will just use it to bully and harrass you. when you get anything in wrighting post it up here and you will get all the help you need to send them packing.

on another note anyone whom gets a phishing letter from any dca should use that dca's complaints procedure and then complain to the financial ombudsman,as I beleve this will cost the dca £450 regardles of the outcome maybe if they start to get loads of people start doing this (say 10 per phising trip =£4500 they will soon stop it)

ok, so I've had 2 text messages today and another last week so I've spoken to the OFT and they told me to compose a letter which I have done thus:

cc: Customer Complaints Department

Lavender Park Road

Surrey

KT14 6NA

 

 

Dear Sirs,

 

 

I write with reference to the repeated and unsolicited contact your company has seen fit to bestow upon me for which I would like to complain. To my knowledge Roxburghe has no authority to contact me, and the methods employed by your staff to obtain personal information from me have hardly induced me acquiesce. Furthermore I have found the tone and manners of your employees to be execrable. Despite repeated asking, your staff have deemed it necessary to withhold such information as what line of business Roxburghe represent, and who, if anyone, they work on behalf of. May I draw your attention to the text below which is from the Office of Fair Trading guidelines which clearly show Roxburghe's approaches to be reprehensible at best.

Regarding the matter in hand I formally request, as is my statutory right in accordance with Section 77 and 78 of the Consumer Credit Act, full, accurate and unaltered written proof of debt to be sent to me within 14 (fourteen) days of the date of this letter 15th February 2010; any contact from Roxburghe after the fourteen days will be considered a criminal breach of the Consumer Credit Act and will be dealt with accordingly.

I'm not sure I want to put my address at the top of the letter, but I think the tone of it shows I'm not the kind of person to be trifled with!

 

Any suggestions?
