  1. ok, so I've had 2 text messages today and another last week so I've spoken to the OFT and they told me to compose a letter which I have done thus: To: Customer Service Manager cc: Customer Complaints Department Reference: Roxburghe (UK) Limited Roxburghe House Lavender Park Road Surrey KT14 6NA Dear Sirs, I write with reference to the repeated and unsolicited contact your company has seen fit to bestow upon me for which I would like to complain. To my knowledge Roxburghe has no authority to contact me, and the methods employed by your staff to obtain personal information from me have hardly induced me acquiesce. Furthermore I have found the tone and manners of your employees to be execrable. Despite repeated asking, your staff have deemed it necessary to withhold such information as what line of business Roxburghe represent, and who, if anyone, they work on behalf of. May I draw your attention to the text below which is from the Office of Fair Trading guidelines which clearly show Roxburghe's approaches to be reprehensible at best. 2 UNFAIR BUSINESS PRACTICES Communication 2.1 It is unfair to communicate, in whatever form, with consumers in an unclear, inaccurate or misleading manner. 2.2 Examples of unfair practices are as follows: c. those contacting debtors not making clear who they are, who they work for, what their role is, what the purpose of the contact is Should you desire to contact me in the future please note that all communication must be in writing as I am not at liberty to answer any verbal or text requests. Regarding the matter in hand I formally request, as is my statutory right in accordance with Section 77 and 78 of the Consumer Credit Act, full, accurate and unaltered written proof of debt to be sent to me within 14 (fourteen) days of the date of this letter 15th February 2010; any contact from Roxburghe after the fourteen days will be considered a criminal breach of the Consumer Credit Act and will be dealt with accordingly. Yours etc. I'm not sure I want to put my address at the top of the letter, but I think the tone of it shows I'm not the kind of person to be trifled with! Any suggestions? Thanks Weebles

  3. Sorry i've not made things very clear as I'm so vexxed! I've got a sole lloyds bank account (opened around 1999) and a sole credit card (opened 2000) The ex and I had a joint lloyds tsb bank account (opened around 2002), and we had the loan paid into and out of said account. After we split up the financial advisor in aber let me open a sole bank account (opened in 2003) for the purpose of me paying in money for the bills etc to come out of. None of it worked, I was left carrying all the debt, plus the debt lloyds put me into by increasing my overdraft limits. Lloyds have been using the joint account for the last 12 months or so to squirrel away money I've been paying in, to pay off against my sole credit card. I wasn't aware they could do such things tbh, but they said they could. At one point there was a credit blanace of almost £200. I'd have liked to have offset it against other debts but lloyds said I couldn't. Hope that clears things up a bit
  4. Until last month I had 3 bank accounts with Lloyds TSB. I opened a sole account with them, which now has an od of £2900. I've got a cpy of the charges they've levied but I've not done a SAR, I'll look into that, would that cover my credit card too? My joint account has not been in use by me or the ex since April 2003. however lloyds have syphoned off money from somewhere and put it in there to pay missed credit card payments, that they still charged me £12 late fees for. They have refused to refund the account charges with one of those standard ha ha we won letters, I'm not letting them get away with this. There was the loan coming out of the joint account, i asked them to let me take sole responsibility fo it but they'd not do anything without the ex's signature. I had a third bank account whcih had a nominal od of £200, which was written off by solicitors acting on behalf of lloyds tsb last month/november. We had a joint loan which I got a full and final for, I was in the fortunate position that my parents could lend me the money to pay that off, about £1500 in the end. I've done everything lloyds have asked me to, and they think they can get away with putting someone £5k in debt. It's not happening. I want to nail their testicles to the wall!
  5. that is awesome, thanks for that. I've got it written down and waiting should they ever try to contact me again. I've spoken to my local police force, and registered my concerns with trading standards. I've ordered my free credit checks from experian and equifax, but I know I'm up to date, just to see if anyone's been naughty at my expense. From reading through other forums they sound like a right bunch of n0bs that seem to specialise in aged debt, I'm just ignoring them, they WILL go away

I know mines not hutchinson 3g but I've recieved 3 phone calls today from roxburghe, they won't say what sort of company they are, they wonlt say who their acting on behalf of, so I won't give them my personal details. I've just had another phone call from the most patronising of men, I've informed him, yet again that I'm not going to give any personal information out and if they continue to harass me then I'll go to the police with their details. I also told him that the data protection act was there for my benefit, not his. I've aslo told him that I'd be refusing all phone calls from these particular numbers and if they have anything further to say then they must put it in writing. According to him the calls are for personal monatary issues pertaining to me, but would not say what. After some research I've found their website Welcome to Roxburghe - Fresh approach, better results They won't tell me who they're acting on behalf of, I know my affairs to be in good order, and as for outstanding matters whenever I change address I always leave forwarding contact details, but as all my post has been going to my current home for 18 months, including a mail redirection service I'm at a loss as to hwat debts I've accrued! Has anyone else had the misfortune to deal with these people?

I've had a call from 01932332007, then also received a text from 07508 355162 with the following: please call Roxburghe on 01932332007 quoting ref use option 5. I rang said number and spoke to, let's call him Jeff. Below follows rough transcript of conversation: Jeff : Hello I need to take some personal information from you me : I'm not at liberty to divulge any personal information until I get advice on either your company, or on whose behalf you are contacting me. Jeff: I cannot tell you that due to European Data Protection laws Me: oh well I'm definately not providing any security information until I have necessary assurances that you are not trying to [problem] me. Jeff: I think we'll cut the conversation there. Thank you Hmm thought I, this is a bit fishy, lets try to spaek to someone else. Me: I'd like to speak to someone in a position of authority them: pardon me: I'd like to speak to someone in a position of authority them: if I can ask you some security questions me: I'm not at liberty to divulge such information them: well we can't do anything unless you do me: who are you working for, or kindly tell me what your company function is? them: we can't tell you that due to UK and European Data Protection Law, if you can answer these security questions me: I cannot answer your questions due to my Data Protection, I've worked in debt collection and in marketing, and at no point are you under such a code of conduct to not discuss the company you work for. them: ok we're not getting anywhere here, I'm going to end the call me: ok have a good day. put phone down. I bank with 2 banks, am on good terms (within my overdraft) on both, have received no written communication from any company, I am up to date with payments on my credit card, but with a limit of £150 I'm hardly likely to get into trouble on that. I have a student loan, which as I am below the payment threshold I do not have to contribute towards so I am failing to see why this company should be contacting me. I am concerned how they got my name and my mobile number. Surely that contravines any data protection laws? Thanks
  9. Hey, Wondering if people can hand out some advice. I've had the severe misfortune to have been a Lloyds TSB customer since the late 1990s. Everything was fine until 2003 when my parter left me and I was left, as a uni student, propping up rapidly crumbling finances as he left me with the house and it's periferals to pay for, apparently as I was first to sign on everything the blame lies sqaurely at my door. I stopped banking with lloyds in 2003 as they refused to turn my classic account into a student one, I've been with Natwest ever since. From memory my lloyds debt was about £1000. Since 2003 I've paid in money when able (having held down 3 jobs while studying trying to keep up with lloyds demands) while they have continued to give me false information, extend my overdraft limits and charge me to the hilt (£200 in one day) which has resulted in me going over my overdraft limit, being charged for that, rinse and repeat. Since 2003 I've been in severe financial hardship, a) as a student and b) as an unemployed graduate since 2008. I've paid money in where possible, I've been sent to the collections department I've had andover lose not one set of compliant/please refund paperwork but two. I've discovered that the collections centre in India (no I'm sure your name isn't Richard, any more than mine is Rashid) and Lloyds TSB branches don't operate on the same computer system. At it's height Lloyds TSB and Lloyds TSB credit card had put me into debt to the tune of £6000 (that includes my £1000 orignal debt) That's £5000 in charges. My joint account with my ex was supposed to have been frozen as he declined to return any of the paperwork to close the account (that is if Lloyds actually sent him any). I asked my local branch at the time if they could remove the £5 charge account and put it to a base account, they told me no. £500 of charges later someone on the phone in a UK based call centre told me that stopping the charge wouldn't be an issue and she didn't understant why this couldn't have been halted in the first place. My current account I've had RPs only to be recently told as my account is in dispute that I can't have another one. I was even passed to a solicitor who were so wonderful and could see that my accounts had been so grossly mismanaged they wiped off £600 of debt for me to put me back into branch control. Having had my mental health suffer as a result of all the stress they've put me under, and working non stop while I should have been studying I now owe about £3400. I've pleaded my case under severe fincancial hardship. I've had the CSSC is it also confirm that my hardship is severe. I've bent over backwards for lloyds, now only to be told "oh we've won ha ha ha, now pay us" I don't disagree with charges if I'd put myself £6k in debt then I'd have issues, but I disagree with the fact Lloyds put me £5k into debt and expect me to deal with the consequences. Is there anything I can do apart from killing myself in their headoffice to highlight the fact I seriously can't take any more?
