I have a collegue who gas been off work for sometime. They sent in a doctors note but the doctor altered the period the note covered from 1 week to 2. Her employers phoned her doctors surgery to query this and were told that they could not divulge this information. They then called another surgery that was ran by the same practice and were given the information.

 

Is this a breach of the DPA, both buy the surgery and by her employer as they would have had to have given details such as her date of birth to the surgery for them to be able to access this information.

How did your colleague find out?

 

I think the breach is by the surgery for giving the information, not by the employer for requesting it. Speaking to PALS might be the most straighforward way to sort this out.
