Cheers for your help. Just an update.

 

I think i need to get my papers sorted out. Havent received a questionnaire yet - not sure what thats all about but i think i will find out when it arrives. Just read the papers sent from Northampton County Court. Lloyds are defending whole amount - they have 28 days from date of acknowledgement which was 1st May - they acknowledged on 5th May - I think my deadline is coming up fast - 28th May i think. Better get prepared.

Will keep you advised and i am reading everyones threads double quick time!!!!!

Good Evening, no nails here -hee hee

 

No allocation questionnaire still - getting worried. So ......

 

Called Moneyclaim's helpline today. they advised i need to wait till 29th May - Bank Holiday - they are not open on 30th Tuesday - so put claim in by default on Wednesday 31st - They advised it takes 48 hours for default to go through.

 

She suggests because I havent recieved the questionnaire Lloyds could be getting ready to pay up!!!

 

She - Nicky from Moneyclaim very chatty - very good at "impartial" but very interested in whats going on with the banks - suggested she watched June 5th Tonight with Trevor - she said she will pass the word on and get all at work to watch - interesting viewing to actually see what is going on - still impartial but very keen!!!.

 

So to call it a night - await the phone call !!!!! with vinegared nails !!!!!

 

(just out of interest not allowed nails - used to have talons - now do Karate and nails not allowed !!!! So as the advert says - No Nails """"""

Spent last night reading the defence.

 

From reading BaronStoneyBroke's thread - its the same defence but with an added Section which goes.

 

"It is denied that s15 of the Supply of Goods and Services Act applies to this claim, since the Bank provides details of all charges which are incorporated into the contract as pleaded in paragraph 2 above."

 

There was alot of discussion with Baron's thread about the SOGA and am completely lost now. Does it look like Lloyds is going to Court or is it just me reading between the lines.

 

Any advice on this - would be really appreciated. Feeling deflated.

All you need to do is wait IMO. You don't need to reply to their defence until you're in court. Which won't happen. Just because their charges appear in some leaflet does NOT make them reasonable. You have a choice when presented with the bank's "Standard Terms and Conditions" - you either agree to them or you go elsewhere for an account. Under Contract Law, any term which places you at any kind of disadvantage which was NOT INDIVIDUALLY NEGOTIATED WITH YOU, is unenforceable.

 

So - you're relying on an interaction between SOGAS and UTCCR/UTCA - which they have not accounted for.

I am still waiting on my questionnaire also. I just called the small claims helpline number who informed me that this is now being sent to my local court and that I should receive the questionnaire within the next few days.

I've read other threads where the allocation questionnaire has taken up to 4 weeks to arrive (going by other peoples dates).

 

LLoyds have indicated an intention to defend all of my claim (as of 01 June) so I'm a couple of steps behind you.

 

I'm eagarly awaiting the defence letter and so am following you thread with much anticipation!

LLoyds TSB: took over 2 months :rolleyes:

but they gave in :lol:

and I got my cash back

 

all £1040 of it!

 

Capital one and MBNA on my hitlist .... stand by for action!!!

Good afternoon all.

 

Just to let you know i have spoken to Moneyclaim - which apparently havent received Lloyds defence dated 25th May. After some discussion, we decided to go and file for default (on their recommendation) as they have not yet received it. It takes 48 hours to go through and once the time is up - it then goes to "Issue". (loyds can still appeal.)

 

It was mentioned that because I had received my defence on 25th May and it is now 2nd June - it could be that Lloyds are awaiting my next move - playing the game to see how far I went - I have now filed default and await Tuesday's / Wednesday's outcome.

 

Once the Courts have received the defence an allocation questionnaire then gets sent out to you. - not sure whether it comes from local court office or from Northampton - i think it comes from Northampton - then you allocate it to your local court. Will get this answered asap when I speak to Moneyclaim.

 

Hopefully this will all be done and dusted (but not counting chicken and eggs yet).

 

Await with anticipation on what next move will be from Lloyds!!!!!

Just to keep you updated, spoke to Moneyclaim this morning my default has gone through and now I can issue Bailiffs into my local bank!!!!!!!!!!!!!!!!!!!!!!!!!:) no money as yet!!

 

I am going to speak to Lloyds Solicitors by Friday if I have not heard from them - I am reasonable after all (the lady at Moneyclaim laughed as well!!!!).

 

Friday is my deadline - so will update further - especially on the Bailiffs.

Fingers crossed for you, i really dont understand their gameplan, it seems to be different with every case, mione had a settlement offer before they filed a defence.

Hi there, I am just at square one!. I am today posting my SAR letter to Lloyds TSB (with the £10 fee!) to find out how much they have charged me in Bank Charges for the past six years. I have read your threads with interest and am hoping that they pay you!; I'm pretty certain they will put me through everything they have put you through!. Best wishes

RELOAD - Funny enough - I have just purchased a VHS with my windfall from Halifax!!!!! so yes i will tape if it comes down to that!!!!! Quite funny - my home town has been filmed recently by Hollywood - Cameron Diaz and Jude Law!!! - so it would be nice to add another film to the Hall of Fame!!!

Ohh Lorraine i would pay a fortune to see bailiffs go into a branch, that would make the branch look like a joke !!!

 

Of course the local paper would have to be invited as well ;) ;)

Lucky you...Dont spend all that money in one go and if you do watch those BANK CHARGES.

 

 

I have just sent off the questionnaire to the court with the £100.00 fee. Not really sure what will happen next..e.g. will I have to attend court or will they settle before it gets to court? any ideas anyone and also has anyone else gone this far and if so did they settle before the court date.

Hi, I don't want to de-rail this thread, just wondering if the £100 charge is a standard fee or does it vary from case-to-case depending on your claim amount? I assume if your claim is successful, you claim it back?

DPA letter sent recorded delivery to Head Office in London - 07/06/06 - have until 19/07/06 to send out statements

Hi spacebug2k,

 

When you start the process you're best off starting your own thread - helps the mods keep track of numbers, etc.

 

To answer your question though - the £100 is related to the Court Allocation Questionnaire, and is dependent on your claim amount and whether Lloyds' solicitors decide to settle with you before you reach that stage.

 

When you actually file your moneyclaim in the first place, there is a charge dependent on your claim amount. Over £1500 is £120, scaling down below that to around £30 at £500 if I remember right (not sure).
