  2. I am claiming against the RBOS and went onto the small calims to make my claim as I have an english address. You get to a stage that you have to fill in the defendents name and address (RBOS) and it states it must be a English or Welsh address. I had to stop there as the bank I am claiming against is in scotland. Can I use the London address I saw in this thread to send my claim to?
  3. I really need help here. I have sent the 2 letters and am now ready to start court proceedings. I have a relative in England doing this for me. Can I go through the English small claims.... amount claiming back is over £4000.00 Bank is Royal Bank of Scotland. If I go through the English small claims I cannot put in a scottish address for the defendent. Is there a RBOS Address in England I should use. If I cant do it this way how do I start court proceedings? PLEASE HELP
  4. Hi I need help. I have sent the 2 letters to the RBS (I live in Scotland) but it is for over £4000 so am I unable to go through the small claims court? What court do I go through to proceed with Court Action. Thanks Jif
  5. Hi Everyone I have sent my questionnaire to the court with the £100.00 fee. The date this was to be in by was today 21st June 2006 (I sent mine a couple of weeks ago). I called the court last week to find out what happens now and they said theyu were waiting on the Bank submitting their questionnaire. What happens now? Do i just wait for a Court date? I am really worried that I am now going to have to attend court and from reading the other threads no-one else seems to have gone this far, it seems everyone else has received a settlement letter before it has gotten this far. Am I just panicing? I really need help here and reassurance that this is the way it goes. By the way its Lloydstsb that I am dealing with. Hope someone can help.
  6. I have sent the questionnaire with the £100 fee but haven't gotten in touch with my bank or their solicitor to state that I have done this. have I done wrong ?
  7. Lucky you...Dont spend all that money in one go and if you do watch those BANK CHARGES. I have just sent off the questionnaire to the court with the £100.00 fee. Not really sure what will happen next..e.g. will I have to attend court or will they settle before it gets to court? any ideas anyone and also has anyone else gone this far and if so did they settle before the court date.

  10. I am still waiting on my questionnaire also. I just called the small claims helpline number who informed me that this is now being sent to my local court and that I should receive the questionnaire within the next few days. I am really panicing that I may have to attend court. I know there will be another £100.00 fee to pay, but have also been told by the small claim helpline number that there may be a court fee??? any ideas what that can be
  11. HELP.............I just got the defence documnts sent to me today from Lloydstsb...I went online to check my claim and this is what was written.... You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. What does this mean? I am really panicing now?l

  13. Stupid person here.........I am confused by the dates. My claim was served on the 10th May to Lloyds which gave them until the 25th May to answer. I received an Acknoledgment of service on 18th May does this give them 28 days from when the claim was served ( 10th May) or from when I received the Acknowledgement??????????? Also if I receive nothing in the 28days do I win be default? :confused: :confused: :confused:
  14. jifandfi here.............I also got a "I intend to defend all of this claim" letter today.............from MARTINEAU JOHNSON they have definately got their work cut out..........
  15. I just got An Acknowledgement of Service delivered today with Lloyds saying they are going to defend this. It has made my stomach churn quite a bit but am still glad I have persued this, especially after reading that many more of Lloydstsb loyal customers have also received this. Keep your fingers crossed for me..............
