Sorry for no reply of late. I finally got First national to settle out of court 1 week before it was due in court. They settled for 100% of the claim including the early redemption fee. -

UPDATE!! First National requested an extension to submit defence, I accepted showing that I was being reasonable, the new deadline was the 26th Sept. By 5:30pm they had not submitted a defence and I so I requested judgement. The pay by date on the requested judgement is 10th Oct, if they have not paid by then i will issue a warrent. I will keep you all updated:o -

Apologies for the delay in writing. I have been chasing my claim up with the court and the judges are on holiday and left with a hugh backlog of claims to arrange. So my claim is still sitting on a judges desk. I aksed the clerk how I could file a cliam against the court because this is costing me with not results or movement in workflow, she told me to go away and stop bothering her. As soon as the claim is issued i will let you all know -

First Nation today made n offer of £675 in a gesture of good will as they believe that the ruling only applies to credit card not banks or mortgage companies. So i shall be not accepting the offer and filing a court claim today in the process. -

they are based in Harrow. First national are doing the stalling thing by making out in there letters that they are trying to resolve the matter waiting for 4 weeks then stating go away. so onto the next stage -
Appologies for the delay, I have been ion holiday for the last fortnight. BCT have refused to repay, on the grounds that the charges are not unlawful just excessive, and that i signed up to that agreement, so onto the next stage

What can i say. I bought a car that was a cool car, lost my job could afford it anymore. These guys crippled me with charges that in the end I had to hand the car back and they sold it for a pitance and left me with hugh charges left to pay. I am seeking them back now. phoned for statements, got them same week, free Sent Prelim letter, they lost it, but i had proof of delivery they finally found letter after 10 days Phoned the on deadline day and they stated they are dealing with it and they would get the litigation manager to ring me today (30/06/06) I shall keep you informed

Started by ringing for a copy of my mortgage statement, got told happy to help, and received them the following day!!!! (gobsmacked, as they were free) Sent Prelim Letter asking for Late DD's, Arrears fees, early redemption, legal fees back. Legal fees will take some getting but they do need to prove that they didnt make a profit on them, so it is worth a try. Got letter back stating they are considering the case and will come back to me in 14 days. I gave them the benefit of the doubt and honouring their 14 day request before sending a LBA letter Tried to ring contact on letter for update as 14 days are due, no answer. LBA sent today (30/06/06) for £3k (exc int)

I will be intrested in this one, i too have charges from them for car finance. I requested the statements over the phone and got them the next day, i was shocked at how fast they got them out to me. BCT nearly destroyed me with the charges they levied on my account, I have now issued a prelim letter to them. Good Luck -
sorry for the delay, the bank have settled in full on the 15th of June with no clauses, thanks to all that have helped in this quest

Quick update, solicitors received my acknowledgemnt of the offer back with the clauses re confidentiality and further action crossed out, they say their client will not accept, but they will revise the clause to say i cannot reclaim for any charges that are within the current claim but in future cases I withold the right to carry out the appropriate action to reclaim the charges. She stated the monies will be in my account by 7 days of receipty of the new signed agreement

Fingers crossed for you, i really dont understand their gameplan, it seems to be different with every case, mione had a settlement offer before they filed a defence.

Quick update; signed the agreement letter with the clauses for confidentiality and future claims crossed out, i also rang my bank manager and arranged for a review, she told me she would only do once the cash had been repaid, even though the letter stated the cash would only be repaid 7 days after my review. I have pointed this out and she was very helpful in stating that she will have the money paid within 3-5 days. I did point out that i would continue the case until the cash was in my bank. I also alter the agreement letter to state that they need to pay back the monies 7 days from receipt of the letter. So fingers crossed it will be back in my back by the end of the week:) Their solicitor did say they would settle out of court due to resources being stretched

Spoke to their solicitor and she said that Lloyds will be dealing with all future claims in this way from now on, as it is easier for them to settle quickly and move onto the next case. She also said that they are becoming inundated with claims!!! must be a heavy work load she has.

Ok, saturday 27th got an envelope with 2 letters in it from Lloyds' solicitors. One letter (the open letter) which states that they intend to defend the case in court and they will be filing a defence. This was what I expected. The second letter was an offer to settle for the full amount to be paid direct to my account within 14 days, the only thing was it had a couple of clauses, which are the normal ones thay state to all on the first offer, such as bank manager account review, confidentiality agreement, no future claims, etc. I will be speaking to the banks solicitors tomorrow to let them know my decision!! I shall also post the letters on here when I get a chance. At least it is moving in the right direction!!!

Quick update, the bank have acknowledged my claim and the next deadline is the 19/06/06 for them to file a defence, just have to sit back and wait:rolleyes:

Just spoke to the Courts Lloyds have had the serve made and the days are ticking now. I was also informed of the following, they have 14 days from date of serve, if they acknowledge then they get 28 days but not from the date they acknowledged but from the date of the serve. So that means my next date for action are 06/06/06 (666 haha) 14days for no acknowledgment (as if), or the 19/06/06 date for defence to be submitted by Lloyds Fingers crossed;) Edit: just saw Lorraine's post above and she had already stated the above. Right my moneyclaim request was accepted by the court today, so the 14 days to acknowledge start from now, is that right? so the 29th is my next deadline date:rolleyes:
