      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lloyds TSB ‘How we’re helping’ campaign launches

The new campaign will show what Lloyds TSB does to help millions of customers, day in and day out. Using examples of how many people the bank has helped over the last 12 months, the campaign aims to show how the bank is supporting people when they need it most.

 

Using the strapline ‘Over the last year, we’ve helped…’ the ads show how every individual counts.

 

To start the campaign, two familiar ads are given a makeover, with new voiceovers added. The ‘Babies’ advert, where a new father is given his five children to hold, will tell customers how Lloyds TSB has helped over 90,000 children start saving and invites parents to come in and talk to us about planning for their children’s future.

 

The second ad, called ‘Henry’, shows a family upgrading to a larger home, with the voiceover saying that over the last year Lloyds TSB has helped more than 50,000 customers get a new mortgage.

 

A new 40 second TV advert as well as radio and magazine ads will go live from November.

Over the last year, we've helped..........suck your finances dry........but we won't enter into mediation because at the moment we have the power to continue sucking you dry and putting you at the bottom of the debt pile. :mad:

You can trust in us........Lloyds! :mad: NOT!

 

I have a deep lothing of Lloyds.

i worked at lloyds bank in stroud this year.............im an electrician they were having a refit ............... i thought sod it i hit the manager with a question..................... DO U THINK BANK CHARGES ARE FAIR? he replied basically no!!!!!!!!!!!!!!!!!!!!!!!! i said the c a g would agree with u 2!

All the banks are a disgrace, but Lloyds are one of the worst.

 

Lloyds have helped by preying on vulnerable people and helped destroy the economy.

 

My other words to describe how Lloyds have helped are unsuitable for here.

Perhaps they could show photos of people that have *allegedly* attempted to take their own lives due to the stress piled on by Lloyds collection activities and bank charges?

Over the last year we've helped one of our loyal customers by referring to her husband's attempted suicide through financial difficulties as his attempt to 'top himself' in her subject access request.............

 

..............and yes, they really did do this:eek:

No, although I did mention their lack of sympathy and understanding in several letters to LTSB regarding refunding our bank charges in the hope this might sway them - all refused and this point specifically ignored.

 

Earlier in the year when we were experiencing financial difficulties and LTSB had refused to acknowledge this I also sent a letter regarding our situation that highlighted the point regarding my OH's experience to the CEO which was passed to some menial staff member who again didn't even offer an apology for the way they dealt with this sensitive issue:eek:

OVER THE LAST YEAR... Lloyds TSB has put 5 late charges on my credit file for a bank account I closed LAST YEAR! Rock on Lloyds... Over the last year Lloyds took 6 months to answer one complaint they should have dealt with in 8 weeks. Over the last year Lloyds have failed to give the Financial Ombudsman any explanation as to why they have put late charges on a closed bank account! Honestly guys, the worst bank in the U.K

Has anybody through of writing a letter about this ad to the advertising complains body? The most be enough evidence on these pages alone to prove that this advert is

 

Misleading.

I hate Loyds with a passion. :evil:

 

You'd deffo have a fight on your hands to prove this tactic, Lloyds don't play nicely...........at all.

Keep up the fight against Bank Charges.
