    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi , i had an interview under caution through the benefit agency.They said i still had my ex husband staying at my home since 2006 till now which he has not been.He has a girlfriend which he has been seeing for a couple of years now.They are going on evidence that he parked his works van in my drive a couple of times a week due to it getting tyres done scratched etc at his girlfriends place.i have a large drive and its pretty safe where i stay.He also put my address down when he applied for his job which i did not know this as no paper work has came to my address.He also got a loan in my address which i agreed to as he was buying a car which he agreed when my daughter turned 17 he would give it to her,he kept his end of the bargain and gave it to her .To cut a long story short i appealed againts it which is still in the prosess i have not had a date yet on it getting looked at buy a tribunal service as i have further evidence to send them.I recieved a citation through the door that they are taking it to court i thought it was still to be looked at buy the tribunal service.Can anyone help me with this i cant believe that basically cause he parked his van that this has went this far.I suffer from severe stress and my hair has fell out in patches over the year and i dnt think i can cope with much more.I am seeing a lawyer which has not been that helpfull and is off for 2 weeks .Can anyone please help.:confused:

Hi thanks for getting back to me not really sure how to use this site.

to answer your questions :We split about 10 years ago.

The evidence they have are 1.he started a job approx 2 1/2 years ago he put my address down which i did not know as no mail came here.He said it was because he was between addresses .He has not had a fix aboad for years not my prob though.2 he got a loan in my address which i agreed to as it was for a car and the agreement was that he gave it to my daughter when she reach driving age which he kept his side of the bargain and gave it to her,she sold it and put more money towards it and bought a newer one.3.He was on the voters role ,that was for applying for the loan! 4his ex boss said that he thought he was staying here and said he received a phone call when he was off work saying that it was his wife ,that phone call came from his girlfriend not me.5 cause he parked the van here a couple of times a week over night when he was seeing 1 of his girlfriends as he had a lot of equipment in the back and it was a rough area.It was fine to park at other girlfriends house as it was safer.He came down to walk my dog anyway in the mornings as i have no control over him,he cant be round other dogs too protective just wants to fight.So thats basically it,so any help or thought would be greatfull.I can get a letter from his landlord to say he has stayed ther over the years ,a letter from a neighbour to say she sees him coming down to pick up the van and take the dog out,a letter from 1 of his girlfriends to say they are in a relationship,cant get the other which i think she is married.He has basically said that he is not on benefits and he can stay where he wants that its not really his problem,but he will get the letters for me .

Every thing that you can get that states he doesnt live at your address will help.

 

What about bank statements? he must have going had them going somewhere. I am presuming he has a bank account to pay his wages in etc

What address is he registered to for his doctor dentist etc. ?

 

Because he is NFA no fixed abode then it is most likely that CIS the benefits central computer shows him still at your address, because he has not claimed any benefits from a different address so you need proof that he isnt there.

The letters off the girlfriend will help also get the statement off the neighbour.

He states that really its no concern to him but you have been so helpful to him letting him park the van there etc and now you are left with no benefit, bit unfare.

 

Have you appealed against the decision

And if you are in an new relationship now you should give details of this as well

Hi thanks,i have appealed againts this i am waiting on a date for to go to an oral hearing.I can get the letters from him that is needed.His bank and docs are still in my address as they have not been changed he is been with the same bank about 20 years and same with docs,as he is always between addresses.He was paid off in feb and his girlfriend basicaly keeps him and he does the odd job here or there i think,he does not claim benefits he keeps telling me.His life is rent free.I dont think he has had benefits in the last 15 years approx going with his jobs etc.

When i go to the oral hearing and win that i still have to go to court.If i win the appeal in my favour ,i can be found guilty at the court its crazy.I found that out yesterday at the rights office as my lawyer is off.I am telling my lawyer he needs to get his finger out and help with this or i am going to another lawyer.

I would ask your husband to inform the loan company that he doesn't live at your home any longer and to give them his new address instead.

 

He should also ammend the electrol register to his correct address and park his van somewhere else.

 

All the circumstances which indicate that he lives full time with you in can be reasonably explained and the failure to change address with the loan company/electrol register were unfortunate 'oversights' on your husbands behalf which he has now taken steps to correct,
