      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Been haing trouble with Welcome Finance for nearly 4 years sold me a dud car and its gone from bad to worse

Won a PPI refund through the OMBUDSMAN but due to account dispute have not made a payment fro over a year

Anyway have won nearly £2000 plus compensation onlyto be told that it will be refunded to teh account due to the arrears they may pay me a cheque for £500 for the 8% interest and compensation for saying they would pay me then they wouldnt, they have been so nasty to me

Phoned the compliance department yesterday and they are useless been dealing with the local office in Hull and they are worse they reduced my bill in May to £2000, but failed to tell compliance so now compliance will not refind teh PPI through the ombudsman till i sign a new agreement which I am not willing to do they are such liars

Can someone please help me I am fed up I want these people now in court""

Dont sign an new agreement whatever you do. You now need to go back to the Ombudsman and complain that they haven't complied and are being 'inventive' with the money you are due. The Ombudsman has a right to enforce these companies to carry out the compensation it awards YOU, not THEM and need to be informed asap.

 

Also with the Acceptance Fee, PPI and other ''cost for credit' in that agreeement I think the entire agreement is unenforceable but then its not my area of expertise.

Thanks Silly Girl I also agree I have tried to get someone to help me because I only owe them £2000 so they told me the collections at Hull told me this in May but the compliance department have said no and that I owe £3780 I should never have believed them they are liars

 

I had a solicitor working on this for 2 years and because the balance was so low I could not get legal aid therefore I could not afford to take this any further do you know anyone that could help me no win no fee I am desperate the slimy sods now want to take teh car and sell it a auction and I still would owe £2700

Also the ombudsman cannot help me anymore they have said as I should sign a new agreement"" not preapred to do this therefore they have said at welcome I am not getting a refund""

Morning Mich. I am sure one of the experience helpers will pick up on your thread as soon as they can. It has been very busy on here these last few weeks. Your dealings sound like a typical Welcome Nightmare Story. Dont give up hope. I am sure help will arrive soon !!

i take it you have had your agreement checked out (confirm)

welcome seem rather keen on getting you to sign a new one

 

2004/5 welcomes agreements were nothing more than toilet paper

 

what should happen is the loan is taken back to where it all started minus the ppi

then take off your payments plus 8% interest

 

then the total is what you owe

 

that gets rid of any penalty charges etc

 

you say the car is a dud

 

what excuse did the warrinty people give not to pay out

 

was it

Re the agreement I have had the law society look at it and they have said its unenforceable as it was not signed by Welcome on the date I signed it it was posted by me to Manchester

I cannot afford a solicitor had a lady from stephensons looking at the details for nearly 2 years she then turned round and said she could do not more as the amount I owed was under £5000 and she could not get legal aid

 

The crafty devils at Hull who i have been paying my money to said in May they would reduce the balance to £2k as long as i started repaying which I did I never recieved anything in writting just a text message yet when the compliance department got involved re the PPI they did not know anything about this and will not agree the balance is £2000 so guess what I am not signing a new agreement so I am not getting the PPI refund

They are terrible I have sent my agreement to a no win no fee company and I belive I have a winner

The car needed a new engine after 3 months and then it just went downhill, and is not been used now the crafty devils have offered to take the car and sell it at auction do they really think I am stupid"":evil::-?

what excuse did welcome give you on not being able to repair the car ref warranty

 

please post the agreement minus personel info onto your thread

Hi I cannot use photobucket at work its a PDF file if you give me yor email address I will email its a real good one

 

I did get the car repaired under warrenty but when the warrenty expired I had to start paying hence it been sat on the driveway for over a year

hi there just emailed my agreement let me know if tyo want teh garage invoice as I said there is 20 diffeence plus the agreement was signed by netcars who were the brokers at the time in Manchester not in York where I bought the car""
