    • Thank you very much for your letter in regard to the above mentioned shipment.  Due to the high volume of parcels coursing through the courier network each day, undergoing continuous processing and handling, certain packages may experience delays or even can get lost in the course of this journey. Please note that due to the time that has passed, this shipment has been declared as lost.  I have today processed the claim and made offers to the value of £75 as a goodwill gesture without prejudice. I do acknowledge that you have mentioned in your letter that the value was higher, however, you did not take out any protection to that amount. The protection for this shipment was £20 and we will not be increasing our goodwill offer any further.    Please log into your account online in order to accept our offer. Once accepted, our accounts department will process the claim accordingly. The claim payment will be processed and received within 7 working days.                                  In addition, a refund of the carriage fee will be processed as a separate payment and will be received within 3 working days.  If I can further assist, please feel free to contact me.   I have also just noticed that yesterday afternoon they sent me an email stating that "after my request" they have refunded the cost of shipping. I did not request the refund so will mention that in my letter as well.
    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy?     • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks Michael,...nothing better then to be sure ,..And on the schedule of charges I will add the calculated interest on these charges,..not the 8% which is only added if going through the county courts,..Am I right in thinking this ,If so the speedsheet will add this?...just read on the forum the thing about adding the interest ,...sure you will point me in the right direction ,..thanks Mx

Hi there again read over the spreadsheets and see that I need to know the balance of the account to work the calculated interest on the charges,...I do not know these figures so are a little stuck working this interest out,...could I leave the interest off,..As I know this will be going to court so the 8% will be added to claim which will be a lot easier to work out,...Or will the abbey see this as not knowing what I am doing???????And here is me thinking I am ready,...all thoughts welcome sorry to be so thick Micheal.

Hi all got everything sorted out now,...printed off the non-compliance letter giving the 7 days ,Primilary letter requesting the charges back (30% from old statements 70% estimated ),Also schedule of charges applied to my account,..run off 3 copies (1 for myself incase need any proof in court,..a copy for my local branch and a copy for the department which deal with these claims,)..will be posted tomorrow recorded delivery... So now the Fun Should start,..Get this case out the way then there is a few more companies including old credit card providers that will be receiving a S.A.R ,..Will consentrate on this claim first as priority as this will be very handy for Christmas Shopping,..Nice to sit back mid-September knowing Christmas is sorted no worries this year round,..or at least 99% no worries,..Will keep a update how things are going ,Welll not long now the 40 days has passed half way there,..all down hill now,..So excited now...Hope you all have as much fun as me doing this and best wishes & luck to all who give it a go ,..nowt to lose.

Have been reading this thread and you are at exactly the same point as myself and have been asking the questions that I have been asking myself! So just to get things clear, you have put all your charges on to a simple spread sheet including those that you have no statements for(these you have estimated by working out an average for a month),and have included the 8% interest. Have you now sent that with the Preliminary approach for repayment letter?

im at next stage from you guys court and im not altogether sure what im doing but im sure it will be alright on the night lol joking aside the longer it goes on the better for your bank balance do they still keep charging you cause the silly people do me still nice little earner eh!!xxKia

Well still nothing off the abbey,..Not even a letter to say their recieved the non-compliance letter,.. Well it looks like court it is,..Think I will get my LBA letter sorted out aswell as the 14 days are up next week,..And Kia you are right nice little earner and their can take as long as their wish,..the longer the wait the more the money their will pay out,..Will keep this updated M.

michelle if you send a notice of action letter at the same time as you issue the MCOL they cant then claim they knew nothign of the case, less chance of it getting set aside???

Right gang,...the 7 days are up tomorrow for non-compliance of my list of transactions/charges,..Should I file with the court ?...Also can I do this online,..Or am I getting mixed up and only claims can be lodged online?..any advice would be greatly appreciated as I am more than ready for any & all battles with the shabbey,..next week there will get the LBA letter and 14 days after that I will file straight away for court as their attituide needs to change big time,..Well sure their will get sick before ourselfs,..Well best wishes all with all you challenge M.

So I just fill the non-compliance to suit my situation??also is the N1 on the site to look over or download??all help needed now as shabbey have had a day over now,..(Been busy with work to get myself even after all the charges,..)but all advice is welcome as I need to act. thanks all Mx.

Thinking over things,...think I might let the non-compliance slip,..might not file for missing statements,..(there have had there chance)think I will wait till next week till the 14 days are up for return of estimated claim,..Then its the LBA,..can not be bothered spending time chasing things what their do not wish to send,...Let the estimated claim run,..Do not mind paying £30 to adjust the figures,...Well what you all think???????

Hi there again Kia,..Think I have it worked out now at long last,..Not going to bother with the non-compliance(I have a estimated claim their will have to show these at some stage after I put the estimated claim to the courts)

 

Sent them my prem letter 19th sept so from the 20th I will take served as next day recorded delivery,..The 14 days is up this wednesday 4th october.

Will send the LBA Letter on the 3rd to arrive the 4th.(Giving them a further 14 days (18th october) Then will file my claim with the courts 3 copies of N1 plus 3 copies of schedule.

Assuming ;Notice of Issue is within 2 days (like most of the others)..Their have 14 days to acknowledge the claim(3rd November)...(IF NOT I WIN BY DEFAULT)

 

If their acknowledge the claim their will have a further 28 days to submit defence.(1st December)

 

*No defence after 28 days, FILE APPLICATION FOR DEFAULT.(1st December)

*Once the Defence is lodged with the court it will take about 2 weeks to A+Q's stage(15th December) .

 

Any thoughts on this is more than welcome,..This is my plan after reading all weekend,..if you can pick up on anything which is not correct please feel free to point this out,..

glad someone on the ball not me thats for sure i thought i had it cracked over adding the interest thing on the claim for court but now theyve really confused me by saying you have to add 0.22p for every day from when charged and thats thrown me now i thought you just added 8% interest will someone tell me if this is right for boyh our sakes taXXkia
