    • Paint is a free programme on any Windows PC. But don't worry, the choice here is not either perfection or nothing. As you say, use your scanner, save the file ... and then use the "choose files" option when you post to CAG to add the file. We can do all the redacting and converting to the correct file type at this end.  The important thing is just to get the info to us. Why not do an experiment this afternoon and see if the above works?
    • I see they're trying to round up asylum seekers and lock them up for about three months so they can be put on planes to Rwanda. I'm a bit surprised that this is legal.
    • thought for the day "Prime ministers need a big strategy that tells you where you’re going, you need a bunch of tactics that get you there, and you need the ability to take everybody else with you."   Now I know you are all thinking 'why is the  UKs destination Rwanda ???
    • Asset Link filed for a default CCJ against me, in relation to an old Barclaycard debt which I apparently signed an agreement for back in 2000.   I did not own a Barclaycard in 2000 so I know this is not true.  The CCJ notice was sent to an old address so I did not receive it.  Years later when I found out about the CCJ when I applied for credit, I put an application in to have the CCJ set aside.   As part of the set aside case, I was asked by the judge to provide a draft defence, should the CCJ be set aside.   The defence I provided was that I did not admit to the debt as I had not been provided with any evidence of an original loan agreement.   I won the case and the CCJ was set aside.   Link then filed to court again to make me pay the debt.   We both filed directions questionnaires and the judge allocated the claim to the small claims track.   As part of the directions, additional directions given were as follows ' Additional Directions in a claim for an Assigned Debt - Because the claim is in respect of an assigned debt the Court makes the following directions for the management of claim.  The claim shall be automatically struck out at 4pm on 3 April 2024 unless, before that time, the Claimant delivers to the Court and to the Defendant the following documents'  It then listed various documents such as an original agreement, deed of assignment, notice of default, statement of account setting out how the alleged debt accrued under that agreement etc.     The Claimant failed to provide these documents within the deadline provided and instead I received a copy of a bundle of documents provided by them in preparation for the court date, this was received weeks after the deadline.    I have called the Court to ask if it has been automatically struck out and they advised that it is not automatic and that I should still send my witness statement by the deadline provided, which is Wednesday.  This does not give me much time to prepare my witness statement.   I have never done anything like this before and I am unclear what my witness statement should include.  My thoughts were that I should keep it simple and stick to the facts, like the fact thy have not provided evidence of the original agreement, or the deed of assignment of the debt.   They have provided a copy of a default notice from Baclaycard dated 2015, this states a figure of £550 but the debt they say I owe is £10k.   I am not sure what makes a valid default notice?   I have previously requested proof of the debt from Barclaycard directly and have evidence of emails between us where they have been unable to provide me with the agreement or any documents at all relating to the debt.   Should I include these as an appendix?  Are there any other documents I should include in my bundle?    I have also tried to mediate with the claimants, to save the court costs and time, on a without prejudice basis, but the claimants solicitors refused to mediate.   Should i state this in my witness statement too to show the judge that I have been reasonable and they haven't? Many thanks   Louise

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Got a bit of a problem with a debt recovery company....CapQuest!

Approx 2/3 years ago I had a Abbey bank account which had a overdraft limit of £100, due to financial difficulties of buying a house etc.. I was unable to pay the overdraft off! I had spoken to Abbey explaining my situation and that i could pay very little to pay the overdraft off, however they would not accept this and demanded I paid it off in full!

Unable to pay the £100 off at once, the only thing i could do was leave it until i could get some money together to pay it off. However this wasnt quick enough for Abbey and I got charge £30 for failing to pay off the overdraft, then a couple of months later they charged me £50.

So I was even more unlikey to be able to pay off the balance of £180!!

A few more months went by and Abbey kept sending me letters, a few more months went by and I admittingly forgot about it! We then moved into rented accommodation and never heard anything of it until a month ago.

I applied for my first credit card with Halifax, I wasnt approved for some reason, so I subscribed to Experian to see if there was anything on my credit file. Thats when i noticed a default payment or something from Abbey for the sum of £180.87.

I then received a letter from Abbey on the 18th August saying my debt had been sold to a debt recovery company.

The same day I received a letter from CapQuest informing me my debt had been sold to them and requesting I contacted them.

Then on the 21st August I got another letter from CapQuest asking me to make a payment of £180.87 by the end of August.

All letters were in the same envelopes marked with UKMail and on the reverse they all have the same PO Box address! Plus the letter from "Abbey" looks strangley similar to the letters from CapQuest! Pritty much the same format! Same setup, same font, same font size etc... even file reference codes in the same location!

Just after a bit of advice on what to do? I dont want to ignore it any longer, but I dont want to pay the full amount if I dont have to.

Is there information I can ask CapQuest to provide me with to show me how the £180.87 is made up of? I havent contacted them yet, but feel i should do soon otherwise i'll only get another letter!

What do i do?

Any help/advice greatly appreciated.

Adam

Hi Adam.

You could send a SAR directly to Abbey, which should produce all the data they hold on you, and throw light on any unfair penalty charges added to the account.

The link is below. They have 40 + 2 days to comply.

Keep us posted, and shout if you need more help :)

Hi, you could write something on the lines of:

Dear Sir/Madam

Ref: Account Number:

Thankyou for your letter re the above account.

Unfortunately this account is in dispute due to inaccuracies including unfair penalty charges.

I have a Subject Access Request pending and therefore request that you hold action on this account until Abbey have complied with my request and I have had chance to examine the documentation.

Yours faithfully...

Or anyone else have any ideas?

So just to get this right, im sending a letter to Abbey asking for information on my account, charges etc.. etc...

Then a letter to CapQuest informing them of the letter to Abbey and would appreciate if they would put it on hold until i receive the info from Abbey.

Shall i send a copy of the letter to Abbey to CapQuest? or not?

Well ive sent off the letter to Abbey and CapQuest so ill await the reponse.

However i received a letter from HL Legal Solicitors yesterday which reads along the lines of....

"....TAKE NOTICE THAT unless this account is paid in full or a satisfactory proposal for settlement is received by 18th Sept 2009 court proceedings may beissued against you without further notice.

In the event that court proceedings are necessary the following costs will be added to the debt.

Balance of Account £180.87

Court costs £15.00

Solicitors Costs £50.00

Total £245.87

Interest, where applicable will also be added, accuring on a daily basis...."

Should i send them a letter similar to what ive sent CapQuest stating that the account is in dispute etc....?

One thing for inexperienced Caggers to note:

adz3785 subscribes to Experian and suddenly he gets a letter from Abbey! This is why the CRAs are so keen to get people to sign up, especially those with any adverse credit history, because they will instantly pass your information on to anyone who wants it... and they charge you for the pleasure!

Yep just goes to show how they're all sharing the same toilet, to put it politely :)

Just managed to stop one of my offspring in time from joining Experian as there's an army of skeletons from her student days in another part of the Country. She'd no idea it would bring them down on her like a scene from Sinbad!

The worrying thing is that your data must have been flagged... I think every time someone subscribes, the CRAs must actively push your data to see if anyone's after it. Very smelly. Sure there must be something dodgy and against data protection principles in there somewhere.

Hmmm, following on from Undercover Debt Collector, how about Undercover CRA?

I wonder how proactive it is.. does the CRA issue a list of new registrations to the DCA's (for a fee) in a similar way the Government publish lists of people who die intestate, for instance?

Or do the DCA's do all the legwork by repeated automated searches for anyone on their books.

Either way all new registrants are sitting targets on the basis that if they registered they probably have debt concerns.

I got hit with this, just moved back to the UK and thought I'd do a check on my Credit History as Direct Line (House Insurance) were so good to offer me a free 'Credit Expert' membership (Experian). So foolishly I entered my details.

3 weeks later and out of the blue I have Capquest chasing me for alleged debts from my previous marriage!!

Agree. I want to access my Credit Record, but cannot do so as (i) I do not want my new address to become part of their database and (ii) I do not want to "flag up" I have searched the file. It seems these are real impediments to people being able to check their own credit situation.

The CRAs will not let you access your data unless you provide them with a current address and give them permission to use the data you have provided. The only option is perhaps to use a PO Box number, but they probably won't let you do that. It really does smell...

... and that's why CAG has a whole forum for it!

Ok guys slight spanner in the works! This debt is now a big problem for me!

At the weekend me and my girlfriend went to Halifax bank to arrange to open a joint bank account for when we move into the new house we are getting built.

Thing is it was declined due to me having a "Default" on my credit file, i explained to Halifax that the matter was currently in dispute, however to allow us to take out the joint bank account with overdraft facilities they require the debt to be "Satisfied"......which got me slightly worried as we are currently applying for a mortgage and i have no doubt that this will cause some problems for us.

Question is what do i do? i dont want it to affect us being able to get a mortgage!

My initial thought was to ring CapQuest and ask for a settlement fiqure to get the debt paid off so it wont show as still owed on my credit file.

Any advice?
