I can't really find a proper answer to this on the forum, my apologies if it is covered somewhere and I haven't found it. I am just wondering if you should continue making payments towards a debt balance if you are disputing it if:-

 

1).The amount of debt is less than what they owe you back in charges?

2).The amount of debt is more than what they owe you back in charges?

When i entered into my debt management programme, i was advised to make nominal payments until the actual arrangement was set up but i wasnt actually disupting the amounts then.

 

I paid £1pcm to each of my creditors agaisnt debt s of close to £26K. Im not sure whether this is the same for debts in dispute.

 

I would say that irresepctive of the amount of the debt you need to act formally if you havent done so, as otherwise you may find they ignore any informal or unclear approaches and cause more grief.

 

I would wait for a bit to see if anyone answers your question who has more specific knowledge or experience.

If you tell them you are disputing it and taking court action, it would help. Tell them you will deal with any issues they have after the dispute is resolved, but only then. It worked for me, the bank sent 1 letter saying they wanted the O/D issue sorted, I responded with the dispute/court thing, and they have gone quiet.

I`m just at the stage of AQ form now, not long to go, if they pay up, my O/D (mostly caused by 6 years of their charges) will be gone.
