Until they provide a CCA they cannot take any legal enforcement, which includes sending 'heavies' around. If they do they will be tresspassing and they can be removed. ;) Besides, that is extremely unlikely. On the rare occasions that a 'doorstep' collector calls they are of the 'plastic mac' variety who are self-employed & work for a pittance and should be told to;

As for your credit file, it's nigh on impossible to get them to remove defaults. Have a read of; Knocked back by a DCA on a Sec 10 notice? - The Consumer Forums

Hi i just wondered how it is going?

I am too scared to do that cca thing so i just pay lx and littlewoods (ndr) £187 a month. But they stopped my nterest immediatelt as mine went to Ndr. So when i hear alot about this interest applied here i wonder why it never happened to me.

I have just read through your posts and you really need to get a cca of to the oc, and can you afford the monthlys that you are paying?.

Hi there well i cannot really afford them but it is 1/2 what i was paying when i had my account which i will have to get by until i get a job again. I dunno these cca things they look like ppl get alot of bother from them and i don't like hassle so i agree to anything for an easy life really. I worry very easily so i pay them what they ask. As the last thing i want is to be took to court :(

Ok I am still receiving statements adding on £12.00 each time for not paying from NDR so I have sent them another letter enclosing my previous letter and highlighting the fact that they cannot enforce this debt. I have yet to receive a reply.

On the other hand I have sent all the letters to Freemans and received a blank CA to which I replied with the "Account in Dispute" Letter to which I am still receiving bullying phone calls and letters, when they telephone I ask them not to discuss my account with me over the phone, I tell them I have sent letters and they are to correspond with me through the post. The only thing they send me are horrible threatening letters and statements with more charges. I am not sure whether to send the Final Notice letter and where I would find it or should I send the bullying by telephone letter in harrasment section of templates? Any ideas please would be very much appreciated.

Ok well all has gone quiet on the Littlewoods front but Freemans are being problematic. Telling me that the ca (unsigned) that they sent me was sufficient under the "Consumer Credit Regs of 1983" ie as it was signed by them this constitues an agreement and as I have pruchased goods. They continue to add charges to my account even though I have sent them all the letters. They enclosed with the letter a document from ICO. This apprarently reiterates that it is sufficient. They also go on to tell me that they will hold my details on file, which I was already aware they would do. They have sent me an offical Default Notice and also said "that the websites that have these templated letters, do not constitute sound legal advice". The letter was signed off by a Credit Liasion Officer.

I am not really sure what to do next I thought it was all cut and dry but it seems they have a "get out" clause. Is this something they can action?

The Default Notice is defective. They've only allowed you 13 days to remedy from the date of the letter. Besides it being one day short, they haven't allowed for postal service it was posted on a Friday so could not have got into the postal system before Mon 16th. If it was posted 1st class you wouldn't have received it 'till 19th if second class 21st yet you were supposed to remedy before 26th.

Just ignore them, they go away after a while. I had them chasing me for a couple of months for Additions, same as you no CCA, then they just stopped. And I noticed on my credit file today, the account is marked as in dispute (q) and has been since August (which is the last time I heard from them) So I guess they have given up, at least for now.

Hello all and a Happy New Year to you all!! Well I thought it would be a happy new year anyway but it turns out that Freemans have other ideas!

 

I received a letter on Thursday 14th Jan from a Debt Collection agency telling me that I should pay the full amount owing to Freemans or ring them to arrange a payment scheme to suit. I was under the impression that as long as the account is in dispute they couldn't charge defaults nor could they involve a third party, which they have obviously done!

 

I am not sure what are the next steps that I should take as they have totally thrown me of the course I was following! If anyone could please help/advise me further about how to tackle them as it seems they won't let this go without a fight! Many thanks in advance, Donna
