    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though. A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok I get a few of those letters through my door offering extended warranties on my sky box.

 

Recently my sky has started playing up, not recording stuttering etc.

I have been a Sky member since day dot so even though my box is more than a year old has anyone had Sky repair there box for free?

 

Maybe by stating sale of goods act and stating that you expect a sky box to last longer than a year?

i would first get your signal strength checked & that you have clear line of sight to the sat.

 

most of these issues are related to poor or int signal.

don't forget it has two connections to the dish LNB, one is offset, that wil not like anything but a very strong signal.

Do you think Sky will repair it FOC?

 

Dont know what package you pay for but a friend who has a package costing £50.00 per month had his sky plus box go down. He was offered a repair for £65.00 which he declined and cancelled the lot telling them he would go to Virgin who repaired for free. Ten minute later he got a telephone call from Sky who offfered a free repair or replacement and six months at half price if he would return.

PUTTING IT IN WRITING & KEEPING COPIES IS A MUST FOR SUCCESS

Yes dw is right i did the same they wanted £65 to come out so i told them to put me though to cancellations.

 

I did not get this far as they changed there tune and sent an engineer out the next day he replaced my sky+ box LNB and connections for free and had a zero bill the next month.

 

So in short ring up explain the fault and soon as the mention £65 ask to be put though to cancellations works every time they do like losing business to virgin and will hold on to customers at all costs.

If you like having a go at fixing, then unscrew the lead at the dish and clean the connection and make sure it is firmly srewed back up, do the same at the box and then you can give them a ring.

had something similar happen to my box rang them up and went through doing something like a factory reset and it cleared it and has worked fine since, I think it may be something to do with them being hdd recorders and the files get fragmented over time.

Try a full system reset, you will lose all of the contents of the planner and anytime recordings.

 

To do a full system reset

 

 

  1. Press SERVICES
  2. Press 4
  3. Press 0,1, SELECT
  4. Press 8

To help prevent file fragmentation do a planner rebuild once a month (same procedure up to step 4 where you then press 7). Like a PC, over time, the files become fragmented which can cause slowdowns and random crashes.

The advice I give in relation to benefits should be viewed as general advice and not specific to your individual claim circumstances. I cannot give specific advice on your claim as I cannot access the claim.

First do the 'system reset' as outlined above. After the box has been in standby for five minutes, unplug the power cord at the back of the box. hold in left and right navigation buttons or 'cursor' buttons on the front of the box. Reconnect power lead whilst holding in these buttons. Do not let go of buttons untill green playback disc lights up and starts flashing, then let go of buttons, by which time your fingers are hurting. Then press 'select' on the box, you will see disc rotating and then after a while, could be several minutes, box will go to standby. After five minutes switch on and recording should work ok, in most cases. Just like the hard drive on your computer, every so often it needs to be defragged/reformated.
