Hi

 

I took out an order with a company and both the order form and invoice have my details on. My wife signed the invoice as i was at work at the time. She also payed a deposit on her debit card which is linked to our joint account.

 

My question is as my wife signed the form on my behalf and made payment on her debit card from our joint account is she liable for any debt or court action that arises from this? The company in question say she is.

I wouldn't have thought so as this is in your name, not your wifes.

 

Her signing for the delivery means nothing (I sign for deliveries at work - if my company didn't pay for them creditors would not hound me for the debt) and the money was paid from a joint account - although, it should not matter where the payment came from - it's still is, and will remain to be, your debt.

 

The company are, it seems, trying to scare you into paying up......

She has simply signed for the ordr as she has entered her debit card details which belongs to our joint account.

 

They issued her with a CCJ as they are saying its her account, she only signed it because she used her card to pay the deposit.

 

The order was made by me and has my name on the invoice, order form and remittance advice slip.

I am no 100% on this and am hoping someone else will come along to answer you. I still feel that this is not right though. This is your order......it's like me ordering something out of a catalogue I suppose. No matter who pays what, or who signs for it, the debt is still mine.

 

You could maybe go for a set-aside re: the CCJ that is in your wife's name, but I would wait and see what other CAGgers have to say first.

Thats what i am looking for some solid advice i can use against them. They also said as she signed the CCJ admission form then that is another reason the debt his hers. She signed the admission form as we have never once dis-agreed with the amount we owe. Its they way we have been treat by this company and how they have gone about things.
