    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have you increased the size of this document? The one they sent me is terrible, it's so tiny it makes it very difficult to make out anything.

 

 

 

Did you have a page that mentioned 'snakeskin' on it? I have, which I think may be due to application being made on line.

 

 

I have enlarged it with my scanner. This is the whole of the 'agreement'. There are no other parts.

Mine was on each side of 1 sheet of A4 which is mostly black apart from the small forms, I increased mine on a photocopier but they are very blurred. They also sent the T & C's which seem to be standard, as you say, recently made up.

 

Think I may SAR now to see what else they can muster up.

On the side of the slip where it listed my name, it says' before signing this agreement you must read section 11...' but there are no T&Cs contained within the document- no section 11 to read.

 

Looking closer at the photocopy, something weird is going on at the top, like they've cut two pieces of paper out an laid them over each other. The very top shows a dotted line and scissors icon. The next section looks laid in because at the bottom of it there is another dotted line. Looking across to the lefthand side of this area you can see the thick black line does not match up.

Could really use some help gang.

 

They don't respond for 5 months. Yesterday I get the above sent to me out of the blue. Today they have already called my home, mobile and work number. Message left by very aggressive sounding person.

 

Need to know how to respond.

Ok, letter from Trading Standards has arrived! At least there is finally something happening. They confirm MBNA's breach and confirm the account has been in dispute since May. The letter advises me to forward it to MBNA, which I am doing with today's correspondence which also includes a copy of the telephone harrassment letter sent some months ago.

 

Can anyone in the know comment on the application that they sent?

You will find MBNA a particularly hard nut to crack. I would suggest you look through other MBNA threads.

you will find that no matter how technical your letter is, it will be ignored. The threatmachine has started and will continue regardless of what you write to them.

Thanks for that. I have pm'd SF and asked her sage as she is a conquering warrior.

 

The letter I sent yesterday was about 9 pages in length. I sent it recorded to a named 'Head' at MBNA and marked the envelope 'Private and Confidential'. The rest will be short and sharp as you say.

Ok, they have just called me at work AGAIN!! This is really going to get me into hot water with my job as I'm not supposed to take personal calls.

 

What can I do? I've written to them repeadedly to ask them to stop. I've sent the phone harassment letter 3 times.

Had to split this out from my main thread, as it's now a real worry for me. I have never supplied MBNA with the name of my current employer OR the number. They have just disclosed the documentation they have on me including my contact details and it listed the employer I had years ago.

 

Somehow they have found out my current number. They have started calling my office repeatedly. I am in a 'hunt' group so any number of people can get the calls.

 

They have left messages with my secretary.

 

I have sent them the harassment letter 3 times.

 

This is going to jeopordise my employment.

Hi MeeBroke,

 

I took a call from MBNA in the early days of my dispute and mentioned to the person calling that I had spoken to an EX work colleague who told me that they had called me at a works number they held. I asked them to remove this number as it was no longer valid. No calls made to that number since.

 

Didn't however work with Cap 1!

Ok so this morning I decided to go against everything I know and actually speak to MBNA over the phone. They rang, I answered. The person I spoke to was someone I had written directly to before. He was surprisingly nice and seemed to understand whenI explained my solicitor had instructed me to not discuss the account over the phone. He was happy with that. Call ended.

 

 

They have tried to ring me twice since. 3 calls in one morning :(

Now an envelope has arrived Recorded Delivery. It contains the same grainy photocopy of the tear off section of the application shown above. It doesn't have anything else in the envelope, not even a short letter. Nothing.

i really sympathise with you at work, i had a couple of calls from calders at work and i work for a government organisation.. guessing it would have to be a civil type injunction not to contact you that you may need but you will need evidence, time date, who you spoke to and most of all witnesses or recordings of the call, if they ring again tell them its being recorded and will be used as evidence in court. wonder if ofcom would help but doubt it as i tried this route
