Hi Leviculas

I am pursuing egg also, my case looks almost identical to yours, I opened my account in Mar 2003 and my argument is that I did not select PPI and genuinely did not know I had PPI. I did try to cancel it and was told that until I had a zero balance I could not. With this being my only argument do you think I have a case?

Hi Leviculus, Just reads your thread and feel inspired as i have just had the brush off from egg.

My credit card was taken out in 2001, but i can't remember if the ppi box was pre selected.

When you submitted your claim to the FOS, did you say that it was pre - selected or did it you leave it for them to investigate?

OMG..........1st Success……….Received a letter from EGG in response to the one in the last post putting their hands up and closing the complaint with a full offer of over £4000 + 8% interest. Logged into my account last night and it is already there, albeit this is direct into my Egg account and is absorbed by the outstanding balance but does give us some breathing space. Many thanks to Alanalana for all your help, not only do you give good advice but you also give people the confidence to keep going. I still have Virgin and Barclays yet to contend with but now am thinking "bring it on". I will definitely be making a donation to this site when I next get paid.

quick update money refunded to my credit card account no contractual interest received. :mad:

 

 

I believe the Contractual Interest issue will at some point be addressed by the FOS but at the moment it seems 8% statutory is all one can hope to get. Whatever action you take you may get your premiums back with 8% stat simple interest but the banks although losing the PPI fight will be multiple pounds into profit from the time they have taken your money until the time they repay some of it.

 

You should have received 8% statutory interest on the amount you claimed.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

hi livis i left it to the fos to decide whether it was pre selected or not but i already had a fair idea that it was after reading around the other egg cases and it turned out that it was, had a lovely cheque from egg the other day compensation awarded by the fos so im not quite so angry now :D aa i have complained to the fos regarding interest hike they said that my ppi complaint may have highlighted that my account needed reviewing and that they were within their rights to hike up the apr so nothing i can do :mad:

I thought they had to actually send you the cheque and let you decide whether or not to pay against account. Did they send you break down first and if so how long after accepting the ombudsmans agreement that they had to pay you the money back did it take.

hi wayout it seem that they do what they please i had the amount claimed plus 8% interst back on my card and then 2 weeks later a cheque for compensation of a few hundred pounds good luck with yours :)
